Monetary policy and uncertainty in South AfricaDe Hart, Petrus Jacobus 01 1900 (has links)
Even though major advances in economic theory and modelling have in some
cases furthered our understanding of how the economy works, the system as a
whole has become more complex. If policymakers had perfect knowledge about
the actual state of the economy, the various transmission mechanisms as well as
the true underlying model, monetary intervention would be greatly simplified. In
reality, however, the monetary authorities have to contend with considerable
uncertainty in relation to the above-mentioned factors.
This said, uncertainty has mostly been neglected in both the theoretical and
empirical literature focusing on monetary policy analysis. Nonetheless, findings
from a review of theoretical literature that does exist on this topic suggest that
optimal central banks act more conservatively when faced with uncertainty.
Similarly, empirical findings from the literature also favour conservatism. However,
there is some evidence to suggest that this is not always the case. These results
suggest that central banks do not always act optimally when faced with uncertainty. The limited number of industrial country cases examined prevents any
generalised view from emerging. If anything, the literature findings suggest that
central bank behaviour differs across countries.
This thesis aims to contribute to the empirical literature by studying the effects of
uncertainty on monetary policy in the developing country case of South Africa. In
simplest terms, the thesis seeks to establish whether or not the South African
Reserve Bank (SARB) responded optimally to uncertainty as suggested by
theoretical models thereof. To this end, the thesis employs a theoretical model
which resembles a structural rule-based approach. The optimal interest rate rule
was derived given a set of structural equations relating to demand, the Phillips
curve and the real exchange rate.
To incorporate uncertainty, it is assumed that the coefficients are dependent on
the variances of the exogenous variables, namely inflation, the output gap and the
exchange rate. The uncertainty adjusted model allows us to investigate whether
monetary policy is more aggressive or passive when uncertainty about the relevant
exogenous variable increases. Inflation, output gap and exchange rate uncertainty
estimates were derived through GARCH-model specifications related to the
structural equations as defined in the theoretical model.
The investigation considered both indirect and direct uncertainty effects with a
sample period stretching from 1990 to 2011. The findings reported in this thesis provide strong evidence in support of the
notion that uncertainty plays a significant role within the South African monetary
policy landscape and contributes towards explaining the SARB’s actions.
Furthermore, the results suggest that the SARB did in fact act optimally in
responding more conservatively to target variable fluctuations on average. Also,
the findings could potentially strengthen the case for inflation targeting as a
monetary policy regime, as the results indicate a marked decline in the effects of

Suretyships given in favour of banks are being challenged in the courts on the basis of equitable doctrines of unconscionable conduct, undue influence, or statutory provisions dealing with unfair conduct or unfair contract terms.
This thesis is an enquiry into a bank's duties of disclosure or advice to an intending surety. Such an investigation also necessitates a study of the relationship between banker and customer, as the surety is quite often a customer of the bank as well, and, as a surety's obligation to the bank is an accessory obligation, the obligation is dependent on a valid principal obligation between the bank and the principal debtor - the customer.
The face of modern banking has, however, changed dramatically and most major banks have become multi-functional. As a result, the banker-customer relationship may often be seen as a fiduciary relationship. A major problem brought about my multi-functioning banks is that of conflicts of interest between the bank and its customer. Furthermore, the banker-customer relationship is providing much more scope for lender liability than in the past.
Various factors are currently having an impact on the law of contract, and this is expected to affect the legal policy makers in their assessments of whether a duty of disclosure of material facts exits or not.
A surety has long been a favoured debtor in the eyes of the law, and the courts have developed a plethora of technical principles on which a surety can be relieved of his obligation. The escape routes of the surety, especially if he is a consumer as well, on the new grounds of public policy, unconscionability, good faith or unreasonableness, are growing. The results of these trends is the expected demise of suretyship as an acceptable, cheap form of debt security in the banking sector. / Jurisprudence / LL.D.

Financial regulation in South Africa : a case study on the implementation of the national credit act by the four big banksDavids, Marlon 12 1900 (has links)
Thesis (MBA (Business Management))--Stellenbosch University, 2008. / ENGLISH ABSTRACT: The banking industry is one of the most regulated industries in the world. The
majority of these regulations are drafted to provide protection to consumers
and investors and to ensure the systemic stability of the economy.
South African banks, like many of their international counterparts, face a
plethora of financial regulation aimed at ensuring stability and protection. In
addition to these regulations, South Africa's prior exclusionary policies have
resulted in the post-democratic government prescribing additional regulation,
in part to address the economic duality that exists within the South African
economy and in part to offer adequate protection to the most vulnerable in the
society. The National Credit Act (NCA) is one such piece of legislation that
has introduced a new era of consumer credit regulation and practice, bringing
about wholesale changes to the consumer credit industry.
The NCA and more than 260 other financial regulations in South Africa have a
significant impact on banks, with each piece of legislation resulting in banks
having to adapt to the changing environment (Nyamakanga, 2007).
Using the four big banks' implementation of the NCA as a case study, the
present study aims to establish if an integrative change management strategy
could assist banks in effectively implementing financial regulation. The
following aspects of the banks' implementation of the NCA were researched:
• Effectiveness of financial regulation.
• Current barriers and challenges to the implementation process.
• Effect of these challenges on banks.
• Impact on staff and customers.
• Methods used to overcome the challenges.
• Future challenges of the NCA.
• Support structures used during implementation.
• Use of change management principles.
• Recommended strategies for future regulatory changes.
• Recommended changes to the NCA.
Detailed interviews were conducted with the overall NCA project leaders of
each of the four big banks, namely, Absa, FNB, Nedbank and Standard Bank.
The method of content analyses was used to analyse the qualitative data
collected through in-depth interviews and the outcomes thereof formed the
basis of the conclusions drawn.
The study found that there were numerous challenges that the banks faced
during the implementation of the NCA, the most common and significant as
recognised by the population include, the magnitude of the Act, difficulty in
interpreting the Act, the process of debt counselling and the associated costs
of implementation.
The study further found that using the principles of change management
enhanced the banks' ability to implement the NCA.
Conclusions drawn on the present study are confined to desktop research and
semi-structured interviews conducted with the participating banks. It might be
useful for future studies on the subject to include a broader population base
which focuses on additional pieces of financial legislation in order to further
enhance the findings of the present study. / AFRIKAANSE OPSOMMING: Bankwese is tans een van die mees gereguleerde industriee ter wereld. Die
meerderheid van hierdie regulasies is ontwerp vir die beskerming van
verbruikers en beleggers asook om die sistemiese stabiliteit van die ekonomie

Suid-Afrikaanse banke, soos talle van hul oorsese teenstukke, verduur talle
finansiele wetgewing gemik op beskerming en stabiliteit. Die gewese
uitsluitende Suid-Afrikaanse wette het veroorsaak dat die huidige
demokratiese regering addisionele wetgewing voorskryf, gedeeltelik om die
tweesydige Suid-Afrikaanse ekonomie aan te spreek en gedeeltelik om
genoegsame beskerming aan die kwesbaarste van die gemeenskap te bied.
Die Nasionale Krediet Wet (NKW) bied 'n nuwe era van verbruikerswetgewing
en -praktyk aan wat terselfdertyd grootskaalse veranderinge op die verbruikers
krediet bedryf teweegbring.
Die NKW tesame met meer as 260 ander Suid-Afrikaanse finansiele
wetgewing het 'n groot uitwerking op banke, met elke wet wat veroorsaak dat
banke moet aanpas by die veranderlike omgewing (Nyamakanga, 2007).
Deur om die vier groot banke se uitvoer van die NKW as 'n gevallestudie te
gebruik, is die doel van hierdie studie om vas te stel of 'n geintegreerde
veranderingsbestuurstrategie banke kan help met die doeltreffende uitvoering
van finansiele wetgewing.
Die volgende aspekte van die banke se uitvoering van die NKW is ondersoek:
• Doeltreffendheid van finansiele regulasie.

Die studie dui aan dat banke baie uitdagings getrotseer het gedurende die
uitvoer van NKW, die gewigtigste en algemeenste SODS herken deur die
bevolking sluit in, die grootte van die Wet, moeilikheid in vertolking van die
Wet, die skuldberadingsproses en die begeleidende koste van wetstoepassing.
Die studie dui verder dat die beginsels van veranderingsbestuur banke se
vermoe om die NKW uit te voer verbeter.
Gevolgtrekkings aangaande die huidige studie is beperk tot "desktop"
navorsing en half-gestruktureerde onderhoude met die deelnemende banke.
Dit mag van waarde wees vir toekomstige studies om 'n bree bevolkingsbasis
in te sluit met addisionele finansiele wetgewing wat die bevindings van die
huidige studie kan bevorder.

M.Comm. / Due to uncertainties experienced while working for the South African Revenue Services and the fact that there are no specific sections in the Income Tax Act no. 58 of 1962 dealing with interest, foreign exchange and bad and doubtful debts of commercial banks there were a need to undertake a study. The study therefore undertakes an examination to determine if the existing sections of the Income Tax Act dealing with interest, foreign exchange and bad and doubtful debts are enough legislation to deal with the interest, foreign exchange and bad and doubtful debts of commercial banks. The study also try to clear all existing uncertainties experienced and mentioned in this study. The study can be divided into the following four parts: A literature study of the definition of "bank" and "banking operations", in terms of history and current legislation. A study of the definition of "interest" and "finance charges", in terms of sections of the Income Tax Act, Act no. 58 of 1962 and applicable court cases. The chapter also concentrates on the application of section 24J of the Income Tax Act on the interest-transactions of commercial banks as well as the identification of any short falls of the section. Before interest can be treated in terms of section 24J of the Income Tax Act, the source of the interest will have to be in South Africa. General sourse principles applicable to commercial banks as well as the deductability of interest expenses when expenced to generate exempt income will therefore also be covered in this chapter. A study of the application of section 241 of the Income Tax Act dealing with the foreign exchange of commercial banks. An examination of the way commercial banks should treat their bad and doubtful debts and the factors taken into account in court decisions relating thereto. The most important activities of a bank are identified in this study as the acceptance of deposits, the provision of credit, rendering of financial services and the trade in exchange and the utilisation of money and interest received. In terms of section 24J of the Income Tax Act, interest include finance charges, premiums or disconto's, all interests and the difference between all amounts payable or receivable in terms of a sale and leaseback agreement. It was found that all the interest of a commercial bank are included in the definition of interest and all the transactions of a commercial bank are treated in terms of section 24J of the Income Tax Act for income tax purposes. Section 241 of the Income Tax Act focuses on foreign exchange transactions and are found to be enough legislation for the foreign exchange transactions of commercial banks. Although bad and doubtful debts are not part of the activities of a commercial bank they are part of the uncertainties experienced while working for the South African Revenue Services. During the study it was found that doubtful debts can not be deducted in terms of section 11(a) of the Income Tax Act but only in terms of section 11(j) of the Income Tax Act. It is practice for the South African Revenue Services to only allows 25% of the full amount of doubtful debts, but as this discretion is subject to objection and appeal, the bank is entitled to claim a higher percentage as a deduction if they can provide proveto justify a higher deduction. It was also found that commercial banks can claim their bad debts in term of section 11(a) of the Income Tax Act.

An investigation into the retention strategies of two large banks towards affirmative action employees in Kwazulu-Natal.Ferreira, George Michael. January 2000 (has links)
Affirmative Action has been around in South Africa for about two
decades. Recently, the government decided to impose Affirmative
Action through the Employment Equity Act. Organisations are
anxious to transform their demographical composition across job
categories, particularly into management. One of the problems
organisations faced in the past and may continue to face in the
future is the perceived short tenure ('Job hopping") of black
employees. The impression has been created that black employees
are taking advantage of the favourable employment market and
constantly keep moving on to jobs that offer better packages.
The aim of this study is to investigate how organisations are trying
to manage this problem . Five Human Resources systems/criteria i.e.
selection, training and development, career management, pay and
socialisation were identified in the theory as instruments with which
employees could be retained.
in-depth case studies were conducted at two large banks (A and B)
in Kwazulu Natal to establish and compare the relationships that
these human resources criteria might have with the retention of
black employees. To obtain this information, a structured interview
schedule with open-ended as well as closed-ended questions was
used. Face to face interviews with a senior Human Resources
Practitioner from each bank as well as two current and two exemployees
from each bank were conducted. The resulting data was
captured onto a computer and analysed statistically.
The results of the research showed that the bank that scored the best
(bank A) on the implementation of these five retention-related
criteria also had the highest turnover of black employees. This was
contrary to what was anticipated. The research also found that
there was little uniformity in practice between the two banks regarding which criteria they were emphasising within their
respective organisations. Furthermore, current and ex-employees
bad different perceptions to management regarding how well these
criteria were being implemented.
The findings suggest that when employees are developing they are
content and tend to stay longer. They further indicate that in order
to reduce black employee turnover, management should recruit
individuals with potential and develop them, rather than purchasing
skills from the outside. The findings also show that whilst
management might have good Human Resources systems at it's
disposal, the implementation thereof needs to be of a high standard

Globalisation and financial liberalisation has increased the linkages across countries in recent times. The existence of money market links has important implications for both domestic monetary policy and for investment decisions. This study examines the linkages between South Africa’s money market and selected major international money markets. The objectives of the study are firstly to examine the links between the repo rate of South Africa and the central bank rates of the EU, Japan, UK and US. Secondly, is to compare the influence of domestic and foreign monetary policy decisions on South Africa’s money market. The third objective is to examine the long run relationship between the South African money market and the money markets of its major trading partners. Three estimation techniques are used to examine the different links. Principal components analysis, four tests of cointegration, and stationarity tests of the spreads/risk premium between South Africa’s interest rates and the interest rates of the other countries. All three techniques show that there is no long-run link between South Africa’s central bank rates and the central bank rates of the other countries. This shows that the repo rate does not depend on movements in other central bank rates. Domestic money market interest rates respond strongly to changes in the repo rate whilst showing no dependence on central bank rates of the other countries. This confirms the autonomy of the South African Reserve Bank in carrying out policy objectives. When the risk premium is accounted for under the third technique, evidence of integration is found. This indicates that the risk premium plays a crucial part in the level of integration between South Africa and the countries included in the study.

Asset prices and inflation-targeting : implications for South AfricaCosser, Leigh Emma January 2005 (has links)
An analysis of the current monetary policy framework in South Africa, which followed the exampie of a number of developed countries by implementing an inflation-targeting regime in 2000, is presented. The primary goal of the framework is to establish price stability, with financial stability a secondary objective. However, as has been evident in other countries, price stability does not guarantee financial stability. Movements in asset prices and the development of asset price bubbles have resulted in a number of episodes of financial instability, which negatively impacted on the growth and development of the countries involved. In addition, the majority of these episodes have occurred in periods of low and stable inflation. The dissertation analyses whether monetary policy would be more efficient if asset price movements were incorporated within the inflation-targeting regime. International experience indicates that early intervention of monetary policy can dampen the negative effects that result when an asset price bubble "bursts". However, if the monetary authorities act too early the effects on the economy can be just as disruptive. The literature is scrutinized to establish what the most effective form of monetary policy should be. The results are then transposed within the South African context to establish how the South African Reserve Bank can best ensure both price and financial stability.

The relationship between interest rates and inflation in South Africa : revisiting Fisher's hypothesisMitchell-Innes, Henry Alexander January 2006 (has links)
This thesis investigates the relationship between expected inflation and nominal interest rates in South Africa and the extent to which the Fisher effect hypothesis holds. The hypothesis, proposed by Fisher (1930), that the nominal rate of interest should reflect movements in the expected rate of inflation has been the subject of much empirical research in many industrialised countries. This wealth of literature can be attributed to various factors including the pivotal role that the nominal rate of interest and, perhaps more importantly, the real rate of interest plays in the economy. The validity of the Fisher effect also has important implications for monetary policy and needs to be considered by central banks. Few studies have been conducted in South Africa to validate this important hypothesis. The analysis uses the 3-month bankers’ acceptance rate and the 10-year government bond rate to proxy both short- and long-term interest rates. The existence of a long-run unit proportional relationship between nominal interest rates and expected inflation is tested using Johansen’s cointegration test. The data is analysed for the period April 2000 to July 2005 as the research aims to establish whether the Fisher relationship holds within an inflation targeting monetary policy framework. The short-run Fisher effect is not empirically verified. This is due to the effects of the monetary policy transmission mechanism and implies that short-term nominal interest rates are a good indication of the stance of monetary policy. A long-run cointegrating relationship is established between long-term interest rates and expected inflation. The long-run adjustment is less than unity, which can be attributed to the credibility of the inflation-targeting framework.

Development of an M-Payment system prototype for a marginalized region (Dwesa case study)Mpofu, Handsome C January 2011 (has links)
Wireless technologies, such as Worldwide Interoperability for Microwave Access (WiMAX) and Wireless Fidelity (WiFi), are making it easier to provide the much needed telecommunications infrastructure in marginalized areas worldwide. These technologies enable the rapid deployment of network services as well as their redistribution throughout these marginalized areas. The ability to bring Internet connectivity to previously underserviced and marginalized areas has the potential to leap-frog socio-economic development and improve participation in the global knowledge economy. This study investigated how wireless access technologies, such as WiMAX and WiFi, can be integrated and used to deliver ubiquitous distributed Internet connectivity with increased capillarity in rural areas. The research was undertaken within an ICT for Development (ICT4D) intervention called Siyakhula Living Lab (SLL) which is based in the Eastern Cape province of South Africa. The research further eliminated the accessibility constraints associated with long distances and remoteness from the Digital Access Nodes (DANs) and provided increased penetration in the network in contrast to the traditional Telecentre model which has been used extensively in ICT4D interventions. This was achieved by deploying WiFi hotspots around the DANs and extending the existing SLL WiMAX backbone to increase the network footprint to neighboring communities. The technical result of the research has been the provision of increased capillarity on the network and service redistribution throughout the entire Dwesa community. Consequently, this has given local community members an opportunity to access network services easily and ubiquitously. Finally, the research investigated and presented the benefits of such wireless network deployment configurations on ICT4D activities in marginalized areas.
