Critical theory, adult learning and a 'xenophobia': a critical perspective on Umoja wa Afrika's human rights peer education programme

<p>The impact of global migration on local contexts has spawned new issues and a range of social responses. These include the emergence of &lsquo / xenophobia&rsquo / in the terrain of discrimination and&nbsp / the subsequent development of popular educational responses to this. As part of popular educational responses, adult education programmes have assumed an important role in changing&nbsp / people&rsquo / s attitudes. This long research paper presents a critical analysis of how a human rights and counter-xenophobia peer educators&rsquo / programme enables young adults to develop a critical consciousness about human rights and &lsquo / xenophobia&rsquo / . The research focused on learning materials, course content, training methodology and processes of a three-day human rights and counter- xenophobia workshop held by Umoja wa Afrika, a local non-governmental organization, in March/April 2007 at Goedgedacht, just outside Cape Town. The research was based on qualitative&nbsp / methodology which included an exploration of relevant literature, interviews with participants and facilitators, as well as the researcher&rsquo / s critical reflections. The research was located within a&nbsp / critical theory framework in the field of adult&nbsp / learning, and drew from the work of Paulo Freire (1970) and Stephen Brookfield(2005).&nbsp / The key finding of the study is that the experience of the&nbsp / workshop enabled participants to develop a critical awareness - but not necessarily a critical understanding of human rights and &lsquo / xenophobia&rsquo / . The participants identified specific factors that&nbsp / contributed to such awareness. These included the diverse composition of participants, the &lsquo / accompanying&rsquo / facilitation style, and the interactive training methodology. This study makes a&nbsp / contribution to understanding human rights peer education in the South African context and the extent to which such provision could enable participants to develop a critical understanding of&nbsp / human rights and xenophobia. This study is an attempt to make an original contribution in this area. As such it adds to literature in applied critical methodology.&nbsp / </p>

For this, the first chapter sought to understand what human rights are, showing this concept and foundations based on the traditional theory and then presenting the vision of the critical theory of human rights. From that point on, it has been shown how the recognition was achieved and how has been happening the redetermination of the human right to adequate food and to the ecologically balanced environment. Next, the role of the Judiciary and its contribution to the effectiveness of human rights were discussed, analyzing some aspects of the Brazilian Judiciary's performance and characteristics. In the second chapter, it was demonstrated how the use of pesticides in agricultural production began in Brazil, trying to show how the Brazilian State, especially the governments of the military regime, played a fundamental role in the adoption of the precepts of the green revolution and the advancement of agribusiness in the country. From that point on, the concept of negative externalities was discussed, exposing how this phenomenon happens through the use of pesticides in agriculture, and demonstrating that it violates human rights to adequate food and to the ecologically balanced environment. Also, some forms of internalisation of negative externalities were pointed out, showing the idea of the contribution of the Judiciary in this process. Finally, in the third chapter, we analyzed the Judiciary's performance through the investigation of judgments of the Federal Supreme Court and Superior Court of Justice, seeking to identify the position of these Courts regarding negative externalities, the fight against the use of pesticides and the guarantee of human rights. / A presente dissertação teve como objetivo investigar se o Poder Judiciário brasileiro exerce o seu papel na garantia dos direitos humanos à alimentação adequada e ao meio ambiente ecologicamente equilibrado por meio da internalização das externalidades negativas decorrentes do uso de agrotóxicos. Para isso, no primeiro capítulo buscou-se compreender o que são os direitos humanos, mostrando seu conceito e fundamentos com base na teoria tradicional e, em seguida, apresentando a visão da teoria crítica dos direitos humanos. A partir daí, demonstrou-se como se deu o reconhecimento e como vem acontecendo a ressignificação dos direitos humanos à alimentação adequada e ao meio ambiente ecologicamente equilibrado. Em seguida, abordou-se o papel do Poder Judiciário e a sua contribuição para a efetividade de direitos humanos, analisando alguns aspectos da atuação e características do Judiciário brasileiro. No segundo capítulo, demonstrou-se como teve início a utilização dos agrotóxicos na produção agrícola do Brasil, procurando evidenciar como o Estado brasileiro, em especial os governos do regime militar, tiveram papel fundamental na adoção dos preceitos da revolução verde e avanço do agronegócio no país. A partir daí, tratou-se do conceito das externalidades negativas, expondo como esse fenômeno acontece a partir do emprego de agrotóxicos no campo, bem como demonstrando que viola os direitos humanos à alimentação adequada e ao meio ambiente ecologicamente equilibrado. Ainda, apontou-se algumas formas de internalização das externalidades negativas, trabalhando a ideia da contribuição do Poder Judiciário nesse processo. Por fim, no terceiro capítulo, passou-se a analisar a atuação do Poder Judiciário por meio da investigação de julgados do Supremo Tribunal Federal e Superior Tribunal de Justiça, buscando identificar a posição desses Tribunais quanto às externalidades negativas, o combate ao uso de agrotóxicos e a garantia de direitos humanos.

Para tanto, procura estabelecer um contraponto entre a tradicional teoria do Estado e a perspectiva oferecida pela teoria de Nicos Poulantzas, combinada à concepção crítica dos Direitos Humanos, segundo a qual a humanidade sempre desprezou algumas de suas parcelas, negando-as a fruição de tais direitos. Analisa-se o processo histórico de fundação e consolidação do banco e seu papel nas transformações vivenciadas pelo capitalismo brasileiro, bem como as principais formas de atuação da instituição na atualidade. Discute-se a política institucional do banco, seus mecanismos de governança e o fenômeno da captura, que pode se dar a partir da aproximação com o poder corporativo. Apresenta-se, ao final, um estudo de caso envolvendo o conflito proporcionado pela atuação de um empreendimento ligado diretamente ao BNDES e povos e comunidades tradicionais. / This paper aims to discuss how the tension between development and Human Rights marks the proceeding of an economic apparatus of the Brazilian State (BNDES). With this purpose, it seeks to establish a counterpoint between the traditional theory of the State and the perspective offered by the Nicos Poulantzas’ theory, combined with the critical conception of Human Rights, according to which humanity has always despised some of its parts, denying them the enjoyment of such Rights. It analyzes the historical process of foundation and consolidation of the bank and its role in the transformations experienced by Brazilian capitalism, as well as the main forms of proceeding of the institution in the present time. It discusses the bank's institutional policy, its governance mechanisms and the phenomenon of capture, which can occur from the approach with corporate power. At the end, a case study is presented, involving the conflict caused by an enterprise directly linked to the BNDES and traditional peoples and communities.
