The theme of the thesis: ,,The matter of the restitution of the church property after 1989", has been chosen due to the interesting public debate about this topic, which is very interesting, topical, sharp and clearly very controversial. The importance of the issue adds its development, while there are still continually opened new aspects and perspectives of this topic. The topic is significant by ambivalence of opinions, basically a certain helplessness and by the sharp clashes of the different opinions of the professional community. The cause is very simple. It is a problem with very complex historical and legal background. The diploma thesis attempts to uncover the background of the preparation of the restitution process and of the separation of the church and state after the 1989 including their historical background and important constitutional aspects. My goal was to describe a path which led to the enactment of the law about the property settlement with the churches and religious societies in 2012. The intention of this paper is not to cover all aspects of this topic, after all that is impossible in frame of one diploma thesis, but it should provide the reader a formally complex material which clarifies the causes and consequences of the enactment of the Act no. 428/2012 coll., about the...

Václav Valeš: Restitution of Church Property in the Czech Republic After 1989 This work describes the sensitive theme of church property restitution in the Czech Republic after 1989. Two laws of restitution accepted from 1990 to 1991 (the law Nr. 298/1990 Coll. and the law Nr. 338/1991 Coll.) solved in particular the activities of Roman Catholic religious orders and congregations. The common law solving church restitutions generally was in 1992 and 2008 not accepted and this situation continues today. This situation restricts churches and religious societies in their work in many areas. A tiny proportion of their properthy were churches and religious societies returned by another way (executive way between 1996-1998, declaratory action).Besides the analysis of existing legislation this work also contains relating judicature of the Constitutional and Supreme Court of the Czech Republic. Současná veřejná debata o náboženství: parlamentní debata o církevních restitucích a jejich zdanění v České republice / Contemporary Public Debate on Religion: Parliamentary Debate on Church Property Restitution and its Taxation in the Czech RepublicFila, Filip January 2019 (has links)
In order to fill a gap in the literature and illustrate what a public debate on religion might look like in a country as unchurched as the Czech Republic, this thesis conducted thematic content analysis on two parliamentary debates related to church property restitution. Transcripts of the debates in The Chamber of Deputies of the Parliament of the Czech Republic on the 2012 Church Property Restitution Bill and the 2017-2019 Proposal to Tax Church Property Restitutions were used to answer theoretically and empirically informed questions pertaining to secularisation. The finding was that it was not religion necessarily, but rather matters of finances, legality, and procedure that figured quite prominently in the debate. Despite this, closer analysis revealed some relevant reflection on religion, most notable on in what sort of relation should churches and religious communities be with the state. The main takeaway from the research is that Members of Parliament acknowledged low individual level religiosity and did not promote something resembling the concept of vicarious religion. There speeches were on the whole interpreted to be more in line with advocating secularisation, rather than desecularisation.

The thesis focus on the reconversion church building in the selected location. At the beginning of the work described church buildings and their influence on the surrounding, the structure of the Roman Catholic Church and the development of church property during the history. This is complemented by theoretical terms and possible methods of valuing cultural monument. The practical part deals with the reconversion church building, specifically the Dominican monastery in Znojmo. Based on an analysis of Znojmo and monastery was suggesting possible use of the monastery. Of these, two variants were selected and were compared. Of these two options, one was chosen as the most suitable option for future use.

Integration von (1) gemeinschaftlichem Leben, (2) gesellschaftsrelevantem Gemeindebau und
(3) Immobilienmanagement gelingen kann. Die aktuelle ekklesiologische Praxis und
Erfahrung zeigt jedoch, dass es zu Spannungen zwischen dem Prinzip des gaben- und
konsensbasierten Miteinanders, einerseits und der Entwicklung eines gesellschaftsrelevanten
Gemeindebaus und einem die ersten beiden Bereiche unterstützenden
Immobilienmanagements andererseits kommt. Infolgedessen soll im Rahmen dieser Arbeit
die Frage nach der genauen Art und Ausprägung dieser Spannungen, ihren Ursachen und
möglichen Lösungen, die eine wirklich fruchtbare Integration dieser drei Bereiche
ermöglichen, untersucht und beantwortet werden. Dies erfolgt mit einem interdisziplinären

The Reformation in the burgh of St Andrews : property, piety and powerRhodes, Elizabeth January 2013 (has links)
This thesis examines the impact of the Reformation on the estates of ecclesiastical institutions and officials based in St Andrews. It argues that land and wealth were redistributed and power structures torn apart, as St Andrews changed from Scotland's Catholic ecclesiastical capital to a conspicuously Protestant burgh. The rapid dispersal of the pre-Reformation church's considerable ecclesiastical lands and revenues had long-term ramifications for the lives of local householders, for relations between religious and secular authorities, and for St Andrews' viability as an urban community. Yet this major redistribution of wealth has had limited attention from scholars. The first part of this study considers the role played by the Catholic Church in St Andrews before the Reformation, and the means by which it was financed, examining the funding of the city's pre-Reformation ecclesiastical foundations and officials, and arguing that (contrary to some traditional assumptions) the Catholic Church in St Andrews was on a reasonably sound financial footing until the Reformation. The second section considers the immediate disruption to St Andrews' religious lands and revenues caused by the burgh's public conversion to Protestantism, and then explores the more planned reorganisation of the 1560s. The disputes and difficulties triggered by the redistribution of ecclesiastical wealth are examined, as well as the longer term impact on St Andrews of the treatment of church revenues at the Reformation. Evidence for this study is chiefly drawn from the extensive body of manuscripts concerning St Andrews held by the National Library of Scotland, the National Records of Scotland, and the University of St Andrews Special Collections.
