Orientador: José Augusto Chaves Guimarães / Banca: Plácida Leopoldina Costa Santos / Banca: José Fernando Modesto da Silva / Resumo: A Internet vem modificando substancialmente os hábitos de pesquisa do ser humano, por um lado permitindo-lhe maior agilidade e eficiência na obtenção de informações, mas, por outro, multiplicando problemas de direito autoral nas obras por ela veiculadas. Desse modo, torna-se necessário analisar, no âmbito doutrinário, legislativo e jurisprudencial brasileiro, os direitos autorais (intelectuais e materiais) e sua aplicabilidade às criações dispostas na rede, ao que se aliam questões como a de controle das cópias de tais publicações e a de meios para evitar falsificações, adulterações e uso indevido das mesmas. Valendo-se de pesquisa documental em fontes do direito e em informações da própria rede, parte-se da abordagem da Internet em seu conceito, características e tipos de documentos, analisam-se os direitos autorais em termos teóricos (conceito e modalidades) e aplicados (controle e proteção no Direito Brasileiro) e discute-se a utilização de alguns elementos para a proteção dos direitos autorais na Internet: Criptografia, Assinatura Digital, Certificação Digital e Marca d'Água Digital, concluindo-se pela natureza eminentemente diplomática dos mesmos. Verifica-se que a Criptografia, enquanto código, é a linguagem por meio da qual se apresenta o documento, podendo ser caracterizada, dentro dos elementos que compõem a estrutura documental, como um elemento externo, sob a ótica diplomática. Já a Assinatura Digital caracteriza uma subscrição, ou seja, a assinatura do autor nos documentos digitais, sendo dessa forma caracterizada como um elemento de estrutura interna do documento. A Certificação Digital representa uma espécie de precação, pois é por seu intermédio que se tem a certeza da legalidade do documento. (Resumo completo, clicar acesso eletrônico abaixo) / Abstract: The Internet has been substantially changing the research habits of human beings, on one hand providing them more agility and efficiency for obtaining information, but on the other hand it increases problems related to copyright in works that the net can spread. Consequently, it is necessary to analyse, in Brazilian doctrinal, legislative and jurisprudencial scopes the copyright (intellectual and material) and its apply to the creations on the net, to which are related questions such as the control of publications copies and the means to avoid falsifications, adulterations and inappropriate use of them. Based on documentary research, on law and also on information from the net, starting from the Internet approach in its concept, characteristics and types of documents, it is analysed the copyright in theoretical (concept and kinds) and applied (control and protection in Brazilian law) terms and it is discussed the use of some elements to protect copyright on the Internet: Cryptography, Digital Subscription, Digital Certification and Digital Watermark, and it is concluded with the diplomatic nature of the same. It is verified that the Cryptography, as a code, is the language through which the document is presented, and it can be characterized, among the elements that form the documentation structure, as an outer element, under the diplomatic view. The Digital Signature characterizes a subscription, that is, the author's signature on digital documents, it is therefore, featured as an element of the document inner structure. The Digital Certification represents a kind of precation because it proves the legality of the document. Resumo: A Internet propiciou a formação de uma rede descentralizada de informações nunca antes encontrada em nossa sociedade. Baseando-se na digitalização dos produtos culturais, a arquitetura da rede permitiu uma ampla distribuição de informações de maneira fácil e relativamente barata, favorecendo uma distribuição cultural de novo tipo, baseada na facilidade de apropriação, de compartilhamento e de produção de réplicas idênticas ao original. Contudo, essa prática tão comum da cibercultura freqüentemente desconsidera as leis de proteção dos direitos autorais, pois estimula uma livre circulação de informações em detrimento da proteção dos interesses autorais e mercadológicos de distribuição. A Internet inaugura ainda novos movimentos sociais, pautados pela construção comum de licenças autorais atualizadas e de práticas políticas de Desobediência Civil nesse novo terreno de disputa. Portanto, objetivamos neste trabalho investigar as formas de distribuição de informação no arcabouço tecnoinformacional e as suas relações com as estruturas jurídicas das leis proteção autoral e com as velhas e novas formas de acumulação. / Abstract: The Internet made possible the beginning of a unique decentralized network of information in our society. Relied on the digitalization of cultural products, the net's framing allowed a biggest sharing of information in a easier and cheaper way, supporting a cultural distribution of a new kind, based on the facilities of appropriation, sharing and production of identical copies from the original one. However, this ciberculture common practice frequently disrespect the copyright laws, because it encourage a free circulation of information in detriment of the authors and merchandising interests protection. The Internet still made possible the emerging of new social movements, ruled by common construction of actualized author's licenses and by political actions of Civil Disobedience within this new space of conflict. O intuito á aparelhar o artista de forma que, dominando os assuntos pertinentes ao direito de autor ele atue de forma preventiva e consciente na sua relação com o mercado cultural. Para isso foi criada uma personagem, Eve-Line, que possui dupla personalidade: é artista e advogada. Os dialógos entre as duas faces da personagem utilizam uma linguagem direta, destacando os pontos essenciais do direito de autor e criando uma comunicação diferenciada com o artista, auxiliando no acesso ao conteúdo jurídico. A materialização de todo o tema proposto e desenvolvido será apresentado na forma de Trabalho Equivalente, que ganha vida na gravação de um diálogo da personagem, através do qual discute-se pontos importantes do direito de autor. O fundamento é demonstrar a importância do domínio do conhecimento dos direitos e obrigações por parte do artista criador, propiciando uma visão prática das normas jurídicas que regulamentam a produção intelectual. / Abstract: The object of the present study is to demonstrate the intellectual propertyt protection to the artist and his work by presenting the rules of copyright, the issue relating to the problem of non-incidence of it in courses involving the creation of higher education institutions. The dialogues between the two sides of the character using straightforward language, highlighting the key points of copyright and creating a differentiated communication with artist, assisting in access to legal content. The materialization of the whole issue, aned developed will be presented in the form of equivalent work, which we discuss important issues of copyright. The reationale is to demonstrate the importance of domain knowledge of the rights and obligations on the part of the creative artist, providing a practical overview of the legal rules governing intellectual production. / Mestre

Resumo: Na modernidade, foi a imprensa com tipos móveis inventada por Gutenberg a tecnologia que propiciou mudanças nas formas de produzir, disseminar e usar a obra intelectual e levou segmentos da sociedade a exigir formas de proteção para a produção intelectual. No mundo contemporâneo, o advento da Internet propiciou o ambiente informacional Web Colaborativa onde a produção descentralizada e compartilhada de conhecimento gera uma nova configuração cultural de exponencial representatividade no fluxo da informação. Nesse ambiente, as práticas de colaboração e remix que o caracterizam são contempladas por uma legislação estabelecida para um contexto anterior ao desenvolvimento da Web e cria-se, portanto, um descompasso entre o que a tecnologia propicia e o que a lei estabelece quanto a produção intelectual. Assim, em beneficio da produção do conhecimento, torna-se imprescindível saber não só quais os limites que a legislação impõe, mas também verificar as alternativas emergentes que contribuam para o fluir da informação no âmbito da Web Colaborativa dentro dos padrões que a lei estabelece. Assim, o estudo, caracterizado como pesquisa bibliográfica e qualitativa com uma abordagem de observação direta não participativa, apresenta o texto dissertativo baseado em levantamento bibliográfico com revisão de literatura teórica e exploratória de aspectos relativos à Web Colaborativa (abordados a partir da observação de fenômenos como blogs e wikis e os websites Flickr e YouTube) e à legislação que regra o direito autoral. In the present-day world, the advent of Internet has favored the informational environment collaborative Web where decentralized and shared production of knowledge creates a new cultural configuration of exponential representativeness in the flow of information. In this environment, collaboration practices and remix typical which characterize it are ruled by a legislation established for a context prior to the development of the Web and an imbalance between what technology promotes and what is established by law as to intellectual work is created. Therefore, for the sake of knowledge production, it is essential to know not only what limits are set by the legislation but also to check the emerging alternatives that promote the information flow in the realms of collaborative Web according to standards established by the law. Thus, the study, characterized as a bibliographic and qualitative research with a direct non-participative observation approach, presents the dissertation based on bibliographical survey with review of theoretical and exploratory literature of aspects related to the collaborative Web (approached from the observation of blogs and wikis and the websites Flickr and YouTube) and to the legislation that rules copyright.
