Subjekty exekučního řízení / Entities of execution proceedings.

I have chosen the topic of this diploma thesis for its relevance. The number of ordered executions is still high and the ratio between rights and obligations on the part of individual subjects of the execution proceeding is unclear. The diploma thesis discusses subjects of the execution proceeding according to the Execution Procedure Act. It analyses who can be subject and participant of the execution proceeding, the status of the subjects, their role in execution proceeding and also their rights and duties. The aim of the diploma thesis is to compare the position of individual subjects, describe how the execution can affect lives not only of the obligated and entitled subjects but also lives of third parties and to elaborate on future legislation. The diploma thesis is, except for the introduction and the conclusion, divided into ten chapters. The beginning is devoted to general questions regarding subjects and participants of the proceeding and the proceeding itself. Then it discusses individual subjects of the execution proceeding. The last chapter focuses on the discussion about future legislation.

This diploma thesis deals with a comparison of two civil codes. Statute number 40/1964 Sb. and statute number 89/2012 Sb. The law science speaks generally in connection with passing of statute number 89/2012 Sb. about recodification of private law. The term of recodification does not mean only adjustment of legal text in more elegant and especially more systematic way, but also removing of some problems in the legal order. The civil code from 1964 was created in another social circumstances and therefore the legal public hoped with passing of statute number 89/2012 Sb. for removing of some defects in civil law. These defects were caused by the selected method, the law should have adapted through this method to new social circumstances. This diploma thesis compares family law (as institute) according to legal order, which was in force before and after the day of 1. January 2014. The conception of family law before this date, so according to the civil code from 1964, arose at the time of intellectual peak of socialism and the task of this thesis is to find, where the family law was moved by the new civil code. Effectivité des droits des créanciers et protection du patrimoine familial / The effectiveness of the rights of the creditors and the protection of family

Le droit de l’exécution forcée offre aux créanciers des voies de droit pour contraindre les débiteurs défaillants à exécuter leurs obligations à leur égard. Ce rapport d’obligation est cependant moins un lien entre deux personnes qu’un rapport entre deux patrimoines. C’est ce qui explique que les obligations s’exécutent sur les biens des débiteurs. La matière devrait donc être hermétique à la situation familiale du débiteur et ne s’intéresser qu’au patrimoine personnel de celui-ci. Cependant, malgré l’absence de personnalité juridique de la famille, il est communément question du « patrimoine familial ». Entendu au sens large, le « patrimoine familial » intéresse alors nécessairement les tiers créanciers. Certains biens en effet, font l’objet d’une protection particulière, destinée, plus largement, à protéger la famille. A la protection d’origine légale, s’ajoute éventuellement une protection conventionnelle. Le législateur offre ainsi un espace de liberté à la volonté privée, même si l’exercice de celle-ci doit aboutir à réduire le gage du créancier. L’ensemble de ces dispositions protectrices entre donc nécessairement en conflit avec le droit à l’exécution des créanciers et conduit à s’interroger sur la légitimité de l’atteinte qui en résulte. Il apparait que dans certains cas l’équilibre entre la garantie de l’effectivité du droit à l’exécution forcée du créancier et la protection légitime du patrimoine de la famille est respecté, alors que dans d’autres, il est largement menacé, voire bouleversé. Et c’est alors toute l’économie du droit de l’exécution forcée qui est remise en question / The right to enforced performance offers creditors legal remedies for forcing defaulting debtors to perform their obligations. However, this relationship of obligation is less a tie between two people as it is a tie between two sets of assets. This explains why obligations are performed in respect of the property of the debtor. Performance should thus be entirely extraneous to the debtor's family situation and concern only the debtor's personal assets. Yet despite the fact that families do not have legal personality, "community property" (patrimoine familial) commonly comes into play. In the broad sense of the term, "community property" is thus necessarily of interest to third-party creditors. Certain property is afforded special protection generally intended to protect the family. In addition to legal protection, contractual protection may also apply. The legislation in this area thus allows for a certain degree of flexibility with respect to private will, even if it ultimately reduces a creditor's claim. This protection thus necessarily conflicts with the creditor's right to performance and raises the question of the legitimacy of the interference it causes. In some cases, the balance is maintained between guaranteeing creditors' ability to exercise their right to enforced performance and ensuring legitimate protection of family assets. In other cases, however, this balance is threatened or even upset, calling the entire tenor and intent of the right to enforced performance into question

Summary: This work proposes a closer look at the divorce-related topics with consequential impacts both on financial situation of divorced spouses and destinies of minor children as resulting from divorced marriages in Czech Republic. Till date, this issue has been solved in different ways at both district and regional courts. In our republic, a more unifying element is represented by decisions of the Supreme and Constitutional Courts. This is a very serious social phenomenon which, according to statistics affects a large number of parents, children, but also childless partners. Yet from ancient times this phenomenon is known to be socially undesirable being almost entirely rejected by the Catholic Church in its canon law. The increase in divorces has resulted namely from the advancement procedure of society. It is a societal phenomenon known to occur irrelatively of the states and political systems, from the totalitarian regimes through those autocratic, up to highly democratic systems of developed countries worldwide. During the creation of this work, up to 40% of marriages have been critically monitored as expected to be ended in divorce. The Meetse-a-tala community from Groenwater, Northern Cape, was resettled in 1964 and returned in 1999 to their ancestral land after a 25 year struggle to do so. The community anticipated that the land would present all the natural resources they had in 1964, but unfortunately, when they returned, the outlook seemed a lot different. / Verskuiwing in die Suid-Afrikaanse konteks is ‘n diverse en komplekse verskynsel wat nog nie voldoende nagevors is, veral vanuit die oogpunt van post-hervestigingsstres nie.
