Darbe yra nagrinėjama sporto ginčų sprendimo Tarptautiniame sporto arbitraže (CAS) procedūra bei visi su ja susiję klausimai. Pirmoje darbo dalyje yra analizuojama, kas yra sporto teisė bei kokie ginčai gali būti sprendžiami CAS. Tuo tarpu antrojoje – pagrindinėje darbo dalyje, nagrinėjami visi su ginčų sprendimu arbitraže susiję klausimai: arbitruotinumas bei arbitražinės išlygos, ginčo sprendimui taikytina materialinė bei procesinė teisė, arbitrai, ginčo nagrinėjimo arbitraže principai, ginčo nagrinėjimo vieta, kalba, terminai, dalyviai, laikinosios apsaugos priemonės, pati ginčo sprendimo procedūra, CAS priimtų sprendimų panaikinimas bei jų pripažinimas ir vykdymas. Taip pat, siekiant geriau atskleisti bei suprasti nagrinėjamą temą, darbo pradžioje yra pateikiama CAS istorija, bei ginčų sprendimo arbitraže privalumai ir trūkumai. O darbo pabaigoje labai trumpai aptariami ir kiti sporto ginčus sprendžiantys arbitražai bei svarstoma galimybė sporto arbitražą turėti ir Lietuvoje. / In this work the procedure of sport disputes resolution in Court of Arbitration for Sport (CAS) and other questions, connected to this subject are analyzed. In the first part of this work is examined the definition of sports law and sport disputes, which are able for procedures in CAS. Meanwhile the main, second, part of the work is devoted for all questions, connected with resolution of sport disputes in CAS. This includes: arbitrability, arbitration agreements, material and procedural law, which is applied for disputes’ resolution, arbitrators, principles, seat (place) of arbitration, its language, time limits, participants, provisional meausures, the procedure of resolution itself, challenging the awards of CAS and recognition and enforcement of CAS awards. In order to better explain the subject, there are parts of this work about history of CAS and advantages and disadvantages of arbitration. At the end of this work is shortly presented other arbitration bodies, which solve sport disputes. The is also discussed about the possibility to have arbitration body of sport disputes in Lithuania.

RESUMÉ Title of the thesis: "Dispute resolution with an international element within the area of sports law". The aim of the thesis is to outline the systém of the dispute resolution reflecting sport specifics, especially the autonomy of sport bodies. The autonomy allows sport federations to establish decision-making bodies deciding upon the rights and duties of their members. In the first chapter of the thesis I discuss the proceedings before the decision-making bodies of the international sport federations. These bodies decide especially on disciplinary matters. As appeal bodies they deal with challenged decisions of the lower organizational level authorities. They also exercise jurisdiction in all matters entrusted according to the statute or other regulations while applying especially regulations of the relevant sport federation. I discuss the compliance of the principle of the fair proceedings and the issue of the binding force of a decision. The decision of sport bodies can be challenged only after the exhaustion of the remedies within the relevant sport federation in the proceedings before an ordinary court or arbitral tribunal if an arbitral agreement have been concluded. First chapter deals generally about the term of alternative dispute resolution, reasons of its growing popularity particularly in the sporting sphere, its advantages and the perception of its use worldwide. The second chapter comprises a detailed analysis of now probably the most important institution in the field of alternative dispute resolution in sport, which is the Court of Arbitration for Sport (CAS) with its seat in Lausanne, Switzerland. Este trabalho tem por objetivo estudar a resolução de litígios no âmbito desportivo por meio das arbitragens realizadas pelo Tribunal Arbitral do Esporte (TAS-CAS), examinando-se a estrutura do referido órgão e determinados aspectos vinculados à sua atuação. Assim, procurou-se contextualizar a utilização do processo arbitral para a solução de controvérsias relacionadas à prática desportiva e a criação do Tribunal Arbitral do Esporte, para posteriormente identificar as principais particularidades de seus procedimentos, comparando-os com as disposições da Lei Modelo da UNCITRAL e das regras da Câmara de Comércio Internacional e da Associação Americana de Arbitragem, que também regulam arbitragens internacionais. No tocante à atuação do tribunal, abordou-se a existência de um corpo normativo especificamente relacionado ao desporto, denominado lex sportiva, cuja formação tem sido fortemente influenciada pelas decisões do TAS-CAS. Apresentaram-se, nesse contexto, alguns dos princípios que compõem a lex sportiva e que foram elaborados com a participação do tribunal. Within this context, it were presented some of the principles which compose lex sportiva and which have been developed with the participation of the tribunal. Finally, using the concepts provided by the Economic Analysis of Law, it was sought to identify factors that can increase or reduce the transaction costs in arbitration proceedings before the TAS-CAS, as from the rules which govern it, disposed in its Code of Sports-related Arbitration.

Institutional fight against doping in sport The diploma thesis with the title Institutional fight against doping in sport deals with the problematic issues of using banned substances and banned methods in sport or any other violation of anti-doping rule from the point of view of establishing international institutions with worldwide scope of activity with the aim of elimination of doping in sport. After the general introduction into the problematic issues of doping with the description of the historical roots of this unfair sporting practice there is a part focusing on the basic instruments of the fight against doping. A principle of strict liability of a sportsman for a violation of anti-doping rule is described, as well as the list of banned substances and banned methods, the process of testing, the therapeutic use exemption, the whereabouts and the athlete biological passport. In the following part the instruments of the public international law which were concluded by Council of Europe and UNESCO are analysed. The fight against doping in sport is transported through these international conventions on the level of intergovernmental cooperation which reflects the important non-governmental institutions and binds itself to international coordination.
