Environmental Integration in Sustainable Urban Planning from an Institutional Perspective : A Study of Swedish and Chinese Eco-City DevelopmentYin, Ying January 2014 (has links)
The continuously rising attention to and practice of eco-city development in Sweden and China, as well as the countries’ active cooperation has motivated this study and the exploration of eco-city development in these two countries. In eco-city development, diverse environmental issues may well be beyond the planning sector’s capacity and need to be resolved elsewhere by other authorities and agencies in such areas as energy, water and traffic. This may in practice require the reframing of certain institutions to ensure that relevant sector authorities, scientific institutions and actors have responsibilities for integrative tasks and can cooperate effectively. The study aims to investigate how institutional conditions affect environmental integration in urban planning. The approach used is the exploration of how different institutional conditions promote and/or hinder environmental integration by the examination of four examples of eco-city development in Sweden and China. Based on theories of institutions, Environmental Policy Integration (EPI) and sustainable urban planning, an analytical framework is used to describe institutional conditions related to formal rulemaking, informal rules and administrative management and organizations. Formal rules provide framework and legitimacy for guiding and enforcing actors in the practice of realizing environmental integration in urban planning. Meanwhile, informal rules; i.e. wills, interests, understanding and knowledge, could considerably affect the design of formal rules and how they are to be implemented. Administrative management and organization serve to realize environmental integration following the formal rules, but the informal institutional conditions of e.g. officials’ interests, understanding, knowledge and experience, as well as political support, affect the organizations’ performance and abilities for implementation, which in turn also largely depends on the specific organizational settings. All three need to be combined to achieve environmental integration in sustainable urban planning, since each one has its own strengths and weaknesses and they gradually affect each other in practices. / <p>QC 20140908</p>

Competition law, state aid law and free-movement law : the case of the environmental integration obligationNowag, Julian January 2014 (has links)
This thesis investigates competition law, State aid law and free-movement law in their interaction with Article 11 TFEU’s obligation to integrate environmental protection requirements into all activities and policies of the Union. The Article is formulated in broad and sweeping terms which makes integrating environmental protection requirements complex and context-dependent. The challenge of integrating environmental considerations is further increased as such integration in competition, State aid and free- movement law is different from other areas of EU action. The three areas are the core provisions protecting the internal market by prohibiting certain actions of the Member States and undertakings. Unlike in other areas, the EU is therefore not in the position to develop or design the actions but has to scrutinise the measure according to pre-established parameters. To address this challenge, a novel functional approach to environmental integration is developed. The approach should facilitate a better understanding of environmental integration and in particular its application to competition law, State aid and free-movement law. An important element of this thesis equally the comparison between the three areas of law. It sheds light on conceptual issues that are not only relevant to the integration of environmental protection. The comparison advances the understanding in relation to questions such as how restrictions are defined and how the respective balancing tests are applied. The contribution of this research is therefore twofold. One the one hand, it compares how the different tests in competition, State aid and free-movement law operate, thereby offering opportunities for cross-fertilisation. On the other hand, this comparison and the improvements suggested as a result help to conceptualise environmental integration thereby paving the way for a more transparent and consistent integration of environmental protection in competition, State aid and free-movement law.

Magistro darbo problema yra susijusi su situacija, kuomet nedidelė valstybių tarpusavio priklausomybė ir nenoras riboti savo suverenitetą lemia globalių aplinkosauginių režimų neefektyvumą. Tuo tarpu regioninis bendradarbiavimas, sąlygojamas valstybių tarpusavio priklausomybės, leidžia efektyviau spręsti kylančias problemas. Regionai, siejami iniciatyvų įveikti specifines ekologines grėsmes, gali būti ypatingai suinteresuoti bendradarbiauti ir kurti ekologinio saugumo kompleksus. Todėl bendradarbiavimas ekologinėje srityje gali skatinti tolesnę regiono integraciją. Tyrimo objektu darbe laikomas dėl ekologinių grėsmių vykstantis regioninis bendradarbiavimas bei institucionalizuotos jo formos. Darbe keliamas klausimas, kokiomis sąlygomis ekologinės grėsmės skatina regioninį bendradarbiavimą? Taip pat keliamas šalutinis klausimas, kokie faktoriai riboja ekologinio bendradarbiavimo procesus? This fact forms the main problem of the MA thesis. The MA thesis is based on the presumption that regional cooperation which is determined by the interdependence of the states allows to resolve current issues easier. Certain regions which have intentions to cope with common environmental threats may be especially interested in cooperation and establishment of environmental security complexes. Therefore, cooperation may encourage the further integration. The key question of the MA thesis is when and in what circumstances the environmental threats encourage regional integration? The additional question is what factors restrict the processes of regional cooperation on the basis of the environmental threats? Environmental education is a response to the environmental crisis. Due to the diversity of the environment, environmental education processes face a challenge, locally and globally, because it should respond to the diversity of local environmental issues, and contribute towards the addressing of local environmental issues. It is therefore important that environmental education programs focus on local environmental issues, and in the analysis there of accommodates investigative, problem solving and environmental action skills, because such programs proof to be more successful.
The introduction of environmental education into formal education can only be successful within a structure that is conducive to a holistic integrated approach and accommodates investigative, problem solving and environmental action skills. Research however proves that within the school context, environmental education processes, as well as the addressing of local environmental issues, is fragmented. The development of a school environmental policy and management plan can provide a valuable framework for a holistic approach to the organization of environmental education processes in schools, that is integrated with the curriculum, resulting in the effective management of resources and the addressing of local environmental issues.
Through this research, the implementation of school environmental policies and management plans in Mpumalanga was evaluated, in terms of the integration of environmental education processes in the curriculum, the organization of environmental education processes in schools, the effective management of resources in schools, and the addressing of local environmental issues.
The conclusion was drawn that the implementation of school environmental policies and management plans contributes towards curriculum integration of environmental education, the organization of environmental education processes, the management of resources and the addressing of environmental issues in schools. The more exposure a school gets in terms of implementation of school environmental policies and management plans the higher the achievement in the mentioned areas. A Competitive Environment? : Articles 101 and 102 TFEU and the European Green DealLundgren, Lars January 2021 (has links)
Europe is facing a climate and environmental crisis. To respond to this, the European Commission has launched several programmes, which aim to increase sustainability and environmental protection. This aim has been condensed into the policy document that is the European Green Deal. The European Green Deal sets out the aim of making the Union’s economy climate neutral, while improving environmental protection and protecting biodiversity. To this end, several different sectors of the economy need to be overhauled. In EU Law, a key policy area is to protect free competition. Article 101 TFEU sets out that agreements between undertakings which have as their object or effect the prevention, restriction or distortion of competition are prohibited. Similarly, Article 102 TFEU prohibits abuse by an undertaking of a dominant position. This thesis explores what happens when competition law thus intersects with the environmental policy of the Union. The thesis identifies two main situations of interaction. Undertakings can invoke environmental protection to justify a restriction of competition. The Union may also rely on its antitrust provisions to enforce sustainability by holding unsustainable practices as restrictive agreements or abuses of dominant behaviour, respectively, and thus prohibited by the antitrust provisions. Generally, the thesis concludes that there is not enough information on how the Commission and the CJEU will approach arguments relating to sustainability in its antitrust assessment. The Commission’s consumer welfare standard appears to limit environmental integration to points where a certain factor results affects the environment or sustainability on the one hand, and consumer welfare on the other. The lack of information, moreover, is in itself an issue as undertakings may abstain from environmental action if they believe they will come under scrutiny due to violations of the antitrust provisions. Therefore, a key conclusion in the thesis is that the Commission and the CJEU should set out clear guidelines for environmental action by undertakings, in relation to the antitrust provisions. Similarly, the Commission appears to be cautious to use antitrust as a tool against unsustainable practices. The Commission has, however, recently decided to open an investigation into agreements which limit sustainability, which shows that the picture may be changing.
