Summary: Constitutional judiciary in Spain The subject of this thesis is constitutional judiciary in Spain. According to the Spanish Constitution of 1978 Spain belongs in the group of states which have established a system of concentrated and specialized constitutional judiciary. In the Czech legal literature is the Spanish constitutional judiciary mentioned mainly as a system based on the German constitutional judiciary, writings dedicated exclusively to the Spanish system are not very common. In spite of the fact that the legislative regulation of the Spanish Constitutional Court was really importantly inspired by the regulation of the Federal Constitutional Court of Germany (especially in the area of competencies of the Constitutional Court), there are also some significant particularities and typical features of the Spanish Constitutional Court which can be an interesting subject of an analysis. The aim of the thesis is to provide a characterization of the Spanish constitutional judiciary. Because of the limited length of the thesis this study does not contain a detailed analysis of all aspects of the Spanish constitutional judiciary. A miss?o pol?tica do Supremo Tribunal Federal: an?lise de sua import?ncia como corte constitucional para o controle do poder no Brasil

For that purpose, we start by examining the intimate relationship between Politics and Law, in view of the most recent social systems theories, so that the political system is distinguished by the exclusiveness of using the physical force, intending to make coletive tying decisions, and the juridical system as a congruent generalization of the expectations towards the rules and principles, brought together under an interdependence by which both gather legitimacy and effectiveness. In this manner we can notice the political effects of the constitutional interpretation conducted by Judges as well as by other juridical professionals, because these ones decrease the overload of expectations which are pointed to the Judicature. Constitutional interpretation is democratized since the participative democracy arises and stablishes a permanent state of awareness around the exercise of power and favours the preservation of the pluralism (counter-majoritary principle) where we can find the origin of the democratic nature of constitutional courts, once, in most cases, their members are not elected by the people. After that, we analyse the historical posture of the Supremo Tribunal Federal as a constitutional court in Brazil, so we can realize the attempts to make it vulnerable to the appeals of governability and economical aims, agains which this court somehow has resisted, stressing its particularities. At the end, it s concluded that even the so-called acts of government, whose judiciary control is mostly repelled, are subjected to a constitutional analysis, last frontier to be explored by the Supremo Tribunal Federal in its role of exposing our republican Constitution / O presente estudo prop?e uma an?lise do processo de politiza??o que enfrenta a justi?a constitucional brasileira, com destaque para o Supremo Tribunal Federal. Para isso, parte-se da perscruta??o acerca da rela??o de intimidade entre Pol?tica e Direito, sob a ?tica das mais recentes teorias dos sistemas sociais, para caracterizar o sistema pol?tico pela exclusividade do uso da for?a f?sica dirigida ? fun??o de tomar decis?es coletivamente vinculantes, e o sistema jur?dico como generaliza??o congruente de expectativas normativas, dentro de uma interdepend?ncia voltada ? legitima??o e efetividade de ambos os sistemas. Assim, acaba-se por concluir pela politicidade da interpreta??o constitucional, seja ela realizada por magistrados (como admitia Kelsen), seja pelos demais profissionais do Direito, por amenizarem a sobrecarga de expectativas dirigidas ao Judici?rio, sempre buscando na Constitui??o, vista como o mecanismo de abertura cognitiva do Direito para a Pol?tica, a matriz pol?tica de sua argumenta??o. A democratiza??o da Hermen?utica Constitucional resulta do florescimento da democracia participativa, que instaura um permanente estado de vigil?ncia em torno do exerc?cio do poder e favorece a preserva??o da pluralidade (princ?pio contra-majorit?rio) de onde se extrai a pr?pria natureza democr?tica das cortes constitucionais, j? que, via de regra, n?o s?o elas constitu?das a partir do sufr?gio popular. Nesse diapas?o, ruma-se para uma aprecia??o hist?rica da atua??o do Supremo Tribunal Federal como corte constitucional brasileira, identificando-se as tentativas de o tornarem vulner?vel aos apelos da governabilidade e das metas econ?micas, a que tem resistido ao ressaltar sua especificidade. Por fim, conclui-se que mesmo os chamados atos de governo, onde a discricionariedade administrativa apresenta a mais firme repulsa ? submiss?o a controle por parte da fun??o jurisdicional, s?o pass?veis de an?lise sobre sua constitucionalidade, ?ltima fronteira a ser explorada pelo Supremo Tribunal Federal em sua miss?o de expositor de nossa Constitui??o republicana
