El presente trabajo de investigación tuvo como objetivo complementar la Ley 29080 para determinar la responsabilidad civil del agente inmobiliario frente al tercero que contrata en virtud de la información que este le proporciona, cuyo objetivo es brindar una mayor seguridad jurídica en las transacciones de bienes inmuebles, puesto que en la actualidad el fraude inmobiliario es la principal amenaza para el mercado inmobiliario y por lo tanto, también para los agentes inmobiliarios. Por tales motivos, ha sido de gran necesidad analizar fuentes del Derecho Comparado donde si se regule la responsabilidad civil del agente inmobiliario para estos casos, es así que como principales fuentes tenemos la normativa Española y Ecuatoriana. De tal modo, que al aplicar un metodo de carácter social y jurídico nos permitirá desarrollar cuáles son las medidas que el Perú debe adoptar para establecer los criterios de responsabilidad civil del agente inmobiliario y que el derecho de propiedad se vea vulnerado. / The objective of this research work was to complement Law 29080 to determine the civil liability of the real estate agent against the third party that it contracts by virtue of the information it provides, whose objective is to provide greater legal security in real estate transactions. since currently real estate fraud is the main threat to the real estate market and therefore also to real estate agents. For these reasons, it has been of great necessity to analyze sources of Comparative Law where if the civil liability of the real estate agent is regulated for these cases, it is so that as main sources we have the Spanish and Ecuadorian regulations. In such a way, that by applying a method of a social and legal nature, it will allow us to develop what are the measures that Peru must adopt to establish the criteria of civil liability of the real estate agent and that the property right is violated.
