As an initial step, it proves to be essential to examine the effectiveness of repression, characterize the contemporary slave labor, explaining the modern forms of slavery, its occurrence modes, the legally protected interests, especially dignity. Therefore, the main international instruments dealing with the issue were examined. The main rules were also studied the internal law, beginning with the Federal Constitution, stating, besides the characterization, the most important tools for combating slave labor. Passes to the qualitative and quantitative study of decisions handed down in actions to combat the repression of slave labor, such as public civil actions, both in the first and in the second instance and it is concluded that, in the first instance, the prosecution proves effective , which does not occur in the second instance, because it uses interpretations that restrict the range of incidence of contemporary slave labor. / O presente trabalho tem por objeto a an??lise de efic??cia da repress??o judicial do trabalho escravo contempor??neo. O exame de efic??cia restringe-se ?? seara trabalhista e ocorre por meio do estudo do conte??do das decis??es da Justi??a do Trabalho da 16?? Regi??o sobre o tema. Antes, por??m, faz-se necess??rio caracterizar adequadamente o trabalho escravo contempor??neo, explicitando as formas modernas de escravid??o, suas modalidades de ocorr??ncia, os bens jur??dicos tutelados, em especial a dignidade. Para tanto, foram examinados, al??m dos instrumentos internacionais que tratam do tema, as principais normas do Direito interno, a come??ar pela Constitui????o Federal, buscando ainda apresentar os mais relevantes instrumentos de combate ao trabalho escravo. Vencidas essas etapas, passa-se ?? an??lise das decis??es prolatadas em a????es de combate ?? repress??o ao trabalho escravo, como as a????es civis p??blicas, tanto na primeira quanto na segunda inst??ncia, e conclui-se que, na primeira inst??ncia, a repress??o revela-se eficaz, o que n??o ocorre na segunda inst??ncia, pois esta utiliza interpreta????es que restringem o espectro de incid??ncia do trabalho escravo contempor??neo.

In infraconstitutional legislation it was already present in the procedural documents of 1939 and 1973. However, the Code of Civil Procedure of 2015 sought to improve what is already provided for in constitutional and infraconstitutional legislation. The present study draws an analysis of art. 489, paragraph 1, of the Code of Civil Procedure of 2015, explaining what cannot be considered a reasoned decision. More specifically, subsection IV of the article, which provides for the obligation of the judge to face all the arguments brought by the party who, at least in theory, can contradict the conclusion adopted in the decision and, therefore, to base a position different from that of the judgmental. As the excessive volume of litigation that has weakened respect for the duty to state reasons has become more frequent among us, through decisions based on ready-made utterances of empty character. The idea of said device is to reinforce that the magistrate cannot choose the arguments of the succumbing party that wants to face. It ceases to be relevant in the process only what the magistrate arbitrarily believes to be worthy of consideration, and everything that could lead to a result different from that obtained has become important. The purpose of art. 489, paragraph 1, subsection IV, of the Code of Civil Procedure of 2015 is that if the decision does not analyze all the fundaments of the succumbing thesis, whether invoked by the author or defendant will be considered invalid for lack of reasoning. And the lack of reasoning goes against the constitutionally foreseen, thus facing the Democratic State of Law. / O dever de fundamenta??o das decis?es judiciais tem previs?o no art. 93, inciso IX, da Constitui??o da Rep?blica Federativa do Brasil de 1988. Em legisla??o infraconstitucional j? estava presente nos diplomas processuais de 1939 e 1973. Todavia, o C?digo de Processo Civil de 2015 buscou aprimorar o j? previsto na legisla??o constitucional e infraconstitucional. O presente estudo tra?a uma an?lise do art. 489, ? 1?, do C?digo de Processo Civil de 2015, explicitando o que n?o pode ser considerada uma decis?o fundamentada. Mais especificamente o inciso IV do referido artigo que disp?e acerca da obrigatoriedade do julgador de enfrentar todos os argumentos trazidos pela parte que, ao menos em tese, s?o capazes de contradizer a conclus?o adotada na decis?o e, por consequ?ncia, fundamentar posi??o diversa da exarada pelo julgador. A ideia do referido dispositivo ? refor?ar que o magistrado n?o pode escolher os argumentos da parte sucumbente que quer enfrentar. Deixa de ser relevante no processo apenas aquilo que o magistrado arbitrariamente acredita ser digno de considera??o, e passa a ser importante tudo o que poderia levar a um resultado diferente daquele que foi obtido. O objetivo do art. 489, ? 1?, inciso IV, do C?digo de Processo Civil de 2015 ? de que se a decis?o n?o analisa todos os fundamentos da tese sucumbente, seja invocada pelo autor ou r?u, ser? considerada inv?lida por aus?ncia de fundamenta??o. E a falta de fundamenta??o vai de encontro ao previsto constitucionalmente, afrontando, dessa forma, o Estado Democr?tico de Direito.

Os cidad?os que n?o encontram nas redes de aten??o resposta para suas necessidades de a??es e servi?os de sa?de buscam, atrav?s da interven??o do Poder Judici?rio, a solu??o para o seu problema, o que tem resultado em fen?meno denominado de ?Judicializa??o da Sa?de?. Paralelo a esse fen?meno outra situa??o se confirmou: as dificuldades pr?prias do sistema de justi?a em lidar com os direitos sociais. O modelo de justi?a apresenta-se incompat?vel com a natureza de urg?ncia que envolve as a??es judiciais em sa?de, desafiando a criatividade dos operadores do direito, profissionais de sa?de e gestores na busca de solu??es alternativas para lidar com a complexidade do tema. Esta pesquisa teve o objetivo de analisar a tecnologia social da media??o aplicada ao fen?meno da judicializa??o da sa?de como solu??o extrajudicial de conflitos, a partir da experi?ncia do Programa SUS MEDIADO NATAL. A pesquisa, de abordagem qualitativa, realizou an?lise documental dos registros do Programa e entrevistas com atores envolvidos no mesmo - operadores do Direito, representantes da Magistratura, t?cnicos colaboradores do Programa e gestores do SUS, das esferas municipal e estadual. O per?odo do estudo incluiu os anos de 2012 a 2014. Foi realizado um perfil da demanda e encaminhamentos realizados, no per?odo estudado, em rela??o aos quantitativos de atendimentos, acordos, a??es propostas pela DPE, encaminhamentos de a??es ? DPU, ?ndice de resolutividade e ?ndice de demandas n?o ajuizadas contra estado e munic?pio, e percep??es sobre as pr?ticas vivenciadas pelos atores envolvidos. Os resultados demonstraram que as percep??es dos atores ligados ao Direito e ? Sa?de s?o contradit?rias quanto ao fen?meno da judicializa??o da sa?de, entre aspectos negativos e positivos. No que se refere ? cria??o e desenvolvimento do Programa SUS MEDIADO em Natal houve consenso de que o mesmo ajudou a concretizar o direito ? sa?de. Quanto ? media??o foram identificadas vis?es semelhantes considerando que ? uma ferramenta adequada para se lidar com a judicializa??o, pois reduz o n?mero de a??es propostas no Judici?rio, direciona melhor as compet?ncias aos entes federativos, enquanto busca a solu??o administrativa dos casos. Foi observado que os problemas que permeiam a media??o s?o praticamente os mesmos identificados no funcionamento do Sistema de Sa?de: insufici?ncia de ofertas, dificuldade do acesso a novas tecnologias, d?ficit e necessidade de uma melhor capacita??o de recursos humanos, dificuldades na organiza??o dos processos de trabalho. Conclui-se que para essas quest?es nem a judicializa??o nem a media??o se apresentar?o como resposta resolutiva. Considera-se, por fim, o potencial educativo da media??o como importante contribui??o do Programa, na medida em o di?logo sobre as quest?es do sistema de sa?de permitem uma orienta??o ao usu?rio e, ao mesmo tempo, divulga positivamente o SUS junto ao cidad?o, reconciliando-o com o sistema de sa?de. Essa comunica??o ? cara ao SUS e poder? contribuir, simultaneamente, na otimiza??o da Justi?a e da Gest?o da Sa?de, e em avan?os na cidadania e na efetiva??o de direitos sociais. / In Brazil of the twenty-first century, twenty seven years after the promulgation of the Constitution, the achievement of fundamental social rights it is challenging, where par excellence, is the right to health. The growing demand of citizens to full health care promised by the Constitution of 1988, highlighted by the difficulties between the constitutional promised and the political, administrative and financial capacity of the Brazilian State to fulfill it. Citizens who do not find the answer to your attention needs actions and health services networks seek, through the judiciary intervention, the solution to your problem, which has resulted in a phenomenon called "Legalization of Health." Parallel to this phenomenon other situation was confirmed: the difficulties of the justice system in dealing with social rights. The model of justice shows to be incompatible with the urgent nature involving lawsuits in Health, challenging the creativity of legal professionals, health professionals and managers in the search for alternative solutions to deal with the complexity of the issue. This research aimed to analyze the social technology of mediation applied to the phenomenon of legalization of health as an extrajudicial settlement of conflicts, from the experience of SUS MEDIATED NATAL Program. The research, in its qualitative approach, accomplished documentary analysis of the Program records and interviews with people involved in the same - Law operators, representatives of the Magistracy, technical colaborators and SUS program managers, the municipal and state sphere. The study period included the years 2012 to 2014. This was a profile and referrals made during the period studied, in relation to quantitative consultations, agreements, actions proposed by the DPE, referrals actions to DPU, resoluteness index and demands index not filed against state and county, and perceptions about the practices experienced by the people involved. The results showed that the perceptions of people linked to the field of Law and Health are contradictory as to the legalization of health phenomenon, between negative and positive aspects. In regards to the creation and development of the program SUS MEDIATED NATAL, there was a consensus that it helped to realize the rights to health. As far as the mediation, similar views were identified considering that it is an appropriate tool to deal with the legalization, because it reduces the number of actions proposed in the Judiciary, directs better the competence of the federative while searching the administrative resolution of the cases. It was noted that the problems that pervade the mediation are much the same identified in the operation of the Health System: insufficient offers, difficulty of access to new technologies, deficit and need for better training of human resources, difficulties in the organization of work processes. It is concluded that for these issues neither the legalization nor mediation will provide a resolute response. It is considered, finally, the educational potential of mediation as an important contribution of the Program, as the dialogue on the health system issues allow the user orientation and at the same time, positively discloses SUS to the citizen, reconciling it with the health system. This communication is expensive to SUS and can contribute simultaneously to the optimization of Justice and Health Management, and advances in citizenship and the affecteviness of social rights.

The discussed problematic it?s about the influence of judicial decisions wich compels the enrollment of kids from 0(zero) to 3(three) years old and the quality of childs education offered in those institutions because of overcrowded day care centers due to those decisions. The education it?s a fundamental subjective right, fundamental cause it?s a right inherent to the human being, subjective because it must be effective, there?s no room for discretion, the public power can?t decide if it?s going to offer education or not, it simply have to. The present paper?s goal is to analyse the envolved subjectives produced senses for the colocation of children in city?s day care centers, especial in the city of Campinas/SP, due to judicial decisions. The importance of offering a quallity child?s education justifies the present search?s importance, cause it means to propiciate the subjects reflexion in the way to improve the quallity of child?s education offered in day cares. For the present researche?s achiviement were used as tools the search off data related to the amount off judicial decisions determinating the registration of children in day cares in the city of Campinas/SP in the past years, semi structured interviews with the following subjects: day care professionals (teacher and director), day care pupil?s father, youth and education prosecutor in Campinas County and the youth judge in Campinas County; beyond those interviews it was made a visit in loco in one of municipal day care centers of Campinas/SP, to evaluate the center?s phisycal structure. In the making of research?s relyzation it was possible to observe that judicial decisions determinating kid?s enrollment in Campinas/SP day cares grew in the past years, however, the youth judge keeps determinating the children?s registration in day care centers, for the child?s education it?s a children?s right, and due to it the day care?s become over crowded. In an over crowded enviroment the professional work conditions and the quality of child?s education offered to kids from 0(zero) to 3(three) years old become compromised. / A presente pesquisa trata da rela??o das decis?es judiciais, que determinam as matr?culas das crian?as nas creches, e o ensino oferecido nestas institui??es. A problem?tica discutida ? a influ?ncia das decis?es judiciais que obrigam as matr?culas as crian?as de zero a tr?s anos nas creches e a qualidade da educa??o infantil oferecida nestas institui??es em raz?o da superlota??o gerada por essas decis?es. A educa??o ? um direito fundamental subjetivo; fundamental porque ? um direito inerente ao ser humano, subjetivo porque ele tem que ser efetivado, n?o h? margem para discricionariedade, o Poder P?blico n?o pode decidir se vai ou n?o oferecer a educa??o, ele simplesmente tem que oferecer. O presente estudo tem como objetivo analisar os sentidos produzidos pelos sujeitos envolvidos na coloca??o das crian?as nas creches municipais, especialmente no munic?pio de Campinas/SP, em raz?o das decis?es judiciais. A import?ncia do oferecimento de uma educa??o infantil de qualidade justifica a relev?ncia da presente pesquisa, pois ela pretende propiciar a reflex?o dos sujeitos no que se refere ? necessidade de uma melhoria na qualidade da educa??o infantil oferecida nas creches. Para a possibilidade da realiza??o da presente pesquisa foram utilizados como instrumentos busca de dados relativos ? quantidade de decis?es judiciais determinando as matr?culas das crian?as em creches no munic?pio de Campinas/SP nos ?ltimos anos, entrevistas semiestruturadas com profissionais de creche (diretor e professor), pai de aluno de creche, Promotor de Justi?a atuante perante a Vara da Inf?ncia e da Juventude ? Educa??o da Comarca de Campinas/SP e Juiz da Vara da Inf?ncia e da Juventude da Comarca de Campinas/SP; al?m das entrevistas, foi realizada visita in loco em uma das creches municipais de Campinas/SP para avaliarmos a estrutura f?sica do local. No curso da realiza??o da pesquisa foi poss?vel observar que o n?mero de decis?es judiciais determinando as matr?culas das crian?as em creches do munic?pio aumentou nos ?ltimos anos, no entanto, o Juiz da Vara da Inf?ncia e Juventude determina as matr?culas das crian?as, pois a educa??o infantil ? um direito da crian?a, e isso gera uma superlota??o nessas institui??es educacionais. Em um ambiente superlotado as condi??es de trabalho dos profissionais e a qualidade da educa??o infantil oferecida ?s crian?as de zero a tr?s anos ficam comprometidas.
