Albania's counter-terrorism policy options: finding a strategy of common sense

Approved for public release, distribution is unlimited / This research will assess the counter-terrorism policy options available to Albanian authorities. As part of this investigation, it will consider the nature of the terrorism threat, review the counter-terrorism policies that have been pursued in the past, and weigh the strengths and weaknesses of the current policy. These elements will provide background for an analysis of the available policy models on the basis of four main criteria: 1) political feasibility; 2) legal and constitutional constraints; 3) foreign policy objectives and 4) effectiveness. The state policy options this study will analyze can be placed under four broad categories: a) deterrence through hard line measures including military operation and emergency powers; b) co-option and conciliation; c) pursuit of sanctuary or a passive policy; or d) deterrence via criminal justice. All these options might be plausibly implemented by Albania; indeed they have been used at different times in different countries. The working hypothesis of this investigation is that a policy based mainly on deterrence through criminal justice will be the most effective way to counter the internal threats that Albania faces while improving the countrys international standing. / Civilian, Ministry of Defense of Albania

Abstract Presented diploma thesis aims to answer a question whether the European Union can be perceived as a relevant actor of international security relations in the context of human rights protection and international security threat regulation. For the purpose of achieving the main goal of the thesis a definition of the EU actorness is used which presumes that the EU could be perceived as an actor of a policy provided it is being perceived as an actor acknowledged by other actors of international security and is able to influence their behavior at the same time. Both are proved by analysis of the antiterrorist sanction régimes, and more specifically a related the Court of Justice case Kadi. By means of the case, the EU pushed for institutional changes within the UN Security Council strengthening human rights protection. Within the EU, regarding the Member States, the EU can be perceived as actor if it succeeds in spread its own normative patterns among them. By the analysis of the Kadi case as well as of the Court's human rights doctrine development I try to prove that an EU institution (in this case the Court of Justice) succeeds in convincing the Member States that they should support the Court of Justice doctrine even though it might diminish their own power and influence. The Role of Perceived Collective Anger and Fear on Policy Support in Response to Terrorist Threat

The current research investigates how the perceived emotional responses of a majority of Americans to 9/11 (i.e., collective anger and fear) affect individuals’ support for governmental policies, in particular, military intervention, anti-immigration policy, and restricting civil liberties. Study 1 found that perceived collective anger was associated with support for military intervention and anti-immigration policy, and that those effects of perceived collective anger on policy support were significantly driven by individuals’ own anger. Study 2 showed that experimentally manipulated collective anger (i.e., exposure to the majority’s anger relative to the minority’s anger) had marginal effects on support for anti-immigration policy and restricting civil liberties, and individuals’ own anger mediated the marginal effect of collective anger on support for restricting civil liberties. Participants exposed to either the majority’s or minority’s fear supported anti-immigration policy and restricting civil liberties as strongly as did those exposed to the majority’s anger. Implications and limitations of these findings were discussed.

Terorizmus v Európskej únii. Ako boj proti terorizmu obmedzuje ľudské práva a slobody / Counter-terrorism policy in the EU and it's impact on human rights

Our thesis has aimed to show a relationship between certain aspects of EU counter-terrorism legislation and the impact it has on basic human rights. We have used the example of incommunicado detention laws in Spain to show that denying the detainees access to basic rights such as (and most importantly) access to legal counsel could lead to systematic abuse of human rights under the Articles 3, 5 or 6 of the European Convention on Human Rights (ECHR). We have shown that in the EU, where counter-terrorism mostly falls under criminal law, the only viable way to combat terrorism is to create exceptions in such law system with the aim of effectiveness. We have shown that these (such as incommunicado detention mentioned above) exceptions will pose threat to basic human rights. We have concluded that combined with mass pre-emptive surveillance and ability to stop and search at will (example of Article 44 in the UK), the Spanish example could lead to a legal system that could by systematically abused and used for suppressing others. We have concluded that on standalone basis, some EU states (notably Spain and the UK) have counter-terrorist laws that have high possibility of infringing upon basic human rights. However the real threat lies in the worst of them combining on the EU level.

Národní zájem? Analýza sekuritizační strategie české bezpečnostní politiky v rámci boje proti terorismu / National interest? Analysis of the securitization strategy of the Czech security policy in counterterrorism

The analysis of security policy, in its variations, regularly deals with the question of what each actor wants to promote in domestic or international politics, in other words, what is his interest. The term "national interest" is not an abstract category and a rhetorical turn legitimizing government action in front of the public audience or in dispute with political opposition. One of the aims of the presented thesis is to present the concept of national interest as a useful tool enabling closer research of domestic policy within the security context. Our main thematic focus, in which we examine the constitution of national interest, is the Czech counterterrorism policy in the context of the reaction of the Czech government and security forces to the terrorist attacks in Paris in autumn 2015 and in Brussels in March of the following year. An extraordinary measure after the attacks in Brussels in the form of the deployment of the Czech Army performing police tasks in mixed patrols in three Czech cities is for us a key manifestation of counterterrorism policy. This constitution of the security policy, we are further investigating. The thesis focuses on the relationship between the European Union and platform companies, and it tries to explore a debate about binding regulations regarding the moderation of illegal content online. The Regulation on preventing the dissemination of illegal terrorist content online from 2018 was applied as the case to test the arguments. The thesis applies the concept of platform governance triangle to analyse whether the Regulation has the potential to be effective. The research argues that the effectiveness of the Regulation depends on the actors competencies, the legitimation of the Regulation and how it was contested during the decision-making process, and finally on the power relations between actors and the tools to monitor and enforce the Regulation. The research shows that the EU has extensive competencies in areas of independence, representativeness and expertise due to the work of EU specialised agencies. Platform companies, on the other hand, possess unique technical competencies to moderate terrorist content online. Furthermore the specific design of the Regulation, and the fact that it was designed under the ordinary legislative procedure and was contested by various actors, suggest the Regulation is legitimate. The consequences of Israel's counter terrorism policy

The main focus of this thesis is to examine Israel's counter terrorism methods and their consequences and to debate the effectiveness of Israel's counter terrorism policy. By stimulating a debate on these issues it is possible to identify a more effective counter terrorism policy. In order to examine Israel's counter terrorism methods, their consequences and effectiveness, it is necessary to first explore the overall concepts of terrorism and counter terrorism. Then, because counter terrorism policy is hard to evaluate if one does not look at the context which surrounds it, this thesis will therefore explore some aspects of Israeli security history which has and continues to influence its counter terrorism policy. Furthermore, this thesis will provide an introduction to the general development of Palestinian resistance movements which will include a scrutiny of Hamas. This thesis has selected some of Israel's counter terrorism methods, and will be examining the width and depth of these methods as well as their consequences on the Palestinian society in general and on Hamas in particular. In seeking to answer the more general question about the effectiveness of Israel's counter terrorism policy the thesis will evaluate this aspect by relying on qualitative and quantitative indicators. This thesis will show that Israeli counter terrorism methods do reduce the capacity of Hamas and as such has prevented certain attacks or incapacitated Hamas' military wing for a limited time; they have, however, had a limited effect in the long run. It will be shown that these methods have consequences far beyond reducing the terrorist organisation capacity, which deepen the root causes for terrorism and increase the motivation to continue the resistance.

本論文以近年歐盟會員國境內之孤狼恐怖攻擊趨勢出發,分析歐盟因應孤狼恐怖主義威脅所制定之反恐政策,同時評估歐盟反恐政策之內外反恐成效,藉此檢視孤狼恐怖主義與歐盟反恐政策之因果關係。孤狼恐怖主義緣起於美國「無領袖反抗運動」與「暴力激進化」,並透過「全球伊斯蘭反抗運動」與「外國恐怖主義戰士」成為歐盟內部安全之威脅來源;而歐盟反恐政策之決策機構與執行機關,業已透過戰略方針與行動計畫等歐盟反恐法律文件,對內建立合作機制與輔助工具等內部反恐網絡,藉此強化歐盟與歐盟會員國之間的警察合作、司法合作、資訊與情報交換合作、以及邊境安全合作;對外則透過國際協定形式,與重要第三國以及國際組織建構外部反恐網絡,以雙邊與多邊反恐合作形式強化歐盟反恐能量。本論文亦以四起孤狼恐怖攻擊個案分析歐盟會員國層級之反恐措施,分析近年歐盟孤狼恐怖主義之現況與趨勢。 本論文發現,歐盟孤狼恐怖主義來自「聖戰恐怖主義」、「本土恐怖主義」、與「外國恐怖主義戰士」等三種威脅,而歐盟近年因應孤狼恐怖主義威脅之反恐政策與措施,已朝向2005年11月30日歐盟部長理事會《歐盟反恐政策》四大反恐戰略的「預防」層面發展,並以外國恐怖主義戰士為重要反恐目標;此外,歐盟除了著手打擊「激進化」與「暴力極端主義」等導致孤狼恐怖主義之根本原因原因外,亦持續因應敘利亞與伊拉克等衝突地區之「返國外國恐怖主義戰士」所帶來的後伊斯蘭國時代孤狼恐怖主義威脅。 / With the trend of lone-wolf terrorism in member states of the European Union, the thesis analyzes EU’s policy to counter threat from lone-wolf terrorism and also evaluates internal and external effectiveness of EU’s counter-terrorism policy, in an attempt to examine the correlation between lone-wolf terrorism and EU’s counter-terrorism policy. Lone-wolf terrorism originated in the United States from the “Leaderless Resistance” and “Violent Extremism” and further threatened EU’s internal security via “Global Islamic Resistance Movement” and “Foreign Terrorist Fighters.” The decision-making as well as the executing agencies of EU’s counter-terrorism policy has established mechanisms of cooperation and policy toolkits for internal counter-terrorism network by means of EU’s legal documents of counter-terrorism, strategic guidelines and implementing programs included, in order to consolidate cooperation of police, justice, exchange of communication and intelligence, as well as border security between EU and member states. Meanwhile, EU has also been constructing its external counter-terrorism network with bilateral and multilateral agreements with third states and international organizations of importance. The thesis also offers four case studies of lone-wolf terrorist attacks of EU’s member states to analyze conditions and trends of lone-wolf terrorism in EU. The thesis concludes that “Jihadist terrorism,” “Home-grown Terrorism,” and “Foreign Terrorist Fighters” are the three main types of threat of lone-wolf terrorism in EU, and that EU counter-terrorism policy has been developing strategy of “prevention”, one of which stated in “EU’s Counter-terrorism Strategies” of November 30th, 2005, by Council of the European Union, and considering foreign terrorist fighters as its main target. Additionally, EU has been countering not only root causes of lone-wolf terrorism, such as “radicalisation” and “violent extremism,” but also future threats from “Returning Foreign Terrorists Fighters” heading back home from Syria and Iraq in the Era of Post-Islamic State.
