En comparación con otros instrumentos ambientales, la Evaluación Ambiental Estratégica ha tenido un incipiente desarrollo en el Perú, Por ello considero que el poco abordaje en la teoría y práctica nacional es un punto para reflexionar. La Evaluación Ambiental Estratégica se empieza a desarrollar en el Perú incluso antes de la que normativa nacional lo recogiera de manera clara. Esto generó un camino poco despejado para llevar a cabo su desarrollo, lo que finalmente influyó en la percepción de este instrumento. Aunado a lo señalado, el Ministerio del Ambiente como ente rector nacional acababa de ser creado cuando la normativa empezaba a abordar de manera tímida la Evaluación Ambiental Estratégica. Este contexto de poca claridad normativa y falta de fortaleza institucional marcaron el camino para que, aún hoy, la Evaluación Ambiental Estratégica no se haya desarrollado como debió. / Compared to other environmental instruments, the Strategic Environmental Assessment has had an incipient development in Peru. Therefore, I consider that the lack of coverage in national theory and practice is a point to reflect on. The Strategic Environmental Assessment began to be developed in Peru even before national regulations clearly included it. This meant that the disorder and the unclear path to carry out its development influenced the perception of this instrument. In addition to the above, the Ministry of the Environment as the national governing body had just been created when the regulations began to timidly address the Strategic Environmental Assessment. This context of lack of regulatory clarity and lack of institutional strength paved the way for the Strategic Environmental Assessment to have not been developed as it should have, even today. / Trabajo académico

El proyecto de innovación busca aportar al fortalecimiento de la articulación entre el Organismo de Evaluación y Fiscalización Ambiental – OEFA y las Fiscalías Especializadas en Materia Ambiental - FEMA, reforzando sus capacidades y potenciando su intervención en la lucha contra los delitos ambientales, con la finalidad de que los ciudadanos vean realizados sus derechos de acceso a la justicia y a contar con un ambiente sano. Inicialmente se analiza las dificultades presentes en las investigaciones penales que generan un reducido número de sentencias. Ello permitió establecer la importancia de la participación del OEFA con los Informes Fundamentados y las causas de su posible ineficacia: contenido insuficiente previsto legalmente, naturaleza jurídica asignada, deficiente articulación entre entidades y falta de comprensión del contenido. Realizada la jerarquización, se eligió la deficiente articulación como causa principal, reformulando el problema público, planteándose el siguiente desafío de innovación: “¿Cómo se puede fortalecer la articulación entre el OEFA y las FEMA en las investigaciones penales por delitos ambientales para lograr que estas entidades mejoren su comunicación e identifiquen un objetivo común, agilizando la atención de requerimientos y reduciendo el exceso de burocracia?”. Luego de la formulación y priorización de ideas surgió un concepto inicial que decantó en la solución: “Programa colaborativo para el fortalecimiento de la articulación entre el OEFA y las FEMA en la lucha contra los delitos ambientales”. El prototipo comprende el desarrollo de actividades de sensibilización y acciones de articulación mediante la implementación de un portal colaborativo. Presentado el prototipo a diversos especialistas en la materia y realizado el testeo, se verificó que la solución propuesta cumple con criterios mínimos de deseabilidad, factibilidad y viabilidad, pudiendo aportar valor público a la ciudadanía al incidir en una mayor protección de su derecho a un ambiente sano. / The innovation project seeks to contribute to the strengthening of the articulation between the Environmental Evaluation and Supervision Agency – OEFA and the Prosecutors Office specialized in Environmental Matters – FEMA, reinforcing their capacities and enhancing their intervention against environmental crimes, with the purpose that citizens fulfill their rights of access to justice and to a healthy environment. Initially, it analyzes the difficulties present in criminal investigations that generate a reduced number of sentences. This establishes the importance of OEFA's participation with the Substantiated Reports and the causes of their possible ineffectiveness: insufficient legally provided content, assigned legal nature, poor articulation between entities and lack of understanding of the content. Once the hierarchy was made, poor articulation was chosen as the main cause, reformulating the public problem, posing the following innovation challenge: “How can the articulation between OEFA and FEMA be strengthened in environmental crimes criminal investigations to ensure that these entities improve their communication and identify a common objective, streamlining the attention to requirements and reducing excess bureaucracy?” After the formulation and prioritization of ideas, an initial concept emerged that led to the solution: “Collaborative program to strengthen the coordination between OEFA and FEMA in the fight against environmental crimes”. The prototype includes the development of awareness-raising activities and articulation actions through the implementation of a collaborative portal. After presenting the prototype to various specialists in the field and carrying out testing, it was verified that the proposed solution meets minimum criteria of desirability, feasibility and viability, being able to provide public value to citizens by influencing greater protection of their right to a healthy environment.
