預售屋相關問題之研究 / The study of pre-sale housing

「家」，是每一個人安身立命之所，很多人打拼了一輩子，充其量不過是希望有一個舒服的安樂窩，所以，「買房子」也就成為許多人一生追求的目標。傳統的房屋契約是採所謂「先建後售」之方式，也就是由建商先將房屋蓋好，再將之出售。但由於近幾十年來經濟發展快速，房屋需求量不斷增加，傳統的「先建後售」模式不僅曠日費時，而且一般建商在一開始興建時並無太多金錢以資因應，所以「先售後建」之預售型態的交易方式逐漸興起。雖然預售屋之興起有其背景，但其與傳統的成屋交易畢竟不同，也存在著多種風險，故使得實務上眾多預售屋糾紛益彰棘手。本論文欲討論預售屋契約交易中產生之法律問題作一詳盡的探討，希冀對法律問題的解決及日後預售屋相關法律之修訂有所助益。
