Reconciling the Opportunities and Obstacles of Motherhood Following Corrections InvolvementNewell, Summer Brooke 08 June 2018 (has links)
This mixed methods dissertation is comprised of three papers that consider interrelated ways in which social bonds, within the context of parenting, are experienced by women recently involved with the corrections system. Types of social bonds considered include agency professionals, romantic partners, and children--all previously theorized to play a role during the reentry period. These social bonds are considered within the context of the challenges experienced during this period, and how and why these social bonds may--or may not--support women as they transition back into the community.

The Influence of Parental Gender on the Type of Communication between Incarcerated Parents and Their ChildrenLazzari, Sarah Renee 01 January 2012 (has links)
The number of children in the United States with an incarcerated parent continues to rise. Currently, more than 1.7 million children have at least one incarcerated parent. In addition, research has found that children with criminally involved parents are at a higher risk of also becoming offenders (Glaze & Maruschak, 2010). Research has shown that incarcerated parents' abilities to maintain communication with their children may decrease negative behaviors while incarcerated and may decrease the negative effects of being removed from their families. The current study utilizes secondary data to explore the types of communication incarcerated parents use in order to stay connected with their children. The goal is to understand gendered differences regarding how incarcerated mothers versus incarcerated fathers choose to communicate with their children, and to understand which forms of communication (letter writing, face to face visits, and phone calls) are utilized most often by incarcerated parents to maintain and strengthen the bonds with their children. Logistic Regressions identified that incarcerated mothers are more likely to have at least one visit, phone call, and will utilize more forms of communication in a month's time, with their children. These findings both support and contradict previous studies. Implications of the findings and further suggestions are discussed.

Relationship issues and newly released male prisonersPadman, Jeanette January 2001 (has links)
This research examines the factors that impact on a newly released male prisoner's ability to deal with relationship issues. Most prisoners, in South Australia, will be released to the community and of these very few will live in complete isolation from other human beings. Humans are dependent on other persons to full-fill a range of needs and this process is reciprocal. If skills are lost due to incarceration then both the prisoner and the community suffer. (Matthews 1999) Pre-release issues are important but the relationship issue permeates through all pre-release requirements. It can can impact on obtaining and retaining employment, maintaining personal relationships, getting social security, obtaining housing etc. This is a very important aspect of human existence but sometimes it is forgotten until it is a severe problem. The Negative Health Consequences for and Impacts of Incarceration on Partners and Children: Predicting Greater Negative Impact and More Harmful Mental Health Consequences for Partners of the IncarceratedWilliams, Shameika Niasia January 2023 (has links)
Mass incarceration is a public health issue that impacts millions of Americans. Draconian drug laws, over-policing, and unfair sentencing policies rooted in racism have led to the incarceration of millions of Black and Latinx people in the past four decades. Mass incarceration not only has collateral consequences for the health of the incarcerated, but also fortheir partners and children across multiple dimensions.
This cross-sectional study recruited participants using social media, email, and text messages. Those who identified as Black or Latinx, age 20 or older, and who had a partner who was incarcerated for at least three months were eligible for study participation. The study was novel in asking for ratings of physical and mental/emotional health for four time periods: before their partner’s incarceration, after their partner’s incarceration, the year after their partner’s release, and “now”/currently. Results showed significant declines in both physical and mental/emotional health (e.g., a decline in ratings for during their partner’s incarceration from the pre-incarceration level), as well as improvements (e.g., improvement for the period “now”/currently from the during incarceration level).
Also, when rating their children for the same four time periods for physical health, mental/emotional health, behavioral conduct, and school performance, a similar pattern of both declines and improvements was found. Findings argued for the importance of a methodology using multiple time periods for obtaining ratings, and for a resilience framework to accommodate interpretation of improvements. Further, having a greater number of children, being currently employed, having a lower income, and a lower rating of mental health during their partner’s incarceration were four significant predictors found in the regression models for both study outcome variables: i.e., (1) a higher negative impact from a partner’s incarceration on multiple dimensions; and (2) more harmful mental health consequences for partners of the incarcerated.
Findings provided evidence for an especially underserved at-risk subset within the population of diverse male and female partners of the incarcerated: i.e., Black and Latinx women with a high number of children who are employed yet earning low wages—while suffering from severe mental health symptoms. Implications of the findings and recommendations are discussed.

Access to justice for non-citizens : a constitutional analysisMatshakaile, Thabani Nkosiyapha 04 1900 (has links)
Thesis (LLM)--Stellenbosch University, 2014. / ENGLISH ABSTRACT: The rights entrenched in the Bill of Rights in South Africa’s final Constitution are, with a few
exceptions, guaranteed to citizens and non-citizens alike. South Africa has seen an influx of
migrants, asylum seekers and refugees since 1994, and this migratory movement has posed
significant challenges to the post-apartheid legal order. This thesis is concerned with the
State’s implementation of its constitutional obligations to protect and guarantee the
constitutional rights of everyone within the borders of South Africa.
It is important that these constitutional obligations do not remain mere aspirations but should
translate into reality. Most non-citizens living in South Africa face numerous barriers to
accessing justice and the processes that could enable them to realise their rights. The thesis
examines the concept of “access to justice” and investigates a number of obstacles
encountered by different categories of non-citizens – such as refugees, asylum seekers and
documented and undocumented migrants – in trying to access justice and to realise their
rights.
Against this background, arrest, detention and deportation under the Immigration Act and
Refugees Act are examined because these processes have often been abused by State officials
to prevent non-citizens from accessing the rights and protections guaranteed in these Acts and
the Constitution, and to frustrate the implementation of court orders vindicating the rights of
non-citizens. The application of the Immigration and Refugees Acts is discussed through the
lens of sections 12(1), 33, 34 and 35(2) of the Constitution which ensure that arrest, detention
and deportation are done in a lawful and procedurally fair manner, as opposed to the
arbitrariness that most non-citizens experience on a daily basis. Secondly, the thesis also examines access to justice for non-citizens in the context of
xenophobia and bias based crimes. The State has in the past failed to respond in a coordinated
and timely fashion in the face of violent manifestations of xenophobia. Against this
background, the State’s obligation to protect non-citizens from violence from either public or
private sources in terms of section 12(1)(c) of the Constitution is discussed and analysed. The
role, accessibility and effectiveness of Equality Courts are also examined in light of the Promotion of Equality and Prevention of Unfair Discrimination Act and the cases that were
brought before them emanating from xenophobic incidents.
The thesis concludes with proposals on areas which require better implementation of existing
laws; and areas in which legislative reform is needed.
xenofobiese voorvalle voortspruit.
Die tesis sluit af met voorstelle oor terreine waar beter implementering van bestaande
wetgewing benodig word, asook terreine waar wetgewende hervorming verlang word.

Mothers behind bars : challenges experienced relating to child care during incarceration / Abantu baqala ibhayi : izinselele ezikhululekile ngokukhetha kwabantu ngokwenzeka / Abantu abakhululela ibhayibhile : iingxoxo ezibenzelekileyo ngokubhalwa kwabantwana ngokwenzekaDeonarain, Sharona 19 January 2021 (has links)
Abstract in English, Zulu and Xhosa / The study’s intent is to explore challenges experienced by incarcerated mothers relating to childcare, based at the Durban Westville Correctional Centre. The theoretic framework of this study encompasses the Relational Theory, the Gendered Pathways Theory, and the General Strain Theory. This research utilises the qualitative research technique. Semi-structured, open-ended interviewing was concluded with 15 incarcerated mothers based at the Durban Westville Correctional Centre using the probability sampling technique. The relationship between a mother and her children is of paramount importance, even for incarcerated mothers. However, incarcerated mothers are unable to tend to their childcare responsibilities due to their physical and emotional limitations presented by incarceration. Incarcerated mothers in this study expressed their challenges experienced and their need for rehabilitation programmes to help them mitigate their childcare challenges. The research reveals that some of the incarcerated mothers have experienced traumatic backgrounds inclusive of emotional strains, financial impediments, verbal abuse, physical abuse and sexual abuse prior to their incarceration. Their challenges exacerbate whilst incarcerated and literature referred to denotes that their challenges continue post-release. Rehabilitation and reintegration of the offender have become the primary focus for the Department of Correctional Services seeing that its scope of service has shifted from a system of “control” to that of rehabilitation.
The study indicates gaps in the rehabilitation programmes offered by the Department. Further, the study intends to make recommendations to the Department of Correctional Services on implementing rehabilitation programmes that aid and support a healthy mother and child bond. Such programmes would assist by enlightening, educating and encouraging incarcerated mothers to tighten and protect unions with their children and for the Department to offer special visitation programmes that aid such a process / Inhloso yalolu cwaningo ukuhlola izinselele ezitholwa omama ababoshiwe ngokuphathelene nokunakekelwa kwezingane, esekelwe eThekwini West Correctional Centre.
