Constitutional frameworks and democratization in Africa since independenceNeirynck, Karim January 2000 (has links)
The subject of this thesis is international studies, specifically a study of constitutional frameworks in Africa in the second half of the 20th century, focussing on a statistical correlation between constitutional frameworks, party systems, electoral systems and the Index of Democracy. The struggle to consolidate new democracies - especially those in Eastern Europe, Latin America and Asia - has given rise to a wide-ranging debate about the hard choices concerning democratic political institutions and political markets. According to Stepan and Skach " this literature has produced provocative hypotheses about the effects of institutions on democracy" (Stepan and Skach, 1993 : 1). It forms part of the' new institutionalism I literature in comparative politics that'holds as a premise that political democracy depends not only on economic and social conditions but also on the design of political institutions (Koelble, 1995 : 231-243). " One fundamental political-institutional question that has only received serious scholarly attention concerns the impact of different constitutional frameworks on democratic consolidation. Although the topic has been increasingly debated and discussed, little systematic cross-regional evidence [especially for our field of research: Africa] has been brought to bear on it " (Stepan and Skach, 1993 : 1-2). So far, only the book"on regime transitions in Africa written by Bratton and Van De Walle seeks to fill this empirical gap (Bratton and Van De Walle, 1997, preface xiii). In this thesis, we paid particular attention to the dichotomy between (pure) parliamentarism and (pure) presidentialism. Each type has fundamental characteristics, and for the purposes of classification these characteristics are necessary and sufficient. It was not our purpose to weigh the benefits and drawbacks of parliamentarism and presidentialism. Our intention was to report and analyse different sources of data, and we based our case exclusively on statistic correlatiohs between regime type and the record of democratic success and failure. We collected a data set about constitutional frameworks (matrix1), democracy indices (matrix2), party systems (matrix3) and election systems (matrix4). The basis for matrix 1 was the constitutions of the African countries (over time) and relevant literature. The basis for matrix 2 was the annual Freedom House ratings made by Raymond D. Gastil and others. The basis for matrix 3 and 4 was relevant literature. Once these matrices had been composed, we compared them and calculated statistic correlations. This long-dyration model allowed us to estimate whether African constitutional frameworks, party systems and electoral systems exhibit positive or negative correlation with the index of democracy.

This thesis looks at the problem of governance and statehood in Africa from an
international law perspective. Adopting a comparative analytical research method, the
thesis investigated the idea of statehood in traditional Africa and Europe, and highlighted
conceptual differences. It traced the origin and nature of the post colonial African state to
an oppressive and totalitarian colonial state; and the coalescence of international law with
European civilization and reality. The argument is made that the international law
framework on statehood and international solutions of intervention and democratization,
are inadequate for dealing with the problems of statehood in Africa and its consequences
such as state collapse. The thesis proposes the legitimization of the African post colonial
state through a combination of a process of self determination and democratization. The
pattern of self determination proposed seeks to give normative expression to an African
state's reality by using the equilibrium of the peoples incorporation and disengagement
from the state as an index for determining the role and relevance of the state. It is
proposed that this index, in determining the ambits of the right to self determination of the
constituent political units in a state, should entitle an African nation to a minimum of the
right to self governance in a confederate system. In complimenting the foregoing
legitimization process, the thesis proposes a democratic framework that is constructed on
cultural foundations of endogenous democracy and development.

Conflict Management of the Organization of African Unity in Intra- African Conflicts, 1963-1980Olvo, Samuel L. O. 08 1900 (has links)
The purpose of this dissertation is to examine and evaluate the role of the Organization of African Unity as an international organization in the solution of intra-African conflicts. For the purpose of this paper, eight conflicts from 1963 to 1980 were investigated. Utilizing these cases, the paper (a) examines four assumptions: (1) that regional actions promote settlements by isolating soluble local conflicts from more complex ones; (2) that intrastate conflicts are more difficult to resolve by regional organizations than interstate or border disputes; (3) that most of the boundary disputes in Africa are due to the arbitrary colonial boundary demarcations; and (4) that most of the causes of the ineffectiveness in its conflict resolution is as a result of poor administrative set-up, lack of resources, and failure of its commissions to operate effectively; (b) it answered the following questions: (1) Did the O.A.U. stop, help stop, or fail to stop the fighting; (2) Did the O.A.U. settle, help settle, or fail to settle the conflict; and (3) Was there super power intervention, and if so, to what effect? The methodology used is primarily case study method. Most attention is given to the way the O.A.U. handled the conflicts.

International Studies))--University of Stellenbosch, 2006. / The African Renaissance, which has its origins in the 1960s during the de-colonization period of Africa, is about transformation, an African continent reinvention that pleads for renewed autonomy and Africa’s own effort to take its intellectual destiny. Africa is beset with a massive amount of problems, and the African Renaissance in general is trying to address these issues and find a solution to all these problems. It has been seen as a call for the people of Africa to work towards the resurgence of Africa, economically, sociologically, politically and spiritually. President Mbeki of South Africa sets the tone for the African Renaissance project and its implementation, but the vision is for the rest of Africa that must equally own the concept and actively fuel its realization.
The African Renaissance has limitations in that not all African countries have embraced it, or are passionate as other countries are. Still, most people in the continent do not understand the concept the African Renaissance as it has found them in conditions that are still disadvantageous to them and are grappling with other issues of life. Most importantly, it is not inclusive of women despite the fact that they constitute a clear numerical majority on the African continent. There is no significant cultural renaissance that can take place while sectors of the population under transformation are victims of silencing. Looking at the position of women in Africa and their development, it is important to understand what the implication of gender is in this discourse. Also, why has the African Renaissance not included women and lastly, that can it hold as a discourse of renewal without the voice of women? The African Renaissance has come to epitomize the democratization of the African continent, therefore, the voice of women and the role that gender must play, should be of great importance.

Grassroots diplomacy between Lesotho and South Africa: the district liaison committeesMoeletsi, Motheba Gwendoline January 2000 (has links)
Cross-border conflicts on the African continent have increased tremendously in the post-colonial years. The widespread border conflicts on the African continent have been attributed to the arbitrariness with which Africa’s national boundaries were drawn during the colonial period. The colonial boundaries have left the doors open for perpetual conflicts among African states. This thesis proposes to investigate the prospects of grassroots diplomacy as an option of dealing with border conflicts with specific reference to the case of Lesotho/South Africa border relations. This is done by critically evaluating the role the District Liaison Committees (DLCs) have played in border relations between Lesotho and South Africa. The Lesotho and South African governments have institutionalised the resolution of border conflicts at grassroots level through the establishment of the DLCs. The DLCs consists of representatives of border communities in Lesotho and South Africa. The paper introduces a not so familiar concept of involving people at grassroots levels in the conducting of diplomacy between the two neighbouring countries. The central issue implicit in this paper is that grassroots diplomacy is succeeding in the case of Lesotho and South Africa. The DLCs have managed to reduce tension between the two countries along the borders which had existed over a long period of time, thereby, relieving the central governments of some of their duties. The thesis contents that high level conventional diplomacy is not always the answer to cross-border conflicts. The example of Lesotho and South Africa could be followed by other African countries in similar situations.

The African Peer Review Mechanism : towards Africa's governance auditMolete, Nathan Teboho January 2008 (has links)
The concept of accountability has grown to become an integral part of a broader political and socio-economic transformation. Closely associated to it is the concept of "auditing" which has established itself as a main driving force of accountability and a core means of delivering it. The extent of the rise and expansion of "auditing" has subsequently come to influence every aspect of modern life and this has led to a situation in which practices have had to adapt to the principles of "auditing" processes. Auditing has become prevalent in both the public and private spheres and this impact has far reaching consequences. The concept of "auditing" is evident in the African Peer Review Mechanism (APRM) and is central to its review process. This thesis focuses on the concept of "auditing" in order to illustrate how the APRM has borrowed and applied insights from other disciplinary practices so as to enhance an understanding of accountability and transparency as features of "good governance" and to explicate how these concepts are conceived within the framework of the New Partnership for Africa's Development (NEPAD). It also clarifies the relationship that exists between "peer review" and "auditing" and argues that rather than being considered as two poles marked by distance from each other "auditing" and "peer review" are closely related and mutually constitutive.

The New Partnership for Africa's Development- NEPAD is the continued search
by African people and its leaders to develop Pan African structures that will
initiate social and economic transformation in a rapidly globalizing world which
continues to marginalize Africa. According to the human indicators of the United
Nations Development Programme, Africa remains the poorest continent under
the sun. Half of Africa's 875 million people survive on US $ 1 daily and they
have little access to socio - economic infrastructure.
South Africa, guided by her foreign policy, which advocates respect for human
rights, democracy and economic development, is at the forefront in efforts to
promote NEPAD. South Africa's promotion of NEPAD is encouraged by her will
to promote the philosophy of African Renaissance, to maintain her prestige in
Africa and to assert South Africa's leadership in Africa.
Many internal and external problems have been encountered by South Africa
whilst promoting NEPAD. Internal problems have been; unemployment, poverty,
tuberculosis, HIV I AIDS, corruption and an excruciating debt. The forces of
globalization such as economic marginalisation and the non-representation of
South Africa within the multilateral institutions such as the World Trade
Organization have presented external problems.
NEPAD should develop social policies that complement liberal policies in order
to address internal problems such as unemployment and poverty. African
.governments should not withdraw from being involved in their nation's
economies and solely rely on liberal policies for economic capital flows. Lastly, NEPAD should fight for the restructuring of the multilateral institutions such as

This thesis explores the political, economic and theoretical underpinnings of the German Democratic Republic’s (GDR’s) development policies towards the Third World between c.1960 and 1990. Particular attention is paid to Africa. Case studies of assistance to SWAPO and the ANC further focus the attention of the reader on southern Africa in particular. Aspects of both military and civilian aid are considered, including both development initiatives overseas in Africa, and development training for Africans within the GDR itself. Since German “reunification”, the GDR’s history has been explored largely from a West German perspective. The present work attempts to provide a more balanced view of successes and shortcomings of the GDR’s policies towards, and interaction with, African countries and liberation movements. It also aims to bring to the attention of English-speaking readers German archival sources, other primary sources and published works which they would otherwise have been unlikely to encounter. From its formation, the GDR made strenuous efforts to develop relations with countries which were either free from colonial dependency or were struggling for freedom. Over the course of thirty years, it followed a number of different approaches, and developed diverse objectives. These were shaped in the wider context of the cold war, the Hallstein doctrine (which established that the FRG – and, in effect, its allies - would not establish or maintain diplomatic relations with any state that recognised the GDR), the relationships between the GDR and partner socialist states, and the economic difficulties faced by the GDR. Arising from this complex situation, from time to time, both internally in the GDR and in terms of its foreign affairs, tensions and discrepancies arose between theoretical objectives and political and economic reality. Despite these severe constraints, during the period under review, the volume and range of the GDR’s relationships with developing countries increased dramatically. For example, between 1970 and 1987, the number of developing countries with which the GDR had foreign economic relations on the basis of international agreements grew from 23 to 64. Viewed within its economic context, the state was arguably far more committed to development aid than the Federal Republic of Germany. In addition, there is a great deal of evidence that “solidarity” with developing nations and the oppressed enjoyed a considerable degree of popular support.
