Le secteur de l’intérim s’est fortement démocratisé ces dernières décennies et génère de nombreuses externalités négatives pour la société civile. En effet, l’intérim est source de vulnérabilité sociale pour les intérimaires, dans une société où les individus s'intègrent socialement à travers leur emploi. L’intérim contribue à la précarisation des conditions de vie et de travail, à la relégation et à l’exclusion sociale. Pour limiter ces dérives sociales et internaliser les problématiques sociétales, les entreprises de travail temporaire (ETT) sont incitées, à travers le reporting extra-financier, à s’engager dans une démarche RSE. Les ETT valorisent leur engagement à travers une communication sociétale volontaire, qui repose notamment sur la production d’un rapport RSE/Développement Durable. La communication sociétale véhicule les engagements pris par les ETT pour protéger les intérêts des intérimaires. Les objectifs de la communication sociétale sont multiples : améliorer l’image et la réputation, favoriser l’autorégulation des activités, permettre un accès continu aux ressources intérimaires, diminuer l’encadrement des activités par les pouvoirs publics, légitimer l’existence des ETT malgré ces externalités négatives, générer une attitude positive des parties prenantes, contribuer à la performance globale et diminuer les coûts cachés relatifs au turn-over du personnel. L’engagement RSE doit être déployé au sein des ETT et susciter l’adhésion collective des parties prenantes internes. Cependant, la littérature académique relative à l’engagement RSE dans le secteur de l’intérim relève un décalage entre la communication sociétale et les pratiques réelles des ETT. Par contraste, ce décalage provoque des effets inverses et génère une attitude négative des parties prenantes envers les ETT. Compte tenu de ces enjeux, le manque d’informations dans la littérature académique ainsi que l’absence d’études empiriques relatives au décalage entre la communication sociétale et les pratiques réelles des ETT nous ont conduits à formuler notre problématique de recherche générale. Nos travaux de recherche ont pour objectif d’apporter des contributions significatives dans ce domaine de recherche émergent. / The temporary employment sector has greatly democratized in recent decades and generates numerous negative externalities for civil society. Indeed, the temporary employment sector is a source of social vulnerability for the temporary workers, in a society where individuals are socially integrated through their jobs. The temporary employment sector contributes in the precarious of life and work conditions, relegation and social exclusion. To limit these social deviations and internalize societal issues, the temporary work companies (TWC) are encouraged, through extra-financial reporting, to engage in CSR. The TWC value their commitment through a voluntary social communication, which is based in particular on the production of a CSR/Sustainable Development report. The societal communication vehicle commitments by TWC to protect the temporary workers’s interests. The objectives of social communication are numerous : improve the image and the reputation, promote self-regulation activities, allowing continuous access to temporary resources, reduce supervision activities by public authorities, legitimize the existence of ETT despite these negative externalities, generate positive attitudes of stakeholders, contribute to the overall performance and reduce hidden costs due to the staff turnover. The CSR commitment must be deployed within the TWC and arouse the collective membership of the internal stakeholders. However, the academic literature on the CSR commitment in the temporary employment sector is a gap between social communication and the actual practices of TWC. In contrast, this gap causes the opposite effect and generates negative attitudes of stakeholders towards TWC. Given these challenges, the lack of information in the academic literature and the lack of empirical studies on the gap between social communication and the actual practices of TWC led us to formulate our overall research problem. Our research aim to make significant contributions in this emerging area of research.

Wilhelm Kempff was one of the greatest pianists of the twentieth century, and his interpretation of Germanic piano literature has been honored in Europe, Africa, Asia, and America by many distinguished musicians and music-lovers. But perhaps because he was already sixty-nine years old at the time of his American debut in New York in 1964, his reputation as a pianist tends to be disregarded in English speaking nations. Even Alfred Brendel acknowledges in his book Me of All People: "I return again and again to Kempff, because he is a pianist who seems frequently underestimated today." Furthermore, Kempff's activities as a transcriber, organist, and composer are even less well known. Thus this paper will introduce Wilhelm Kempff's life and music, and present a study of his solo piano transcriptions of J. S. Bach's chorale preludes for organ. In Kempff's autobiographical novel, Unter Dem Zimbelstern: Das Werden eines Musikers ("Under the Cymbal Star: The Development of a Musician"), a Bildungsroman ("education novel") published in 1951 when he was fifty-six years old, he describes the environment in which he grew up: an environment steeped in music and Protestantism. Within a strong family tradition of church music organists, he heard Bach's organ repertoire, as well as conversations about Lutheran faith. His father and paternal grandfather were both Lutheran church organists, and Kempff too was an excellent organist. J. S. Bach's organ repertoire, especially his chorale for organ, were deeply ingrained in Kempff's childhood. It is generally very difficult to find sacred music repertoire for the piano; however, Kempff's transcriptions of the chorale preludes represent a small--though important--contribution of sacred literature to the piano repertoire. In The Pianist's Guide to Transcriptions, Arrangements, and Paraphrases, Maurice Hinson characterizes Kempff's transcriptions as follows: "Kempff makes clear distinctions between the various parts and uses ingenious fingering to create beautiful legato (without relying totally on the pedal). He also seems to enjoy the interplay of tone colors, finding the right register, and establishing the particular timbre of each part in polyphonic writing." This paper will examine: 1) basic transcription techniques; 2) coloration/timbre; 3) fingering to create beautiful legato; 4) pedaling; and 5) pedagogical suggestions. Kempff transcribed eight of Bach Chorales for solo piano, two of which will be discussed in this paper: 1) Ich ruf zu dir, Herr Jesu Christ ("I call to you, Lord Jesus Christ" BWV639,); 2) Nun Komm der Heiden Heiland ("The Saviour of the Heathen now comes," BWV659a). This paper also will present a brief history of piano transcriptions, followed by a detailed analysis of the two chorales, examining Kempff's methods through comparison with the original works for organ, and demonstrating how Kempff's musicianship as a pianist and organist is reflected in his Bach transcriptions.

Utvecklingen i praxis på kombinationsfullmaktens område visar att ställningsfullmakten i 10 § 2 st. AvtL inte fullt ut kunnat tillvarata tredje mans intresse på ett önskvärt sätt. Bestämmelsen har framförallt visat sig vara otillräcklig i de fall rättshandlingar företagits på högre hierarkisk nivå genom att det sällan hinner utvecklas någon sedvänja för sådant rättshandlande. Andra omständigheter i kombination med varandra har då ansetts kunna ersätta sedvanerekvisitet i 10 § 2 st. AvtL. Avgörande har varit om tredje man genom dessa omständigheter fått ett befogat intryck av mellanmannens behörighet. Rättsfiguren som kommit att kallas kombinationsfullmakt har präglat praxis enda fram till idag. I och med NJA 2013 s. 659 och NJA 2014 s. 684 har rättsfiguren dock fått en klarare struktur med en tydlig metod för hur prövningen av tredje mans befogade tillit ska ske. Metoden uppställer ett tydligt härrörandekrav och tillitskrav. Därtill uppställer HD i 2014 års fall ett krav på insikt hos huvudmannen, som innebär att han inte blir bunden om han inte måst inse att de omständigheter som härrör från honom kan ge tredje man det befogade intrycket av behörighet. Samtidigt har begreppet kombinationsfullmakt ersatts av tillitsfullmakten. Övergången till tillitsfullmakten torde inte innebära att den rättsfigur kombinationsfullmakten bygger på ändras nämnvärt. Dock synes det nya begreppet innefatta även överväganden som normalt sett faller inom toleransfullmakten.
