Esse fenômeno de judicialização da vida pública tem ocorrido no Brasil, sobejamente após a promulgação da Constituição Federal de 1988. Os atores do sistema de justiça passaram a exercer importante influência sobre a vida social, econômica e política do país, atuando na afirmação de novos direitos e na construção da agenda pública. À luz deste contexto a presente dissertação analisa a judicialização da política na realidade político-institucional brasileira, delimitando, todavia, o seu campo de estudo à atuação das unidades da Defensoria Pública da União nos Estados que integram a Amazônia Legal em conflitos de natureza coletiva, buscando compreender fundamentalmente as formas judiciais e extrajudiciais de resolução de conflitos, os critérios de atuação da instituição neste tipo de controvérsias, bem como os resultados das ações e relações com o judiciário. A ideia central é a de que os mecanismos que proporcionam inclusão no sistema de justiça podem desempenhar um papel importante na afirmação de direitos e na construção da agenda pública. / The bodies of the Justice System around the world have taken important places in the institutional-political scene, acting like real political agents entitled with Power resources. That phenomenon of judicialization of public life has occurred in Brazil, specially after the promulgation of the 1988 Constitution. The parties of the Justice System started to have major influence upon the social, economical and political context of the country, working on the enforcement of new rights and the shaping of public agenda. In view of such context, this dissertation analyzes the judicialization of politics in the Brazilian political-institutional circumstances, delimiting, however, its scope to working into the Federal District Attorneys in the Stated that compose the Legal Amazon on conflicts of a group nature, seeking to understand, fundamentally, the judicial and extrajudicial ways to mediate conflicts, the criteria for the institution actions over this type of controversies, as well as the outcome of those actions and relations with the Justice System. The central idea is that the mechanisms which favor inclusion in the justice system can play a major role in the enforcement of rights and the shaping of public agenda.

No primeiro capítulo apresentamos nossa reflexão, fundamentada na teoria lukacsiana, a respeito do complexo social do Direito. Bem como sua expressão jurídico-normativa nas constituições brasileiras, com ênfase na Constituição Federal de 1988, que estabelece as Defensorias Públicas. No capítulo seguinte retratamos a Defensoria Pública da União compreendo-a em sua inserção no campo sociojurídico. Nesse sentido, através da bibliografia contemporânea, expomos sinteticamente o debate acadêmico a respeito desse campo, o qual dialoga diretamente com o Projeto Ético-político do Serviço Social brasileiro e com a intervenção profissional. Por fim, nos dois últimos capítulos, pontuamos a particularidade da intervenção profissional na Defensoria Pública da União, por meio da sistematização e análise dos dados coletados através de pesquisa empírica com os assistentes sociais que atuam nesse espaço sócio-ocupacional no Brasil, contemplando todas as regiões da federação. Em resposta, identificamos elementos que apontam para o caráter contraditório desse espaço que se caracteriza pela defesa de direitos ao passo que é permeado por todos os limites inerentes a atual ordem societária. Essa é a conjuntura na qual os assistentes sociais se inserem, com o desafio de desenvolver um trabalho cotidiano que vá ao encontro do compromisso ético-político da profissão, cujo Projeto Profissional desvela um norte progressista e democrático conflitante com as diretrizes impostas pelo capitalismo. / This dissertation approaches Social Services in Public Defender Union, comprehending this socio-occupational space as a mediation that is related to the complex of rights. In the first chapter, we present our reflection on the social complex of right, based on the lukacsian theory, as well as its legal-normative expression in the Brazilian Constitution, with emphasis on the Federal Constitution of 1988, which establishes Public Defenders. In the following chapter, we portray the Public Defender and comprehend its inclusion in the socio-legal field. Therefore, through the contemporary bibliography, we synthetically expose the academic debate about this field that converses directly with the ethical-political project of Brazilian Social Services and also with the professional intervention. Finally, in the last two chapters, we highlight the peculiarity of professional intervention in Public Defender Union, through the systemization and analysis of data collected, through empirical research with the social workers who act, in Brazil, in the socio-occupational space that includes all regions of the federations. In response, we identify elements that point to the contradictory character of this space that is characterized by rights of defense while it is permeated by all the inherent limits in current social order. These are the circumstances in which the social workers are find themselves and they are challenged to develop a daily work that meets the commitment of Ethical-Political Project of profession that reveals a progressive and democratic north that conflicts with the guidelines imposed by capitalism.
