Considered a major tourist destination in Brazil, with a lush and economically viable tourism, the city has not given due importance to municipal solid waste as the final disposal site is inadequate, with a very vulnerable physical environment, shallow water table and a rocky substrate with structural flaws. Faced with this situation it`s been tried to see which instruments would be adopted to prevent and - or minimize the risks and hazards arising from the final disposal site of municipal solid waste in Caldas Novas. At that pace, it sought to identify the risks from this activity and the actions of government agencies involved with this issue.Thus, the search begins with the notion of risk, to focus on the issue of risk society, built by Ulrich Beck, emphasizing the role played by the social risks from the "first modernity" to "reflexive modernity". The study sought to draw a connecting line between the risk and the Environment and the Law, mentioning the statutes of national and international levels, applied to this environmental issue. In this context, it`s been analyzed the role of criminal law in this new society, and particularly the expansive nature of criminal law as a tool to contain social risks, on the basis of Offenses of Abstract Danger. The technical research of this study has been guided in literature, analysis of documentary texts and visit of the site of final disposal of solid waste of Caldas Novas. As a result obtained from research, it was observed that the landfill Caldas Novas is actually a (dump) in the open, generating imminent risks to the environment. / Essa pesquisa tem por finalidade estudar a realidade do local de disposição final dos resíduos sólidos urbanos de Caldas Novas - GO, considerando o meio ambiente da região e os riscos ambientais decorrentes dessa atividade. Considerada um importante destino turístico no Brasil, diante de um turismo exuberante e economicamente viável, a cidade não tem dado a devida importância aos resíduos sólidos urbanos, pois o local de disposição final é inadequado, com um meio físico muito vulnerável, lençol freático pouco profundo e um substrato rochoso com falhas estruturais. Diante dessa situação procurou-se verificar quais os instrumentos a serem adotados para prevenir e-ou minimizar os riscos e perigos advindos do local de disposição final dos resíduos sólidos urbanos em Caldas Novas. Nessa cadência, buscou-se identificar os riscos oriundos dessa atividade e a atuação dos órgãos públicos envolvidos com essa questão. Assim, a pesquisa se inicia com a noção de risco, para centrar na questão da sociedade de risco, construída por Ulrich Beck, enfatizando o papel desempenhado pelos riscos sociais desde a primeira modernidade até a modernidade reflexiva . O trabalho buscou traçar uma linha de conexão entre o Risco e Meio Ambiente e o Direito, mencionando os diplomas legais de âmbito nacional e internacional, aplicados a essa questão ambiental. Nesse contexto, analisa-se a função do Direito Penal nessa nova sociedade, e particularmente, o caráter expansivo do Direito Penal como instrumento de contenção de riscos sociais, com fundamento nos Delitos de Perigo Abstrato. As técnicas de pesquisa do presente trabalho foram pautadas em pesquisa bibliográfica, análise de textos documentais e visita ao local de disposição final dos resíduos sólidos de Caldas Novas. Como resultado obtido a partir de pesquisas, observou-se que o aterro sanitário de Caldas Novas é, na realidade, um (lixão) a céu aberto, gerando riscos iminentes ao meio ambiente.
