The work is theoretically grounded in the fields of Law, especially Family Law, and French Discourse Analysis, as formulated by Michel Pêcheux. It is a look into the functioning of a discourse which has determined the breakthrough of a new practice, of a new perspective of social coexistence, in the light of Law, between and with people with a homoaffective sexual orientation. The development of the concept of discursive memory, as well as the peculiar way the decision works as a discursive event, make it possible to catch a glimpse of new memory network around homoaffectivity. The theme of the present study – the affective relationship between people of the same sex – has been deleted by the collectivity, the culture, the religious tradition. This deletion has reflected, over the centuries, in Western culture, including language – which did not even have names without pejorative connotations, such as that which permeates the term homossexualism, for instance. This thesis deals with the transformation of a socially stabilized and legitimized discourse by institutions (a normative discourse) into a hitherto apocryphal and unrecognized one, in relation to the theme of stable union and homoaffective marriage. The rupture provided by the decision inaugurates a new institutional discourse that offers the possibility of a new legal practice. The confluence of the event (the trial) with a memory (the affective and supportive memory towards the homoaffective people) and with history grants the conclusion that the decision of the Federal Supreme Court analyzed here, for all its consequences – among them, establishing new memory networks – has configured a Discursive Event with significant repercussions in Brazilian society. / Esta tese analisa o voto do relator do julgamento do Supremo Tribunal Federal brasileiro, Ministro Ayres Britto, sobre a possibilidade de reconhecimento de união estável e do casamento entre pessoas do mesmo sexo. O trabalho tem como referencial teórico o Direito, especialmente o Direito de Família, e a Análise de Discurso de orientação francesa, formulada por Michel Pêcheux.Trata-se de um olhar sobre o funcionamento de um discurso que marcou o começo de uma nova prática, de uma nova perspectiva de convivência social, à luz do Direito, entre e com as pessoas que têm uma orientação sexual homoafetiva. O desenvolvimento do conceito de memória discursiva, e o peculiar funcionamento da decisão enquanto acontecimento discursivo, possibilitam entrever novas redes de memória sobre a homoafetividade. O tema do presente estudo −o relacionamento afetivo entre pessoas do mesmo sexo− foi apagado pela coletividade, pela cultura, pela tradição religiosa. Um apagamento que se refletiu durante séculos na cultura ocidental, inclusive na linguagem, que não dispunha sequer de designações sem conotação pejorativa, como a que permeia o termo homossexualismo, por exemplo. Esta tese trata da transformação de um discurso socialmente estabilizado e legitimado pelas instituições (um discurso normatizado) em outro até então apócrifo e não reconhecido, em relação ao tema da união estável e do casamento homoafetivos. A ruptura proporcionada pela decisão inaugura um novo discurso institucional que proporciona a possibilidade de uma nova prática jurídica. O encontro do evento (o julgamento) com uma memória (a memória afetiva e solidária para com as pessoas homoafetivas) e a história autoriza a conclusão de que a decisão do Supremo Tribunal Federal aqui analisada, por todas as suas consequências – entre elas a de estabelecer novas redes de memória –, configurou um Acontecimento Discursivo com repercussões significativas na sociedade brasileira.

To develop this study, we used the aesthetic concepts and phenomenological on various theories on the subject, focusing on phenomenology and hermeneutics, on the interpretation of a life in the work of contemporary art. Therefore, were selected authors of works who have developed and still develop researches that underlie the subject studied in order to ground theoretically every study. Among them are: HAMBURGER (1975), FOUCAULT (1985 - 2006), BAUDRILLARD (1991), WOLFGANG ISER (2002), BARTHES (2004), CAMPOS (2004), ROBERTS (2007), LEJEUNE (2008), BAKHTIN (2010 - 2013), PAREYSON (1993), among others, which undoubtedly will contribute significantly to the understanding and critical analysis of this study. This study belongs to the field of Literary Theory, which proposes a new way of looking at the memory speech and simulation in the context of contemporary Brazilian literature. / O presente estudo tem como objetivo realizar uma pesquisa por meio de uma abordagem crítica da obra de arte Confissões de Ralfo, (uma autobiografia imaginária) do escritor brasileiro Sérgio Sant Anna, publicada pela primeira vez em 1975, considerada, no contexto da literatura brasileira contemporânea, como um livro de memórias, o qual apresenta uma multiplicidade de faces da escrita de si tais como: Autobiografia imaginária, memória, diário e epistola (carta). Para o desenvolvimento deste estudo, recorreu-se às concepções de estética e fenomenológica em diversas teorias sobre o tema, focando na fenomenologia e hermenêutica, sobre a interpretação de uma existência na obra de arte contemporânea. Assim sendo, foram selecionadas obras de autores que desenvolveram e que ainda desenvolvem pesquisas que perpassam a temática estudada, a fim de embasar, teoricamente, todo estudo. Entre eles estão: HAMBURGER (1975), FOUCAULT (1985 2006), BAUDRILLARD (1991), WOLFGANG ISER (2002), BARTHES (2004), CAMPOS (2004), RODRIGUES (2007), LEJEUNE (2008), BAKHTIN (2010 - 2013), PAREYSON (1993), entre outros, que, sem dúvida, contribuíram, significativamente, para a compreensão e análise crítica deste estudo. Tal estudo se insere no campo da Teoria Literária, a qual propõe um novo modo de olhar para o discurso da memória e do fingimento no contexto da literatura brasileira contemporânea.
