Organismos nacionais e internacionais têm reconhecido a necessidade de se estabelecer meios que possam resguardá-los de situações consideradas perigosas, ao mesmo tempo em que os direitos já reconhecidos sejam cada vez mais preservados. Procurando alcançar esse objetivo, governos, autoridades e sociedade em geral, têm empenhado esforços para que a criança seja cada vez mais protegida. Historicamente, porém, percebemos que em outros períodos, como o medieval, a percepção da infância e de suas peculiaridades ainda não se apresentava de maneira clara para os integrantes daquelas sociedades. As crianças sofriam, juntamente com os adultos, as consequências de viver em uma sociedade com pouco ou quase nenhum controle de pulsões e emoções. Norbert Elias nos mostra que aos poucos a sociedade passa a exercer um maior controle sobre o indivíduo, fazendo-lhe exigências em relação aos comportamentos. Ao mesmo tempo em que isso acontece, o indivíduo modifica a sociedade e assim, numa relação recíproca um traz alterações ao outro sem que se consiga saber quem deu início ao processo. Faz parte da teoria dos processos de civilização de Norbert Elias a compreensão da importância do Estado e sua monopolização da força física e da tributação no controle dos indivíduos e de suas pulsões. Desse modo, o objetivo dessa pesquisa é compreender a importância do papel do Estado para proteção e o resguardo dos direitos da criança e do adolescente no Brasil. Nesse intento, foi realizada uma pesquisa que teve como referencial teórico algumas das principais obras de Norbert Elias, com o objetivo de compreender a teoria dos processos civilizadores e a contribuição que ela pode nos trazer para o entendimento da importância da intervenção... / Now the child and the teen have been objective of great concern of the society. National and international organisms have been recognizing the need to establish means to protect them of situations considered dangerous, at the same time in that the rights already recognized are preserved more and more. Trying to reach that aims at, governments, authorities and society in general, have been pawning efforts so that the child is protected more and more. Historically, however, we noticed that in other periods, as the medieval, the perception of the childhood and of their peculiarities, still didn't come in a clear way for the members of those societies. The children suffered, together with the adults, the consequences of living in a society with little or almost any instincts and emotions control. Norbert Elias tell us that little by little the society starts to exercise a larger control on the individual, making her demands in relation to the behaviors. At the same time in that happens, the individual modifies the society and like this, in a reciprocal relationship one brings alterations to the other without it is gotten to know who led off the process. Makes part of the theory of the civilizing process of Norbert Elias the understanding of the importance of the State and his monopolizacion of the physical force and of the taxation in the individuals' control and of their instincts. The objective of that research is to understand the importance of the paper of the State for protection of the child's and tenn's rights in Brazil.
