Legislation governing foundations and endowment funds Abstract The diploma thesis deals with the topic of foundations and endowment funds with a focus on a current legislation, that is reincorporated into the general legislation after the recodification of the private law. Brief introduction to the topic of foundations and endowment funds is followed by the chapter containing a historical analysis of foundations on the Czech territory since the 9th century. Significant changes, which the foundations went through and caused their present form, are highlighted. The third chapter is the most important and the longest part of the thesis, as it focuses on a current legislation. The chapter defines the institutes of foundation and endowment fund in the contemporary society and it is divided into the two subchapters that concerns both endowment entities separately. The diploma thesis defines the purpose, property and bodies. There is further clarified the establishment and formation process and the reverse dissolution and termination process of these legal entities. In addition, the chapter formulates the Public Benefit Status and the conclusion is devoted to the new terminology brought by the recodification. The diploma thesis deals with the implementation of a Business Intelligence solution for the endowment fund helping with debt relief for people and thus replaces the current process of manually created reports. The main goal of this solution is to bring to the endowment fund the opportunity to make faster and better decisions, as well as many other benefits associated with Business Intelligence.

THE ABSTRACT Topic: Problems of activity of foreign foundations and endowment funds in Czech Republic. This thesis is primary aimed to clarify problems regarding to activity of foreign foundation and endowment funds in Czech Republic. The purpose of this work is to explain related problems and provide possible solutions for such issues. In the early chapters, the author familiarizes readers with history of foundations and endowment funds in Czech Republic and explains the terminology and meaning of foundations and endowment funds as a legal person. Secondly, the author analyses legal situation in Czech law and presents various options for activity of foreign foundations and endowment funds in Czech Republic. Furthermore, the author deals with the description of the solution consisting in the establishment of branch in Czech Republic. This part of the thesis is the largest content because the author provides possible solutions for various problems arising from establishing of branch. The thesis also describes foreign legislation relating to foundations and endowment funds. And finally, the author states possible changes in Czech law, which will lead to the better foundation's legislation in Czech Republic and attaches drafts of documents usable for the thesis topic.

In order to mitigate the burden of government expenditure and improve the management of university, national universities in Taiwan have implemented the system of University Endowment Fund. The establishment of University Endowment Fund System has enacted for 16 years since 1996. The maintenance of National University mostly depends on government support in the past. And the college maintenance fund turned into half government support and half self-raised fund after the University Endowment Fund System has been enact. The investment gain is the most undeveloped item in five self-raised items. Most of National universities take bank deposit as its only investment. As a result, this paper aims to study about university investment. Investigate the latest law and regulation of national university and find the characteristic of college investment. Take National Sun Yat-sen University for example and establish the investment policy for national university. Select appropriate invest stock for National Sun Yat-sen University, and the select mechanism depends on the investment policy. Take the cash dividend to improve the financial income. The University Endowment Fund can improve its asset allocation gradually in the future.

The diploma thesis deals with the design of the building of the Center for Children's Oncology Endowment Fund Krtek (Mole) at the crossing of Milady Horákové and Francouzské streets in Brno. Emphasis is placed on a detailed solution of operational, functional and capacity needs, which are individual requirements of a particular endowment fund.

This thesis is focused on the taxation of organizations in the non-profit sector. The theoretical part presents the various kinds of non-profit organizations and the Tax system in the Czech Republic. The practical part includes the analysis of taxation of a concrete profit organization – Nadační fond manželů Livie a Václava Klausových.

This thesis deals with the analysis of financing of endowment funds as one of the legal forms of non-governmental organizations. Specifically, it is focused on those that specialize in the human rights. The author specifies the environment and conditions under which the endowment funds work in general. The second chapter is focused on the characteristics of the group of the funds supporting human rights and evaluates their professionalism. The third chapter is devoted to the analysis of the selected types of their revenues and economic indicators. It also shows the example of four endowment funds and the various attitudes to their financing. Part of this chapter also indicates some of the current problems and challenges of this specific group of endowment funds.

Предметом диссертации является частно-государственное партнерство в сфере высшего образования как специфическая GR -технология. Особое внимание автор уделяет изучению коммуникативных механизмов, обеспечивающих эффективное взаимодействие между бизнес-структурами и органами власти. Диссертант подробно рассматривает новые коммуникативные механизмы данной технологии, особенности их применения в системе российского и зарубежного высшего образования. Анализ предмета статьи доказывает, что частно-государственные проекты являются самыми эффективными площадками открытого диалога бизнеса и власти для решения проблем высшего образования РФ. Для характеристики функционирования субъектов и коммуникативных механизмов GR-технологий используются структурно-функциональный и сравнительный метод. Для получения доказательной базы применен метод case-study. Основные результаты: 1.Частно-государственное партнерство является GR-технологией, выражающейся в применении специфических методов взаимодействия бизнеса и власти с целью решения социальных проблем.2.Изучение коммуникативных механизмов ЧГП как GR-технологии определило ее эффективные формы: ассоциации выпускников, эндаумент-фонды, академический фандрайзинг, частно-государственные проекты. 3.Метод Сase-study позволил определить частно-государственные проекты в системе высшего образования, как самый эффективный механизм GR-деятельности в РФ. / The subject of this research is the public-private partnership in the sphere of higher education as a specific GR-technology. The author pay particular attention to the study of communication mechanisms that ensure the productive interaction between businesses and government authorities. The work carefully examines the new communication mechanisms of such technology, as well as specificities of its application in the system of the Russian and foreign higher education. Analysis of the subject of research confirms that the public-private projects manifest as the most efficient platforms for the open dialogue between business and government for resolution of the issues of higher education in the Russian Federation. The author made the following conclusions: 1) public-private partnership is the GR-technology, which manifests in application of specific methods of interaction between business and government to address the social issues; 2) examination of the communication mechanisms of public-private partnership as a GR-technology defined its efficient forms: alumni association ,endowment funds, fundraising, and public-private projects; 3) the case-study method allowed identifying the public-private projects within the system of higher education as the most effective mechanism for GR-activity in the Russian Federation.
