Ochrana spotřebitele v případě úpadku cestovní kanceláře / Consumer protection in the case of bankruptcy of the tour operator

The aim of this thesis is to analysis the current consumer protection in the case of bankruptcy of the tour operator in the Czech Republic, review of the present situation in selected member states of the European Union and a draft for the specific alternative options for the Czech Republic to increase the protection of clients of the tour operator. The theoretical part is devoted to the definition of the fundamental and legislative terms relating to the issues under examination. The practical part outlines the current situation of bankruptcies of the tour operators and ensuring the conditions in the Czech Republic and also in the European Union. The merit of the practical part is the result of the market research implementation, aimed at evaluation of the attitude and opinions of the professional public on the current situation in the branch. Based on the obtained information, the specific options for the tour operators and adjustments in the Czech tourism industry are provided, so the consumer protection in the case of bankruptcy of the tour operator would be sufficient.

Restructuring as one of the ways of solving insolvency is a method, that is supposed to allow preservation of the operation of the debtor`s company. Part of the restructurings however later converts into bankruptcy orders. The objective of this thesis is an identification of the key factors that lead to a successful fulfilment of the restructuring plan and also factors that might lead to their conversion into bankruptcy orders. The first part of this thesis is dedicated to insolvency and methods of its resolution among others according to the act no. 182/2006 Coll. on Insolvency and Methods of its resolution (Insolvency Act). The second part is dedicated to the selected factors and their possible influence on successful or unsuccessful completion of the restructuring. The conclusion includes a summary of important findings concerning whether and if so, what kind of connection is there between the selected factors and their influence on the successful completion of restructurings.

Dissertation thesis deals with the managerial needs in the area of financial health. Managers need a tool to reveal the impending financial failure or to assess the financial quality of the organization. They link their decisions to performance, ability to pay, employee productivity, financial resources and financial risk. In the theoretical part of the thesis it is necessary to explain the non-profit sector and its connection with the hospital environment. It is also necessary to introduce models used both in the Czech Republic and abroad, which share common elements. The basic aim of this thesis is to propose a financial performance prediction index for decision support of the hospital management, the owners of hospitals and insurance companies. To achieve the basic goal, three sub-goals must be accomplished. The first goal is to divide the hospitals into healthy and unhealthy by using the multi-criteria methods. The second goal is, based on an expert approach with the support of statistical methods, the selection of indicators appropriate for the hospital environment and the third goal is to find a suitable method for the determination of weighted representation of individual indicators in the proposed index and to assemble the final form of the new financial index for the hospital environment.

Cash flow based bankruptcy risk and stock returns in the US computer and electronics industry

This thesis investigates the anomalous underperformance of distressed stocks in the US computer and electronics industry. It shows that such anomaly can be explained by a parallel analysis of risk based rational pricing and profitability (earnings) levels to returns relationship propositions. For the 1990 to 2006 period, distressed stocks have on average underperformed their non-distressed counterparts. However, once the conditional relationship with profitability is taken into account, the distress risk is rewarded by a continuous positive return hence priced appropriately. In the computer and electronics industry growth stocks (low B/M) outperform on average value stocks (high B/M). The size factor has not been confirmed to be significant in explaining stock returns for this specific industry over the 1990 to 2006 period. The study also reveals that B/M and size factors do not proxy for distress risk. The B/M factor follows an inverted u-shape along the distress risk deciles axis. As result, stocks in low and high distress portfolios share similarly low B/M values. Cash flow based bankruptcy predictors estimated on a quarterly basis from a Cox proportional hazard model, that are used as proxy for a continuous distress risk factor in asset pricing tests, are able to predict bankruptcies at higher accuracy rates than the Z-Score as alternative measure.

The use of absorbing boundaries in the analysis of bankruptcy

An explicit solution is given for the value of a risk neutral firm with stochastic revenue facing the possibility of bankruptcy. The analysis is conducted in continuous time. Uncertainty is modeled using an Ito process and bankruptcy is modeled as an absorbing boundary. The analysis yields an ordinary differential equation with a closed form solution. The value function is used to calculate the firm's demand for high interest rate loans, showing a positive demand at interest rates which appear intuitively to be excessive. A value function is also derived for a risk neutral lender advancing funds to the firm. The borrowing and lending value functions are then used to examine various aspects of lender-borrower transactions under different bargaining structures. In a competitive lending market, the model shows that credit rationing occurs inevitably. In a monopoly lending market, the lender sets interest rates and maximum loan levels which reduce the borrower to zero profit. When a second borrower is introduced, the lender must allocate limited funds between two borrowers. A lender is shown to squeeze the smaller "riskier" borrower out of the market when the lender's overall credit constraint is tight. Under each bargaining structure, the model is also used to examine changes in the respective "salvage" recoveries of the lender and borrower on bankruptcy. This analysis focuses on the analysis of financial statements, ratios, and finally the application of credibility and bankruptcy models.
