In order to achieve this objective, an exploratory study has been made, based on the through interview technique, ten managers from the major printed newspapers in the State were interviewed. From specialized literature an analysis structure made of six dimensions was elaborated, which have oriented the creation of the interview script, as well as the structure of the chapter of results. The results of this paper indicate that companies acknowledge, the importance of the competitive intelligence, although several restrictions have been observed towards its effective practice. This practice is more evident towards the most palpable aspects , closer to the day by day of the companies, as the analysis of the most direct competitors (other newspapers), the technological changes in the area of the printed newspapers and in the behavior of the readers. A broader and more strategic approach of the competitive scenarios where the companies are inserted is for them something still distant and to be achieved. Therefore, even though the importance of the competitive intelligence has been acknowledged and understood in a reasonable way, the companies that operate newspapers in Rio Grande do Sul still lack procedures to provide a greater depth and laterality of the analysis to subside the process of competitive intelligence. Its reflective strategies are still too attached to the printed newspaper business which has restricted the monitoring of the environment towards the actions of its direct competitors, or to the technology more directly associated to the production of printed newspapers, not yet paying attention to hidden movements seen in areas much more threatening to the business that they operate today. / Este estudo analisa o processo de inteligência competitiva na indústria de jornais impressos no Rio Grande do Sul. Para concretizar este propósito foi realizado um estudo exploratório, no qual, com base na técnica da entrevista em profundidade, foram entrevistados dez executivos dos seis maiores jornais impressos do Estado. A partir da literatura especializada foi montada uma estrutura de análise composta por seis dimensões, as quais orientaram a elaboração do roteiro de entrevistas, bem como a estrutura do capítulo dos resultados. Os resultados do trabalho indicam o reconhecimento, por parte das empresas, da importância da inteligência competitiva, embora tenham sido identificadas várias restrições quanto à sua efetiva prática. Esta prática é mais evidente com relação àqueles aspectos mais palpáveis e que estão mais próximos do dia-a-dia das empresas, como a análise dos concorrentes mais diretos (outros jornais), as mudanças na tecnologia na área dos próprios jornais e o comportamento de leitores. A leitura mais ampla e estratégica dos cenários competitivos onde as empresas estão inseridas é para elas algo ainda distante e que está ainda por ser feita. Em síntese, conclui-se que, embora reconheçam a importância da inteligência competitiva e a entendam de forma razoável, as empresas que operam jornais impressos no Rio Grande do Sul carecem ainda de procedimentos que lhes propiciem maior profundidade e lateralidade de análise para subsidiar o processo de inteligência competitiva. Suas reflexões estratégicas estão ainda muito presas ao negócio jornal impresso, o que lhes tem restringido o monitoramento do ambiente ao âmbito das ações dos seus concorrentes diretos, ou da tecnologia mais diretamente associada à produção de jornais, não atentando ainda para movimentos ocultos evidenciados em áreas muito mais ameaçadoras ao negócio que hoje operam.

A tecnologia desafia o direito, causando sério impacto na sociedade contemporânea. O seu desenvolvimento resulta, na maioria das vezes, na inadequação entre as relações de emprego vivenciadas na realidade e as legislações que as tutelam. Como não poderia ser diferente, a evolução tecnológica afetou também os profissionais radialistas e jornalistas. Em contrapartida, não há qualquer alteração legislativa neste setor, o que se torna ainda mais crítico, considerando que as leis que tutelam estas profissões estão próximas de 30 anos de publicação. O presente estudo pretende analisar estas legislações, sua aplicação prática e as dificuldades enfrentadas pelas empresas de radiodifusão e pelas empresas jornalísticas, no que diz respeito aos contratos de trabalho firmados com empregados que fazem parte de referidas profissões regulamentadas, à jornada de trabalho especial, à questão salarial x direitos autorais, ao enquadramento dos profissionais em atividades descritas de forma minuciosa na legislação específica e, ainda, à questão do registro profissional. The technological evolution has likewise affected the radio broadcast workers and journalists. On the other hand, there is not any legislative change in this sector, what makes this issue even more critical, considering the laws that rule these professions are coming close to their 30 years of publication. In the present study, it is intended to review these legislations, their practical use and the difficulties faced by the radio broadcasting companies and the newspaper companies, regarding the work agreements signed with employees that are part of the referred regulated professions, with the special work shift, with the issue salary versus copyright, with the placement of professionals within the activities described in-depth by the specific legislation and, yet, with the issue of the professional register. A lack of unison is verified between the current legislation and the technological reality present in the communication enterprises, which leads to the necessity of both change and pursuit for the ideal regulation, consonant with the contemporary modernity.
