Santrauka Darbe apžvelgiami Darbo kodekso 235 straipsnio 2dalies 8, 9, 10 punktuose numatyti darbuotojų atleidimo be įspėjimo pagrindai, kai darbuotojas šiurkščiai pažeidžia darbo pareigas. Minėti 235 str. punktai apžvelgti ne tik teisiniu aspektu, bet ir istoriniu bei palyginami su kitais teisės aktais bei kaimyninių valstybių teisės aktais reglamentuojančiais darbo santykius. Panagrinėta Lietuvos Aukščiausiame Teisme nagrinėtos civilinės bylos susijusios su šiurkščiais darbo drausmės pažeidimais pagal punktuose numatytus pažeidimus, iškeltos problemos ir trūkumai susiję su atleidimu iš darbo remiantis šiais aspektais.Taip pat paliesta kolektyvinių ( grupinių) ir individualių atleidimo iš darbo atvejų sąsajumas remiantis 1998 07 20 ES direktyva Nr 98/59, o taip pat panagrinėta specialių darbuotojų kategorijų atleidimo iš darbo už šiurkščius darbo pažeidimus specifika ir palyginta su Darbo kodekso reglamentojamomis šiuos aspektus normomis. Darbe akcentuoti pagrindiniai kriterijai kuriais remiantis galima atleisti darbuotoją be įspėjimo, kai jis šiurkščiai pažeidžia pagal DK 235 straipsnio 2 dalies 8,9,10 punktuose numatytą darbo drausmę : 1. DK 235 str. 2dalies 8 punktas – kai darbuotojas darbo metu darbe yra neblaivus, apsvaigęs nuo narkotinių ar toksinių medžiagų, išskyrus atvejus, kai apsvaigimą sukėlė įmonėje vykstantis gamybos procesai: - konstatuotas darbuotojo neblaivumo faktas; - darbuotojas yra neblaivus darbo metu; - jis yra neblaivus darbo vietoje ( t.y... [toliau žr. visą tekstą] / Summary The Termination of Employment Contracts Due to Gross Breach of Labour Duties whereas Encroaching on the Labour Treatment (Pursuant to Item 8, 9, 10, part 2, art. 235 of Labour Code of the Republic of Lithuania) The Paper presents review of the grounds for termination of an employment contract without notice in case of gross breach by an employee of work duties as provided for in Paragraphs 2(8), (9), and (10) of Article 235 of the Labor Code. The indicated paragraphs have been reviewed from the legal as well as historical point of view, and compared with other labor relations-regulating national legal acts as well as legal acts of neighboring countries. The Paper also contains analysis of the gross breach associated civil cases which were subject to hearing at the Supreme Court of Lithuania, and indicates the problems and drawbacks associated with termination based on the indicated grounds. In addition, the Paper considers correlation of the cases of collective redundancies and individual termination under the 20th July 1988 EU Directive No. 98/59, as well as the specifics of termination of employees of certain categories for gross breaches of labor discipline in comparison with norms regulated by the Labor Code. It was synthesized from terephthalic acid and FeCl3.6H2O under air-free conditions and characterized by its crystalline structure, functional groups and temperature resistance. The kinetic data results were best adjusted to the pseudo-second order model (R2>0.963). The best-fit isotherm, Langmuir model, suggested the adsorption of DMA is localized on homogenously distributed active sites on the surface. This fit was confirmed by the value of β = 1 on the Redlich-Peterson model. Our study suggests that the manipulation of novel materials such as MOF-235 promises new avenues for water treatment solutions. Deixis has had a useful, yet fairly one-dimensional history in Linguistics. The core of traditional deixis is essentially the manner that the utterance reflects the spatial and temporal position of the narrator. The aim of this study has been to pursue a paradigmatic application of deixis to literature, much as Snyman (1983), Anker (1987) and Fludernik (1997) have utilised deixis as a stylistic tool in the analysis of poetry, short stories and shorter novels. What this dissertation proposes is that deixis could also be a viewed as a literary paradigm in the analysis of literary texts. The deictic paradigm can also be especially important, as a narrative structural principle, in the evaluation of literary texts where space and time causes particular difficulty. In order to develop deixis as a paradigm, a spatial and temporal deictic analysis, is emphasized.

Following a NEA high priority nuclear data request, an experimental campaign to measure the prompt Î3-ray emissions from 235 U has been performed. This has used the STEFF spectrometer at the new Experimental Area 2 (EAR2) within the neutron time- of-flight facility (n_TOF), a white neutron source facility at CERN with energies from thermal to approximately 1 GeV. Prior to the experimental campaign, STEFF has been optimised for the environment of EAR2. The experimental hall features a high background Î3-ray rate, due to the nature of the spallation neutron source. Thus an investigation into reduction of the background Î3-ray rate, encountered by the NaI(Tl) detector array of STEFF, has been carried out. This has been via simulations using the simulation package FLUKA. Various materials and shielding geometries have been investigated but the effects determined to be insufficient in reducing the background rate by a meaningful amount. The NaI(Tl) detectors have been modified to improve their performance in a high count rate environment, and their behaviour characterised to understand the response to higher count rates. Initial testing demonstrated that the modified detectors maintain a potential to measure Î3-ray multiplicities up to 3 counts per microsecond. However, the energy resolution fails somewhere below 1.75 counts per microsecond. The experimental campaign has produced a large amount of data. The preliminary analysis of phase one data has considered incoming neutron energies ranging from thermal to an upper limit of 1 eV, with a minimum Î3-ray energy threshold of 160 keV. Results have been achieved for the prompt fission Î3-ray multiplicity and total energy of M Î3 = 6.3 ± 0.2 and E S,Î3 = 9.0 ± 0.1 MeV respectively. Further work is ongoing by the STEFF team at Manchester to improve upon these results and analyse the remainder of the data set at higher incoming neutron energies.
