Como ponto de partida, tomou-se o Cerimonial de Formatura uma vez que a autora ao participar de vários desses rituais como diretora de escola pôde perceber que por trás de sua formalidade e de seu caráter de festa escondese uma trama social institucional existente na sociedade. Tal estudo foi realizado em uma Escola Pública de um bairro periférico do município de Jundiaí com 11 (onze) alunos que durante o período de 1984 a 1991 cursaram o primeiro grau e não enfrentaram nenhuma reprova com suas mães e com os doze (doze) professores mais apontados por eles. Os instrumentos da pesquisa foram constituídos por fotos documentos oficiais entrevistas "semi-orientadas' e questionários aplicados aos alunos às suas mães e aos professores.O trabalho ficou dividido em quatro capítulos: no primeiro intitulado Cerimonial de Formatura há uma reflexão sobre este rito considerando o uma representação simbólica do "sucesso" escolar; no segundo capítulo A Vida no Bairro, registra-se a condição de favelados migrantes rurais e mostram-se as condições de vida que devem ser entendidas a partir de um contexto histórico, cujo aparecimento se deve a condições específicas; no terceiro, A Casa da Família, fazse uma apreensão desta instituição por meio das relações sociais que ocorrem em seu interior, da representação que os pais possuem da escola, e como estes inculcam na criança desde seus primeiros anos, a importância da educação escolar, apontando-a como um instrumento de acesso a um futuro melhor; no quarto capítulo abordam-se as relações sociais que ocorrem na sala de aula. o singular dos dois últimos capítulos está nas biografias dos alunos e professores, centradas na trajetória social e escolar, nos sonhos e expectativas que são elementos decisivos para percepção das estratégias familiares face à escolarização. o estudo evidencia que o "sucesso" escolar constitui uma realidade ambígua e paradoxal, e que o aspecto importante que o Cerimonial de Formatura permite ressaltar é o poder simbólico da escola, capaz de criar sistemas de disposições tais que levam a fazer crer como naturais e evidentes situações dramáticas de experiências sociais / Abstract: As an instrument to understand the school "success", this work. was conducted in order to study the social relations which take place in the family and at school. The Graduation Cerimony was taken as a starting point, once the author has participated in many of them as a school principal, and was able to observe that, behind its formality and character of party, an institutional and social plot is hidden The research was made at a public school in the outskirts of the County of Jundiaí, with eleven students who from 1984 to 1991 attended High School Junior, and who did not face any failure, with their mothers, and with the twelve teachers who had been mentioned by them most of the time during the interviews. Photos, legal documents, partially directed interviews, and inquiries applied to the students, to their mothers, and to the teachers,were the instroments of this study. The work. was divided into four chapters: Chapter I - Graduation Cerimony - is a reflection about this ritual, tak.en as a symbolic representation ofthe "well succeeded»at school; Chapter n - Life the Area - depicts the life condition of the dwellers who migrate ftom the country side, and which must be understood within a historical context, resulting ftom specific conditions; Chapter m - The Family House - such an institution was apprehended through the social relations which occur inside it, the representation that the parents have of the school, and how they remark ftom the very beginning to their children the importance of school education as an instrument to the stairway for a better future; Chapter IV - Social Relations in the Classroon The last two chapters also bring biograpy of the students and teachers, centered in the social and school experiences, dreams and expectations, which are decisive elements for the perception of the family strategies in relation to schooling.The study outlines that "to be welllucceeded at school" is meant to be an ambigous and paradoxal reality, and that the important aspect transmitted by the Graduation Cerimony is the symbolic power of the school, which is capable of creating disposition systems that as such are believed to be natural and evident dramatical situations of social experiences / Mestrado / Administração e Supervisão Escolar / Mestre em Educação

These rituals are filled with internal symbolic representations, by raising feelings and external that work our visualities. Among all Graduation Ceremonies run by Mackenzie Presbyterian University, there is a specific one that bring a historical legacy, the Faculty of Law. The purpose of this research was to investigate the importance of the academic ritual of the Graduation Ceremony, especially the one held by the Faculty of Law of Mackenzie Presbyterian University, between 2009 and 2017, but also considering some historical factors since its first solemnity in 1959. The research was established in theoretical conceptualization, bringing the Graduation Ceremony as a historical ritual filled with visual symbolic, behavioral and sentimental representations, discussed by authors such as Bourdieu (1989), Chartier (1990) and Peter Burke (1992). Ethical aspects were raised, but also aesthetic aspects, personal recognition relationships, respect, hierarchy and power established by it, harmony and individual rights, principles that compose solemn and ritualistic acts, which historically are normatized, such discussions are raised by Burns (1959) and Elias (2001). The methodology adopted was qualitative, which included: field research and continuous bibliographic search; interviews with several personalities who have experienced the Graduation Ceremony in its most diverse instances, bringing the perspective of oral history, raising the lived experiences, descriptions and conceptualization, as well as bringing aspects of memory as much by the experience, as by its verbalizations and photographic records; survey and systematic mapping of verbal and non-verbal records made in imaging analyzes and with the insertion of phrases, as part of the interviews; as well as a survey of 425 graduates from the Law Course in December 2017, where tangible and intangible aspects of the feelings experienced during the ritual were set out in graphs. The conclusion of this research is reflected in the symbolic, subjective and sentimental importance of this academic act that is verified; in the historical record of the Mackenzie Presbyterian University; and in the certification that rites such as these are symbols that extol the achievements, that hierarchize society, and are necessary for the harmonious social construct. / A colação de grau é um ritual acadêmico que surge juntamente com a história da Universidade. Estes rituais são repletos de representações simbólicas internas, por trazerem à tona sentimentos e externas que trabalham nossas visualidades. Dentre as diversas colações de grau executadas pela Universidade Presbiteriana Mackenzie, existe uma em específico que acompanha um legado histórico, a Faculdade de Direito. Esta pesquisa teve como objetivo geral, investigar a importância do ritual acadêmico da Colação de Grau, especialmente o que é realizado na Faculdade de Direito da Universidade Presbiteriana Mackenzie, entre os anos 2009 a 2017, mas contemplando também alguns fatores históricos desde sua primeira solenidade em 1959. A investigação foi estabelecida em conceituação teórica, trazendo a cerimônia de Colação de Grau como um ritual histórico repleto de representações simbólicas visuais, comportamentais e sentimentais, discutidos por autores como Bourdieu (1989), Chartier (1990) e Peter Burke (1992). Foram levantados aspectos éticos, estéticos, as relações de reconhecimento pessoal, o respeito, a hierarquia e o poder por ela estabelecida, a harmonia e os direitos individuais, princípios estes que compõem atos solenes e ritualísticos, que historicamente são normatizados, discussões estas levantadas por Elias (2001). A metodologia adotada foi a qualitativa, que contemplou: pesquisa de campo e levantamento bibliográfico contínuo; entrevistas com diversas personalidades que experenciaram os atos de colação de grau em suas mais diversas instâncias, trazendo a perspectiva da história oral, levantando as experiências vividas, descrições e conceituação, bem como trazendo aspectos de memória tanto pela vivência e experiência, quanto por suas verbalizações e registros fotográficos; levantamento e mapeamento sistemático dos registros verbais e não verbais feitos em análises imagéticas e com a inserção de frases, partes constantes nas entrevistas; e também uma pesquisa com 425 formandos do curso de Direito de dezembro de 2017, onde foram levantados aspectos tangíveis e intangíveis quanto aos sentimentos vividos durante o ritual, dados estes que foram expostos através de gráficos. A conclusão desta pesquisa se reflete na importância simbólica, subjetiva e sentimental deste ato acadêmico que fica constatada; no registro histórico da Universidade Presbiteriana Mackenzie; e na certificação de que ritos como este são símbolos que enaltecem as conquistas, que hierarquizam a sociedade e que são necessários para o construto social harmônico.

Special attention is to be given to the polemic aspects, arising out of 2002 Civil Code provisions. Therefore, six major themes are analyzed. Initially, descent law origin and legal basis are presented, as well as collation historical evolution, indicating its definition and legal basis. Then, it deals with collation subjective aspect, approaching the most relevant quests in regard to heirs who are compelled to collate according to Brazilian legal system. The third theme reports to the objective aspect, concerning assets identification which, donated to heirs whilst deceased was still alive, arise the need of collation, or not. Analysis on how to effect collation and the amount of donated asset to be taken into consideration are presented right after as the fourth theme. The theme before last approaches concept and legal basis of inheritance share of one's parents and calculation of collation assumptions, collation dismissal and unofficial decrease. Finally, it reports to lawsuit to effect collation / O presente estudo destina-se a abordar, de forma crítica, a colação, instituto do direito das sucessões com forte aplicação prática, o qual, em regra, é objeto de análises superficiais e contraditórias, em virtude das próprias previsões legais que o regulamentam. Dá-se especial atenção aos seus aspectos polêmicos, decorrentes das previsões do Código Civil de 2002. Serão analisados, para tanto, seis temas principais. Apresentam-se, de início, a origem e os fundamentos do direito das sucessões, assim como a evolução histórica do instituto da colação, com a indicação de sua definição e fundamentos. Em seguida, trata-se do aspecto subjetivo da colação, por meio da abordagem das mais relevantes indagações quanto aos herdeiros que são obrigados a colacionar no ordenamento jurídico pátrio. O terceiro tema reporta-se ao aspecto objetivo, no que concerne à identificação dos bens que, doados em vida pelo de cujus aos seus herdeiros, levam à necessidade, ou não, de colação. A análise da forma de se efetivar a colação e do valor do bem doado a ser levado em conta é apresentada logo em seguida, no quarto tema. Como penúltimo tema, abordam-se o conceito e os fundamentos da legítima e o seu cálculo nas hipóteses de colação, de dispensa de colação e de redução por inoficiosidade.
