As the level of goverrument closest to the people, local authorities have been credited with a key role in action towards sustainable development (United Nations, 1992). This thesis describes research which addresses mechanisms for evaluating sustainable development practice by local govemment. A review of approaches to measuring progress, in economic, social and environmental terms, identified sustainable development indicators as an evaluation framework whose applicability to local government warrented further research. A review of research literature highlighted the need for a dynamic and cyclical research approach which would acknowledge the contested and valueladen nature of both sustainable development and the research endeavour. The fieldwork is written up in three stages. The first stage explores the scope for transferring experience from public sector quality and performance indicators work. The second stage is a thin and linear description of the process of Fife Regional Council's role as a pilot authority in a Local Government Board Sustainability Indicators project. The third stage uses the wide range of written and experiential data gathered through the role of Project Consultant/Researcher to the Fife project to present a rich description of 'Sustainability Indicators for Fife'. The dialectic and hermeneutic framework adapted for this study enabled a detailed examination of the iterative movement between the sustainable development framing of the whole report and the process of crafting individual indicators. The study concludes that sustainable development indicators have considerable value as a performance management tool for use in local government, particularly in the context of the Local Agenda 21 and Community Planning initiatives. However, it is the quality and approach to local governance that will have an overiding impact on the achievement of effective action towards sustainable development. Recommendations are made for good practice and for further research.

This thesis examines the implementation of air pollution control at the local level within the UK. Focusing upon the local air pollution control regime (LAPC) that is regulated by local authorities under the provisions of Part One of the Environmental Protection Act 1990, the research assesses whether this system has been effective in controlling localised emissions from industrial processes. To place the research in context, it essentially evaluates the implementation of LAPC with reference to its main objectives: to reduce industrial emissions and improve local air quality, to provide greater clarity and certainty for business and to allow the public greater access to local environmental information. The methodology adopted to undertake the research was based upon grounded theory and naturalistic inquiry. As such, the research programme was structured in phases where initially, essential baseline data was collected on the LAPC system. This quantitative data provided the foundations from which more detailed qualitative work was undertaken in the field in subsequent phases of the research. This allowed the research to build towards theory utilising an emergent, yet structured research design. As the research progressed, a range of complementary methods were used to collect data about the LAPC system. Initially, the research critically evaluated the major Reports that had been written on LAPC in order to establish benchmarks from which implementation of the LAPC system could be assessed. To keep the research within defined limits, a case study approach was adopted, using Lancashire as the case study area. Under the first phase of the research a questionnaire was used to survey the process operators within the region in order to collect baseline information about their processes and to obtain their views and perceptions of the LAPC system. Under the second phase qualitative research was carried out in the field. This involved detailed, semi-structured, faceto-face interviews with the process operators and the DETR and examination of documentary evidence within the Public Registers held by Lancashire's local authorities. The phased approach allowed the research to explore progressively deeper into the key areas associated with the implementation of the LAPC system. In particular, the research examined local authority enforcement and administration of the LAPC system to assess their regulatory performance and to determine the strategies they adopt to achieve compliance. The research also focused upon the process operators to assess their capacity to comply with the duties and responsibilities placed upon them under LAPC. The work offers a new perspective as it focuses upon both regulators and operators alike and examines their performance from the outset of LAPC to its closing stages. The research findings allow conclusions to be drawn on the relationship that exists between these "stakeholders" and the regulatory conditions that exist within the system. The research findings suggest that local authorities and process operators have had difficulty in discharging their duties under the LAPC system. For various reasons, the capacity of the regulators and the operators to achieve compliance has been compromised. The difficulties that the stakeholders have faced in striving to come to terms with the LAPC system have influenced their compliance strategies and affected the relationship that exists between them. This research identifies and examines these difficulties and assesses their performance under such conditions.

Dans ce mémoire, j’ai voulu répondre à la question suivante: Une nouvelle évangélisation haïtienne peut-elle s’inspirer de l’histoire? Et si oui, de quelle histoire? «L’histoire de l’évangélisation en Haïti», doit-on tout d’abord répondre. Mais, ne pourrait-on pas remonter bien avant, avant 1492, date de l’arrivée de l’Évangile en Haïti pour retourner «aux origines du christianisme africain», par exemple? C’est ce que nous découvrirons tout au long de ce mémoire. Saint Augustin surtout, que l’on a appelé le «père» du christianisme africain nous indiquera des pistes nous permettant de relever quelques défis pastoraux de taille qui s’offrent encore à nous en Haïti. Un pas dans l’immense tâche d’inculturation qui nous revient aujourd’hui pourrait ainsi, à mon avis, être fait.

A critical analysis of the resolution of the Malaysian Securities Commission Shariah Advisory Council : a case study of the crude palm oil futures contractKasri, Noor Suhaida Binti January 2012 (has links)
This thesis analyses the resolution made by the Shariah Advisory Council of the Malaysian Securities Commission (SAC) which resolves that the crude palm oil futures contract is permissible. This resolution is controversial as it collides with the resolutions of other mainstream or internationally represented organisations of Shari'ah scholars. These mainstream resolutions rule that the commodity futures contract transgresses Sharf'ah principles. However, the SAC contends that it is permissible on the principle of public interest (ma#a~ah) and on the notion that trading regulations have overcome Sharf'ah prohibitions; namely, that of gharar (uncertainty) and maysir (gambling). The focus of this thesis is thus to analyse the adequacy of the SAC resolution in terms of its coherence with the real trading of the crude palm oil futures contract as well as the adequacy of the crude palm oil futures legal framework in overcoming Sharf' ah prohibitions. This is an area which has not been given adequate attention in the current literature. Apart from the liteniture on the legality of the commodity futures contract, this thesis examines the legal framework of the Malaysian commodity futures market as well as the American and European markets. To compliment this research, non-structured interviews and discussions have been undertaken. In the final analysis, the data gathered from the interviews and discussions, as well as the relevant literature, evidences that the SAC resolution is not coherent with real trading and that the elements of gharar and maysir have not been eliminated by the trading regulations. Additionally, the analysis finds that, contrary to the argument of its proponents, the commodity futures market has failed to represent its purpose as a risk management tool as well as a price discovery tool. In summation, an inadequate resolution would inevitably undermine the SAC's, position as Malaysia's sole Islamic capital market's Sharf'ah advisor, and Malaysia's reputation as the international Islamic capital market hub.
