This dissertation is the result of pedagogical experience on child with cerebral palsy, not allowed to attend a regular school because of health problems, opening a new path not already taken. At this point, on this dissertation, I have as a goal to analyze the process of appliance of this kind of care, pointing out the paths taken on the process of child scholarship. From this perspective, I report the implication of different sectors of society, searching for an efficient and successful educational care for everyone in need. On this opportunity, we bring up legal and pedagogical aspects, examining official documents which directs this unique experience, pointing out the implementation of educational law for everyone, on municipal department of education. Basing this research on educational care, which emerges from intentions to offer a good quality scholarship for this new demand, purposing a human care for every person involved, I use as reference, authors such as Sacristán, Rousseau, Tomaz Tadeu da Silva, Paulo Freire and so on / O presente trabalho traz uma reflexão acerca da experiência pioneira do atendimento pedagógico domiciliar no município de Feira de Santana, no sertão da Bahia, e os entraves para a consolidação deste, dentro da perspectiva da Educação Especial. Esta dissertação que é fruto da experiência pedagógica no atendimento à uma criança com paralisia cerebral, impossibilitada de frequentar a escola por problemas de saúde, abre uma trilha que até então não tinha sido percorrida. Assim, nesta dissertação, tenho como objetivo analisar o processo de implantação deste atendimento, ressaltando os caminhos trilhados no processo de escolarização da criança. Nesta perspectiva, relato o envolvimento entre diferentes setores, em busca de um atendimento eficiente e exitoso para todos que dele necessitem. Na oportunidade, abordaremos os aspectos legais e pedagógicos, visitando os documentos oficiais que direcionam esta experiência ímpar, ressaltando o cumprimento da lei de educação para todos, pelo sistema de municipal de educação. Referendando a pesquisa desse atendimento, que surge com pretensões de oferecer um ensino público de qualidade a esta nova demanda, propondo a humanização de todos os sujeitos envolvidos, utilizo como referencial, autores como Sacristán, Rousseau, Tomaz Tadeu da Silva, Paulo Freire e outros

Uma das alterações mais marcantes, no que diz respeito à seleção do profissional moderno é a exigência daquele apto ou talentoso para desempenhar diferentes funções, tornando mais limitante a atuação de pessoas com deficiências em um trabalho produtivo. A presente pesquisa centraliza-se no estudo de algumas características relacionadas à participação de pessoas com deficiências físicas e mentais no mercado laboral, em municípios do interior do Estado de São Paulo. Dessa forma, o objetivo dessa investigação é conhecer os aspectos envolvidos no processo de enfrentamento dessas pessoas no mundo do trabalho, analisando, por meios de seus relatos orais, expectativas e perspectivas em relação a ele. Foi utilizado o instrumento da entrevista semi-estruturada para coleta de informações, permitindo a análise qualitativa de conteúdo, ou seja, do objeto de estudo. Como resultado e conclusão dessa análise, considera-se que a sociedade, de maneira geral, deveria, se 'reabilitar' para conhecer, aceitar e permitir conscientemente o acesso da pessoa com deficiência no mercado de trabalho, analisando os recursos disponíveis da comunidade ou do meio social mais viáveis, juntamente com as forças do poder político social, público e privado, e, assim, auxiliando a remoção de preconceitos e dificuldades, e facilitando a inclusão social desses sujeitos possuidores de limitações superáveis, de talentos e capacidades para um trabalho produtivo. / Nowadays, the business world has suffered some changes that, together with the global social-economic factors, result in a worldwide crisis related to the employment supply. One of the more remarkable changes, in regarding the choice of the modern professional, is the demand of those who are capable or clever to perform different duties, becoming more limitating the performance of the people with a lack in a productive work. The recent research focuses on a study of some characteristics related to the participation of people with physical and mental deficiency in the laboral market, in some cities of the state of São Paulo. In this way, the aim of this investigation is to know the aspects involved in the process of confront of these people, in the business world, studying by ways of their oral reports, expectations and prospects regarding it. It was used the instrument of interview semi structured to the assessment of information collection, allowing the qualitative analysis of contents, so, the conclusion of this analysis, it is considered that the society, this way, should 'reestablish' themselves to know, accept and allow consciously, the promotion of the people with deficiency in the business market, analyzing the available resorts of the community or the social ways more practicable, together with the forces of the social political power, public and private, and this way, helping the removal of prejudice and difficulties, and making easier, owners of restrictions that can be beaten, of aptitudes and abilities, to do a productive work.

This legislative intervention, originated from the mandatory content of the International Convention on the Rights of Persons with Disabilities, has confirmed the fundamental rights of persons with disabilities, with the purpose of their emancipation and social inclusion. However, as will be seen further on, the partial repeal of Articles 3 and 4 of the Civil Code of 2002, has generated profound changes in the ratio of the disability theory, so that the present analysis of its reflexes in the legal spectrum is of substantial importance, especially regarding the practice of contracts / O presente trabalho tem por objetivo discorrer sobre alguns reflexos patrimoniais projetados no ordenamento jurídico a partir da promulgação da Lei Federal n. 13.146, de 5 de julho de 2015, denominada Lei Brasileira de Inclusão da Pessoa com Deficiência (Estatuto da Pessoa com Deficiência). Essa intervenção legislativa, originada do conteúdo principiológico obrigatório da Convenção Internacional sobre os Direitos das Pessoas com Deficiência, veio confirmar os direitos fundamentais da pessoa com deficiência, com vistas a sua emancipação e inclusão social. Contudo, conforme se verá, a revogação, em parte, dos artigos 3º e 4º do Código Civil de 2002, gerou profundas alterações na ratio da teoria das incapacidades, de modo que se faz premente a análise de alguns reflexos decorrentes desta alteração no espectro jurídico, especialmente no tocante à prática de negócio jurídico patrimonial

From the premise that this social function is effective with the enjoyment of full citizenship - which is embodied in the right to work, under the mantle of the human dignity of persons and with equal opportunities, without distinction between disabled people and other people in society - a bibliographic, legislative analysis and jurisprudence, on the subject. The legal protection of the work of disabled people is observed, considering the legislation inserted in the context of the constitutional order, the International Convention on the Rights of Persons with Disabilities and the Persons with Disabilities Statute. The control instruments used by the State are then focused on the verification of compliance with quotas, as defined in the specific regulations, leading to a reflection on the annulment of the infraction notices drawn up, as well as on decisions rendered in degree of appeal by the Superior Labor Court, combining the effects of these instruments and decisions with statistical data presented by state bodies to infer the possibility of changes in the legal command of the quota system aiming at the effectiveness of its social function / A reserva legal instituída pelo artigo 93 da Lei 8.213/91, se impõe como ação afirmativa, em manifesta discriminação positiva cogente, vetor para a efetividade da igualdade material prevista na Constituição Federal de 1988. A partir da premissa de que essa função social se efetiva com a fruição da cidadania plena – que é consubstanciada no direito ao trabalho, sob o manto da dignidade da pessoa humana e com igualdade de oportunidades, sem distinção entre as pessoas com deficiência e as demais pessoas da sociedade – faz-se uma análise bibliográfica, legislativa e jurisprudencial acerca da temática. Observa-se a proteção legal ao trabalho das pessoas com deficiência, considerando a legislação inserida no contexto da ordem constitucional, da Convenção Internacional dos Direitos das Pessoas com Deficiência e do Estatuto da Pessoa com Deficiência. Enfoca-se, em seguida, os instrumentos de fiscalização e controle utilizados pelo Estado para a verificação do cumprimento das quotas, definidos na normatização específica, conduzindo à reflexão sobre a ação anulatória dos autos de infração lavrados, bem como sobre as decisões prolatadas em grau de recurso pelo Tribunal Superior do Trabalho, conjugando os efeitos desses instrumentos e decisões com dados estatísticos apresentados por organismos estatais para inferir quanto a possibilidade de alterações no comando legal do sistema de quotas, almejando a efetividade de sua função social

The topic is relevant once the number of students with special needs in regular schools has increased and there is now mandatory inclusion of these students in the education system. To investigate this issue, this qualitative research, of interpretative nature, analyses four semi structured interviews conducted with teachers and managers of two public schools and two private schools in São Paulo (SP). Based on this data, the information was organized according to its theme. The defined categories are around four axis: the relationship between the school, the family and the healthcare professionals of the autistic child; the teachers' preparedness; the learning process; the socialization of the students; the ways ASD interferes in the process of inclusion. The discussion of the data is established according to theoretical foundation, which debates over the different interpretations of the concept of inclusion and over Vygotsky's definitions of learning and development. After the analysis, it is concluded that the interviewees worried about the admission of students with autism, though the permanence of the students in school is still a challenge. The teachers show an emotional response facing the duty of modifying the classes and their tasks and they fear the autistic students' behavior in the classroom. These teachers seem to experience a personal failure when they don't see positive changes in the students and feel proud when notice some sort of achievement. As far as the comprehension of the concept of inclusion is concerned, this essay reveals that there are divergences between the real objectives of receiving na autistic student in class. It is common for the school to focus on socialization only, without showing the same diligence when it comes to the child's learning process / Esta pesquisa tem como objetivo discutir qual a visão das escolas sobre a inclusão de crianças que têm o Transtorno do Espectro Autista (TEA). O assunto mostra-se relevante diante do crescente número de alunos com deficiência nas escolas comuns e na obrigatoriedade da inclusão deles na educação. Para investigar a questão, esta pesquisa qualitativa, de cunho interpretativista, analisa quatro entrevistas semiestruturadas realizadas com professores e gestores de duas escolas públicas e de duas particulares da cidade de São Paulo (SP). A partir desta coleta de dados, as informações foram organizadas segundo o conteúdo temático. As categorias definidas circundam quatro eixos: a relação da escola com os familiares e os profissionais de saúde da criança com autismo, o preparo dos docentes, o aprendizado e a socialização dos alunos e as formas de interferência do TEA no processo de inclusão. A discussão dos dados é estabelecida segundo a fundamentação teórica, que versa sobre as diferentes interpretações do conceito de inclusão e sobre as definições de aprendizagem e desenvolvimento de Vygotsky. Após a análise, conclui-se que os entrevistados demonstraram preocupação com o ingresso dos alunos com autismo, mas a permanência destes estudantes no colégio ainda é um desafio. Os docentes mostram uma sobrecarga emocional diante do dever de modificar as aulas e as tarefas da turma e revelam sentir medo do comportamento dos alunos autistas. Eles parecem experimentar um fracasso pessoal quando não veem mudanças positivas nos estudantes – e sentem orgulho quando notam algum tipo de conquista.
