O papel do Estado neste contexto é decisivo e, principalmente do judiciário num país como o Brasil. O pertencimento é fraterno e sua ocorrência se dá pelo convívio entre as diferenças como forma de encontrar a igualdade, motivo pelo qual um estudo sobre o direito fundamental ao ensino inclusivo por Língua Brasileira dos Sinais (LIBRAS) para as pessoas surdas e o papel do judiciário na sua materialização se mostrou relevante e atual. Neste contexto, fez uma pesquisa de base doutrinária e legislativa apoiada na Teoria da Constitucionalização Simbólica de Marcelo Neves e pela visão da diversidade e o Capability Approach de Martha Nussbaum, findando com a análise da LIBRAS e o direito fundamental ao ensino inclusivo para a comunidade surda. A partir deste ponto, passou-se a uma análise das decisões dos Tribunais Superiores (STF e STJ) e dos Tribunais Regionais Federais das cinco Regiões. Selecionadas vinte decisões, traçou-se um perfil das ações que buscam a educação inclusiva por LIBRAS e seus fundamentos, resultando em que elas são tipicamente legalistas e, em geral, favoráveis ao reconhecimento e deferimento do direito fundamental. / Feeling human and belonging to the species is something sought after by many minorities, but none has as much difficulty as people with disabilities, since they present palpable and generally visible differences, creating a certain stigma to be overcome by Internal and external form. The State in this context is decisive, and especially of the Power Judiciary in a country like Brazil. Belonging is fraternal and its occurrence is due to the coexistence of differences as a way of finding equality, which is why a study on the fundamental right to inclusive education by Brazilian Sign Language (LIBRAS) for deaf people and the role of the judiciary In its materialization was relevant and current. In this context, he did a doctrinal and legislative research based on the Theory of Symbolic Constitutionalization of Marcelo Neves and the vision of diversity and the Capability Approach of Martha Nussbaum, ending with the analysis of LIBRAS and the fundamental right to inclusive education for the deaf community. From this point, an analysis was made of the decisions of the Superior Courts (STF and STJ) and the Regional Courts of the five Regions. Twenty decisions were selected, a profile was drawn of the actions that seek inclusive education by LIBRAS and its foundations, resulting in that they are typically legalistic and, in general, favorable to the recognition and deference of the fundamental right.
