Elektroninių viešųjų pirkimų teisinis reguliavimas užsienio valstybėse: lyginamoji analizė / E-procurement's Legal Regulation in Foreign States: Comparative Analysis

The use of electronic measures during administration of public procurement not only helps to save recourses but also guarantees effectiveness, transparency and more possibilities for small and medium companies to take part in it. Directive 2004/17/EC coordinating the procurement procedures of entities operating in the water, energy, transport and postal services sectors and Directive 2004/18/EC on the coordination of procedures for the award of public work contracts, public supply contracts and public service contracts became the basis of the legal regulation. Great Britain, Spain and Lithuania have incorporated norms of directives into their national law systems successfully. Great Britain is considered to be one of the leaders from European Union member states in e-procurement administration. Spain’s administrative units – Cataluña and Basque Country – are as examples of e-procurement’s regulation and for very good results in e-procurement’s administration in Basque Country. Lithuania has implemented new norms of directives with the law of public procurement and shows a quite good progress in it. In 2006 the Federation of Russia with new legal act of public procurement implemented many important aspects which will help to cooperate with the public procurement participants from abroad and administrate public procurement with the help of electronic measures. Viešieji pirkimai kaip viena iš pagrindinių valstybės funkcijų tiekti viešąsias gėrybes visuomenei, tapo svarbia ekonomikos dalimi.Viešieji pirkimai tapo aktualūs tiek savo poveikio visuomenei, tiek verslui prasme. Todėl šio darbo tikslas yra įvertinti viešųjų pirkimų poveikį privačiam verslui. Teorinėje dalyj apžvelgiama viešųjų pirkimų kilmė ir didžiausią įtaką turėjusios tendencijos (liberalizmas, nacionalizmas, marksizmas). Taip pat pateikiamas pamatinis pasaulio praktikoje naudojamas viešųjų pirkimų modelis. Remiantis analitine medžiaga įvertinama Lietuvos viešųjų pirkimų reglamentavimo raida, viešųjų pirkimų sistema Lietuvoje. Taip pat išsamiai išnagrinėjam elektroninių viešųjų pirkimų teorija bei įgyvendinimas. Plintant pasaulyje darnaus vystymosi tendencijoms aptarta ir darnių pirkimų vystymosi raida, kliūtys ir galimybės. Kadangi viešieji pirkimai yra nepatrauklūs neskaidriais procesais yra pateikiama prevencinės priemonės skaidrumui užtikrinti. Atliktas tyrimas atskleidė, kokią yra reali viešųjų pirkimų praktika Lietuvoje, buvo nustatyto tobulintinos viešųjų pirkimų dalys, veiksniai skatinantys įmones dalyvauti viešuosiuose konkurse bei didžiausi per pastaruosius metus įvykę pokyčiai viešųjų pirkimų sistemoje Lietuvoje. / The environment of public sector purchasing has become more complex then ever before. Without all changes is necessarily to remember the purcahsing power government, which direct impacts private business aria. So the main issue is – if the public procurement transformation goes the right way and how to secure effetive function of public procurement. So this graduation paper researches the practice of public procurement in Lithuania. The aim of this paper is to analyse and evaluate the impact of government to private business through public purchasing. This identification of the aim of the paper has led to the following objectives of the study:  to review the theoretical economical ideologies, which had influence public procurement and present underlying set of process and elements in nowadays public procurement in Lithuania;  to analyse e-procurement possibilities incorporating with the international aspect;  to reveal the society opinion about legality and transparency issues in public procurement;  to identify the innovation progress in public procurement discussing sustainable public procurement.  invoking the research to compare the theoretical model and real practice in Lithuania of public procurement and to estimate how public procurement gaps impact private business.
