Neste sentido, este trabalho se propôs descrever os fatores condicionantes à introdução da legislação da propriedade intelectual na universidade e a forma de gestão a ela associada. O objetivo geral foi analisar como as Instituições Públicas de Ensino e Pesquisa estão apreendendo e implementando a proteção ao conhecimento cientifico tecnológico, após a promulgação do novo complexo de legislação, no campo da proteção à propriedade intelectual. Especificamente, foi possível ter um identificador das ações administrativas e das regulamentações internas destas instituições verificando os entraves à sua introdução e a forma possível de sua condução, ou seja a gestão da propriedade intelectual nas universidades pesquisadas. Foram analisados os dados existentes a respeito da proteção, registro e patenteamento nos órgão competentes da administração federal, as normas internas das universidades: UFV, UFMG, UFRJ, UNICAMP e USP em face da legislação referente a propriedade intelectual, aplicáveis a estas Instituições (Leis, Decretos, Projetos de Lei, Atos Normativos, Resoluções e Portarias congêneres e os novos Projetos de Lei em tramitação no Congresso Nacional). Buscou-se determinar como as Instituições Públicas se instrumentalizam, em face da propriedade intelectual e quais seus efeitos para as mesmas. Finalmente, buscou-se identificar os entraves e barreiras para a implementação efetiva da propriedade intelectual, nas universidades. / The new legislation on the intellectual property in Brazil, decade of 90, brought an excellent aspect the research scientific developed in the universities: the obligatoriness of the protection of the scientific knowledge, for the public institutions of education. In this direction, this work if considered to show to the description of the condition factors to the introduction of the legislation of the intellectual property in the university and the form of management associated it. The general objective was to analyze as the Public Institutions of Education and Research is apprehending and implementing the protection to the technological cientifico knowledge, after the promulgation of the new complex of legislation, in the field of the protection to the intellectual property . Specifically, it was possible to have identification of the administrative cases and internal regulations of these institutions being verified the impediments to its introduction and the possible form of its conduction, or either the management of the intellectual property in the searched universities. One analyzed the existing date regarding the protection, it register and patenteament in the agency competent of the federal administration, the norms of interns of the universities: UFV, UFMG, UFRJ, UNICAMP and USP in face of the referring legislation the intellectual property , applicable to these Institutions (Laws, Decrees, Normative Projects of Law, Acts, Resolutions and would carry same types and the new Projects of Law in transaction in the National Congress). One searched to determine as the Public Institutions if they instrumentalizam, in face of the intellectual property and which its effect for the same ones. Finally, one searched to identify the impediments and barriers for the implementation it accomplishes of the intellectual property , in the universities. / Dissertação importada do Alexandria
