Combating Corruption: A Comparison of National Anti-Corruption Efforts

The primary goal of this thesis is to provide a comparative analysis of the institutional and organizational mechanisms designed to monitor and control political corruption at the national level. The paper will provide comparisons of these arraignments and control systems across three nations. The thesis will identify differences across countries in terms of organizational and institutional political corruption control mechanisms, and use the CPI index to suggest and identify those control mechanisms that appear to be present in nations with low CPI measurements. Finally, the thesis will conclude with the discussion concerning the future prospects for controlling political corruption in Turkey based on the comparative analysis described above.

Le contrôle politique de l'agence anticorruption malaisienne

L'enjeu des politiques anticorruption occupe une grande partie du discours politique en Malaisie. Après des événements tels que la crise financière de 1997, ou encore l'affaire Anwar en 1998, les politiques anticorruption ont été catapultées au sein du débat politique, dans lequel elles sont constamment observées, scrutées et critiquées. Ce mémoire étudie ces politiques à travers l'analyse du contrôle politique, notamment en ce qui concerne leur autonomie et leur indépendance bureaucratique. En se concentrant plus précisément sur le cas de l'agence anticorruption, notre mémoire offre un regard sur la nouvelle agence indépendante qui a récemment vu le jour en 2009, ainsi que celle qui la précède. Cette étude démontre que la nature du contrôle politique exercé a entravé et ralentit la mise en œuvre des politiques anticorruption. / The issue of anticorruption policies has permeated a significant part of the political discourse in Malaysia. After events such as the 1997 financial crisis, or the Anwar affair in 1998, anticorruption policies have been catapulted in the midst of political debate, in which their efficiency is constantly observed, scrutinized and criticized. This thesis examines anticorruption policies through the analytical lense of political control, specifically in regards to its bureaucratic independance and autonomy. Our study concentrates itself more specifically on the case of the independent anticorruption agency freshly instituted in 2009, as well as its predecessor. The conclusions drawn support the argument that the nature of the political control exercised on anticorruption policies have hampered and slowed down their implementation.

Institucionální zakotvení protikorupční politiky: mezinárodní srovnání protikorupčních agentur a situace v České republice / The Institutional Framework of Anti-Corruption Policy: International Comparison of Anti-Corruption Agencies and Situation in the Czech Republic

The subject of the thesis is the institutional framework of anti-corruption policy, in particular its anchorage in the form of specialized anti-corruption bodies, referred to as anti-corruption agencies. The aim is to address three main research questions: What specialized anti-corruption bodies exist in the world? How do specialized anti-corruption bodies operate in individual countries? What anti-corruption bodies do exist currently in the Czech Republic and what recommendations can be drawn from the foreign institutional arrangements? To answer them, the current state of research, recommendations and standards for the design and operation of specialized anti-corruption bodies is analysed first. The comparison of anti-corruption agencies in Lithuania, Latvia and Slovenia follows. On this basis, the current situation in the Czech Republic is assessed and recommendations are made. Partial aim of the thesis is to present international discussions and documents, the current state of reseach on this topic in the Czech language, as a comprehensive professional processing of this field is still missing.

A critical analysis of crime investigative system within the South African criminal justice system: a comparative study

With the establishment of the Directorate of Special Operations (Scorpions), the Asset Forfeiture Unit (AFU), the Special Investigating Unit (SIU) and the Departmental Investigating Unit (DIU), questions were asked as to whether this is a creation of new units of the Police Service. These questions were exaggerated by the fact that the media uses the term "Scorpions" whenever the Scorpions, the AFU, SIU and the DIU perform their functions. South African legislation that governs organised crime does not demarcate activities to be dealt with by the SAPS, AFU, DIU, Scorpions and the SIU. The Constitution of South Africa lays down the objects of the police, but it is silent about the objectives of the Scorpions, AFU, SIU, DIU and other investigative institutions except that it only mentions the creation of a single National Prosecuting Authority (NPA). A literature study was used as the basis for this study. In addition, unstructured interviews and observation were used to gather evidence from the relevant stakeholders. An analysis of the SAPS Detective Service, the Special Investigating Unit (SIU), the Scorpions, the Departmental Investigating Unit (DIU) of the Department of Correctional Services and the Asset Forfeiture Unit (AFU), was done in order to establish the overlapping of functions. Indeed, overlapping was discovered between the Scorpions and the SAPS Detective Service, the AFU and the SIU, as well as between the SAPS and the DIU. In order to make a proper finding, an analysis was done of anti-corruption agencies in Botswana, Nigeria, Malawi and Hong Kong. The findings indicate that the better way of fighting corruption, fraud, economic and financial crimes, is through the establishment of a single agency that will work independently from the police, with a proper jurisdiction. / Criminology / D.Litt. et Phil.(Police Science)

ベトナムでは汚職・腐敗問題は依然深刻な問題として位置づけられいるものの近年、新たな展開が見られるようになった。政府政策の変化は市民の汚職行為に対する容認度の低下につなぎ、マスメディアの活躍も一段と目立ってきている。本論文社はベトナム政府の汚職取締と法的・制度的枠組みの歴史と制度改変について考察した後、今日のマスメディアと市民社会組織の活動を検証し、汚職問題を取り巻くベトナム社会の今日的意義を問う。 / Although corruption is continuously regarded as a pressing matter in Vietnam, there have been new developments in this aspect. Specific changes in government policies empowered anti-corruption agencies and nurtured the participation of mass media and civil society organizations, which ushered in a decline in public tolerance for corruption.
