Odlišnosti v transpozici směrnice o modré kartě napříč Evropskou unií / Variances in the Blue Card Directive Transposition across the European Union

This work attempts to analyze causes of divergent transposition of the Blue Card directive, regulating the conditions of immigration of highly-skilled workers from third countries, between individual EU Member States. The differences are analyzed on two levels. Firstly, in terms of timeliness and correctness of transposition, secondly, from a perspective of a different manner of transposition of the discretionary clauses entailed in the Blue Card directive (whether the Member States opted for an open or for a restrictive way of transposition of these provisions). Scholarly literature about transposition compliance and highly-silled immigration policies creates the foundation, by means of which the author identifies several variables and articulates hypotheses aiming at providing explanation of the divergent transposition of the directive in the respective Member States. The author classifies the Member States in groups and clusters according to their transposition performance and its results embody a point of departure for a subsequent analysis. From each group, certain number of countries is selected for a detailed country-level analysis in order to ensure universality and geographical representativeness of the outcomes. An <em>Ever Closer</em> International Society? : A Social Constructivist Approach to Trans-Regional Migration between Africa and the EU

<p>This thesis discusses the recent change in EU’s immigration policy. EU’s restrictive policies may be changed by the two proposals, COM(2007)637 and COM(2007)638, presented in October 2007. These proposals were formed during a process in which representatives from the African Union (AU) were present in discussions about migration. Using official documents from EU and AU, we study this inter-regional interaction process with the English School theories of “international society” and with a Social Constructivist ontological model describing the relationship between agents, structure and institutions/regimes. We find that the proposal changes the trans-regional migration regime, and by extension the structure and the trans-regional world order. This will probably lead to an increase in the number of African labour immigrants in the EU, which may enlarge the trans-regional “world society” and, in turn, the inter-regional “international society”.</p>

České zelené karty v kontextu imigrační politiky EU / Czech green cards in context of the immigration policy of the EU

Green card is a new type of residence permit within the territory of the Czech republic designed for foreigners from selected third countries. It entitles its holder to residence as well as work. The concept functions in the Czech republic since 1.1.2009. This thesis sets the Czech project of green cards into wilder context of the immigration policy of the EU and examines whether Czech green cards are compatible with similar system of EU blue cards which is not yet running on but it is in process of approval. The thesis also investigates if there are similar systems already working in other EU member states and compares Czech green cards to selected systems of green cards of Germany and Denmark. It also deals with the question whether the Czech system has so far been successful, what are its strengths, weaknesses and prospects of the future.

69 Abstract The main goal of the diploma thesis "Employment of foreigners" is to summarize and critically evaluate the current legislation regarding the employment of foreigners in the Czech Republic, both for foreigners from countries which are not Member States of the European Union and also employment of citizens of the European Union since a separate regime applies to each of these groups under the Czech law. The thesis itself is divided into the introduction, four main chapters and a conclusion. The first chapter defines the most important legal terms which are crucial for the elaboration of the thesis, i.e. in particular a foreigner - as a general term as well as the legal definition stipulated in the Act on Residence of Foreign Nationals in the Czech Republic, a family member of an EU citizen or a Czech citizen respectively, an employee, an employer and employment. The second chapter deals with the current legal status and concept of employment of foreigners in the Czech Republic with focus on individual types of residence permits, types of individual work permits as well as on employers' obligations and necessary steps when employing EU citizens or foreigners in the Czech Republic. Les objectifs de cette recherche sont de comprendre comment se déroule lélaboration de la politique dimmigration de travail dans le cadre européen et comment sest développé un discours favorable à une nouvelle immigration de travail en Europe. La recherche est basée principalement sur des entretiens semi-structurés avec des acteurs des institutions européennes et de la société civile européenne et un corpus documentaire. Lanalyse des différentes phases du processus de policy-making européen montre dune part, comment émerge un discours européen dans le chef de la Commission européenne qui rompt avec le discours public dominant de fermeture à limmigration de travail et qui défend une approche communautaire de cette immigration et dautre part, comment ce discours évolue et se transforme pour développer une stratégie dapproche différenciée de limmigration de travail permettant un changement de politique publique qui se matérialise par ladoption de la Directive dite de la « carte bleue » et une entrouverture de l'UE à l'immigration de travail. La thèse démontre que la Commission cherche avant tout à se positionner comme acteur supranational et à renforcer ses compétences. Elle démontre aussi que la reconnaissance du caractère continu et durable des migrations reste inégale au niveau des différents acteurs européens et leur tendance à préférer limmigration de travail temporaire. Enfin, elle montre aussi que la résolution du paradoxe qui consiste à privilégier limmigration provisoire tout en exigeant des immigrants des qualités de permanence se manifeste en privilégiant ladmission de catégories spécifiques de migrants présumés pré-intégrés ou en transformant lintégration en condition dadmission.

The diploma thesis "Employment of foreigners" deals with the topic of legislation and proceedings concerning employment of foreigners in the Czech Republic. In the first place it is aimed at employment of foreigners that do not have nationality of European Union member states, member states of European Economic Area and Switzerland, but it also deals with employment of nationals of European Union member states. Different rules for access to labour market are set up for these two distinct groups of foreigners while for nationals of European Union member states the access is significantly easier. This diploma thesis is structured into six chapters. Chapter One deals with sources of law that are relevant for given topic - both on domestic and on international level. Chapter Two contains definitions of basic concepts that are essential for this thesis. These are concepts of foreigner, employment, subjects of employment relationship, family member of national of EU member state and illegal work. Chapter Three is aimed at particular types of residence of foreigners in the Czech Republic. Foreigners can use several different types of residence permits that allow them to stay in the country. The thesis, entitled Employing foreigners focuses on the issue of employing foreigners in the Czech Republic, mainly the foreigners from non-EU countries. The primary goal of the thesis is to analyze the institute of the employee card which was introduced to the Czech law in 2014 changing radically the system o employing foreigners in the Czech Republic. The thesis also includes analysis of implementation aspects of the employee card in practice building on the experience of the author with the institute. This thesis is divided into four parts. The first one examines and explains the most important terms regarding employing foreigners. The terms foreigner, employment, employee card, long-term residence and others are explained in this part. Thesis title: Employing Foreigners The aim of the diploma thesis is an analysis of the legal conditions concerning the employment of foreign nationals in the Czech Republic. The second goal is the detection of the situation regarding employing foreigners in Great Britain.
