Environmental policy processes surrounding South Africa's plastic bags regulations : tensions, debates and responses in waste product regulation

This study was conducted in South Africa. South Africa is the first country within the Southern African Development Community to have regulated plastic shopping bags waste through the imposition of both a standard on thickness and a levy. Given this scenario, the Plastic Bags Regulations present an illustrative case for researching complexity, uncertainty and controversies surrounding a new trend in environmental policy making, namely waste product regulation. The thesis focuses on understanding and investigating tensions, debates and responses emerging from the policy process as actors and actor-networks put not only the Plastic Bags Regulations asfocal actant (token) but also other actants and actant-networks as well. To this end, a research question that addressed environmental policies, tensions, debates and responses that informed the development of South Africa's Plastic Bags Regulations was spelt out. The research objectives included the need to: (I) analyse selected international environmental policy processes surrounding plastic shopping bags litter and waste regulation and how these influenced developments in South Africa; (2) identify actors, actants and actor/actant-networks that shaped and were being transformed by South Africa's Plastic Bags Regulations and explain the tensions, debates and responses arising in the policy processes; (3) identify environmental policy outputs and assess outcomes emerging from the formulation and implementation of South Africa's Plastic Bags Regulations; and (4) establish patterns in environmental policy process reforms around South Africa's Plastic Bags Regulations. The language of actors (human), actants (non-human) and actor/actant-networks brings to the fore the aspects of processes and relationships that exist around them. As such, insights from the actor/actant-network theory (AANT) were drawn upon to inform the research. AANT enquiry framework collapses binaries such as nature/society, art/science, structure/agency and global/local historically associated with a particular type of social theory. AANT also denies that purely technical, scientific or social relations are possible (the notion of quaSi-objects or token). Data sets were generated following' the Plastic Bags Regulations as token actant with time frames ranging from prior to, during and after the formulation of the regulations. Similarly, data analysis drew insights from AANT's four moments of translation namely problematisation, interessement, enrolment and mobilisation, with the intervention theory providing an evaluative perspective that complemented AANT. The findings were that after the promulgation of the first draft of the Plastic Bags Regulations in May 2000, tensions emerged around the nature of regulation (whether command and control - preferred by government or self regulation - preferred by industry and labour). In this regard the latter group raised concerns about jobs, income and equipment loss as well as the need to have a holistic approach to waste management rather than targeting a single product at a time whilst the former maintained that this would not be so. As such, education, awareness and stringent antilitter penalties were proposed by industry and labour as sustainable responses to the problem of plastic shopping bags waste rather than regulation. These debates continued and resulted in minor amendments to the original regulations as finalised by Government in May 2002. However, industry and labour continued lobbying government resulting in the conclusion of the Plastic Bags Agreement in September 2002 and the ultimate repulsion of the May 2002 regulations in May 2003. As revealed by this research, these responses led to broader social responses and further tensions as demand for plastic shopping bags went down by about 80% although an estimated 1000 jobs were lost and a number of companies lost equipment and business (with some closing down) following the implementation of the regulations. During implementation, debates emerged around the need to promote locally made carry facilities with two alternatives in sight namely: the Green Bag and the Biodegradable Plastic Bag. Debates also took place regarding enforcement of the new law resulting in the amendments of various pieces of legislation including the Environmental Conservation Act, Environmental Management Act and the Revenue Laws Act. Overall, a 15-year policy reform cycle and sub-cycles was determined. The research also established that the government considered the regulations a success and was already implementing simi lar initiatives to regulate other waste products, among them, used tyres, used oil and glass, confirming the trend towards waste product regulation in South Africa. From these research findings, a series of conceptual frameworks were drawn up to clarify the nature of tensions, debates and responses surrounding certain lead actors, actants and actorlactant-networks. Some of the conceptual frameworks that emerged around the actors and actor-networks include Organised Government, Organised Industry and Organised Labour. Conceptual frameworks that emerged around key actants and actant-networks include the Integrated Pollution and Waste Management, Plastic Bags Regulations as well as the discourses surrounding the Green bag and biodegradable plastic bags. Development in this century is facing the critical dilemma brought about by Climate Change and the misuse of natural resources which are being depleted faster than they are being reproduced. Sustainable development offers an on-going call for global action towards mitigating the impact of these changes to ensure that current generations live equitably without infringing on the needs of future generations. Ensuing from Sustainable Development are a variety of initiatives such as Renewable Energy, which are aimed at reducing the amount of greenhouse gases, the main culprits of Climate Change. Many countries around the globe have further tailored Sustainable Development principles into policy and legislation to ensure that development initiatives meet the needs of current generations without compromising those of future generations. This study embarked on a process to evaluate how such policies influence the implementation of Renewable Energy projects in the Nelson Mandela Bay Municipality in Port Elizabeth, South Africa.

Critical analysis of the law on duty of care to the environment in South Africa :challenges and prospects

Thesis (LLM.) -- University of Limpopo, 2017. / Considering that South Africa is part of the world initiatives to ensure maximum protection of the environment for the sake of the present and future generations, if the environment is abused or degraded, there is need to sanction perpetrators accordingly. Reasonable measures should be taken to prevent harm from occurring to the environment or those harms that cannot reasonably be avoided or stopped, be minimized and steps taken to rectify such harm to the environment. Environmental care and management is principally recognised and regulated by the National Environmental Management Act 107 of 1998. This framework imposes a general duty of care for the environment (that is, every person has the duty to avoid pollution and environmental degradation). Both implementers and enforcers rely on this duty when enforcing environmental obligations. The duty of care has a retrospective effect, meaning that it is imposed on anyone who causes, has caused or may cause significant pollution or degradation to the environment. This study highlights the consequences for violating the duty of care as enshrined in NEMA particularly by people who are destroying the environment in the name of development. It argues for stringent implementation and enforcement mechanisms in order to bring perpetrators to justice. The study further deals with comparative analysis between South Africa, Australia and England where lessons are derived to help South Africa better its environmental laws and policies to ensure maximum protection of the environment.

This study arises out of a proposal of the Natal Parks Board (NPB) to develop a 200 bed hutted camp at Cathedral Peak in the Natal Drakensberg. In line with the NPB's stated commitment to the principles of Integrated Environmental Management (IEM), a multidisciplinary group, comprising five students from the Masters programme of the Department of Environmental and Geographical Sciences of the University of Cape Town, was commissioned to conduct a Preliminary Environmental Impact Assessment (PEIA) on the proposed development. The author was one of the members of this study team, hereafter referred to as the Masters Group, which conducted the PEIA at Cathedral Peak under the supervision of the Environmental Evaluation Unit of the University of Cape Town.

Johannesburg, May 2016. / Globally, urban areas are the fastest growing land cover with significant numbers of people residing within these urban spaces. The continuous growth and expansion of urban settlements continue to exert unprecedented negative pressure on the natural environment, and green spaces are increasingly disappearing. In most intermediate and secondary cities of developing countries, loss of urban green spaces is partly due to the knowledge gap in urban planning as well as the lack of comprehensive assessment of the challenges and factors contributing to the deteriorations of urban spaces in these cities. In any given urban environment, green spaces of all types are acknowledged for creating valuable economic, social and environmental services. Urban green spaces are fast becoming means to sustainable development due to their extensive multifunctional roles and benefits to different users. This research focusses on critically assessing the relationship that exists between urban greenness and sustainable development in the city of UMhlathuze, KZN, South Africa. It also explores how urban greening is increasingly tied to urban planning and the challenges that urban greening faces in the context of rapidly increasing urbanisation. Results of this study show that there is increasing need to improve green spaces especially for low income groups who cannot afford to travel out of town to experience natural environments. Urban development therefore calls for stakeholders to follow the principles of sustainable development with reference to ecological systems in urban areas, including community green spaces, gardens, biodiversity, native species and urban green infrastructure. Evaluation of provision and accessibility of government's environmental programmes and campaigns to the community of Masibekela, a rural village in Mpumalanga, South Africa, under the Nkomazi Local Municipality

The study focuses on the role of government in the provision of environmental programmes, events and campaigns. South Africa is a signatory to a number of environmental treaties and protocols hence it is expected to celebrate environmental days annually, such as World Wetland Day, National Water Week, World Environmental Week, Arbor Day and many more. The study considered the community of Masibekela, a remote rural village in Mpumalanga Province under the Nkomazi Local Municipality as its study area. Both qualitative and quantitative methods were applied to gather the necessary data from the four sets of respondents to a questionnaire survey, namely: the Sector Manager of Tonga Environmental Centre, traditional leadership and community members, learners and educators. The study discovered that the provision of environmental programmes, events and campaigns to the study area by the government leaves much to be desired. It lays bare that the community members of Masibekela are neglected environmentally by the government as compared to schools. The study also revealed contrasting features both in the knowledge and celebration of some of the environmental days by both the schools (learners and educators) and the general community members. A high percentage of learners and educators expressed their knowledge and celebration of environmental days since they are frequently visited by government officials to promote environmental programmes, events and campaigns geared towards environmental education and awareness but the same cannot be said about the traditional leaders and community members. It is recommended, among other things, that the Tonga Environmental Centre, as a custodian of provision of environmental programmes, events and campaigns, should be capacitated both in terms of human resources and strategic planning so as to meet its expectations. It is also recommended vi that more funding for bursaries for environmental studies for the youth should be made available and also more capital should be injected into the actual promotion of environmental programmes, events and campaigns. The National Department of Education in collaboration with the Department of Environmental Affairs should consider including Environmental Education in the school curriculum as a compulsory subject in all grades / Geography / M. Impacts of climate change : some economic considerations for decision-makers in the City of Cape Town, using Langebaan Lagoon as a case study

Thesis (MBA)--Stellenbosch University, 2005 / ENGLISH ABSTRACT: Strong scientific evidence suggests that global warming is altering the world's climate and that this phenomenon is being accelerated as a result of human activities. Climate change is affecting weather patterns and, in addition to demonstrated sea-level rise, these in turn have and are likely to continue having significant, mostly negative, impacts - both economic and loss of life - on governments, industries and people. Ocean levels rose between 15 and 20 centimeters in the 20th century, mostly as a result of melting glaciers and thermal expansion of the oceans. The International Panel on Climate Change (IPCC, 2001a: 16) in its 2001 estimate suggests a potential rise in average sea level from nine to 88 centimeters from 1990 to 2100. Areas of risk in the City of Cape Town are residential property, infrastructure and beaches in low-lying areas. These areas are likely to be impacted as a result of increasing sea-level rise and increasing severity and frequency of storms. This study seeks to • demonstrate that sufficient evidence exists to compel decision-makers in the City of Cape Town that climate change and the impacts of sea-level rise and increasing frequency and severity of storms need to be considered in development planning; and • test cost-benefit analysis (through climate change impact analysis) as a tool for decision-makers to consider adaptation measures, using Langebaan as a case study. The research comprises a comprehensive literature study of the impacts of climate change, particularly with respect to coastal areas. A case study based on the eroding beaches at Langebaan is used to test cost-benefit analysis as a tool for decision-makers in dealing with the impacts. Despite the uncertainties associated with the impacts of climate change (time, place and extent) the issues of sea-level rise and severe storms seem to warrant further investigation, especially at a local level. This study provides local context to a global problem and makes recommendations for decision-makers in the City of Cape Town. Climate impact analysis (incorporating cost-benefit analysis) is suggested as a tool to quantify avoided damages at vulnerable coastal sites in the City of Cape Town. In conclusion, the impacts of climate change are a complex and multivariate problem. However, there are a number of identified vulnerable areas along the coastline of the City of Cape Town and using tools like climate impact analysis and cost-benefit analysis may assist in identifying, costing and managing these economic risks before the problem becomes unmanageable - a case for quantifying avoided damage. / AFRIKAANSE OPSOMMING: Sterk wetenskaplike bewyse bestaan dat globale verwarming besig is om die wêreld se klimaat te verander en hierdie verskynsel word versnel deur die mens se handelinge. Environmental concern in South Africa : an analysis of elite and public attitudes and their implications for public policy

Thesis (MPhil)--Stellenbosch University, 2003. / ENGLISH ABSTRACT: South Africa, like so many other developing countries, is confronted with a very complex situation: although large-scale environmental degradation is threatening the future of the country, environmental matters are not regarded as of sufficient importance amongst the general population for them to contribute to environmental improvements. Most of the country's populations, many argue, are simply too poor and too focused on fulfilling short-term survival needs to give priority to the environment. Employing the 2001 World Values Survey, this study analyzes the attitudes of the general public of South Africa towards environmental matters. These attitudes are contrasted with those of the elites, who have a disproportionate influence over policy-making, by looking at the 2000 South African National Leadership Opinion Survey. This study finds that, as hypothesized, the general population of the country is quite unwilling (or unable) to contribute materially or financially to environmental improvements, especially in relation to the elites. In the final part of the study, these findings are employed in the development of a set of guidelines that policy-makers can use to increase the probability of developing successful and effective environmental policies. These guidelines take into account the nature and dimensions of popular attitudes, and consider ways in which environmental policies can foster the support of a public that is confronted with so many other serious issues. / AFRIKAANSE OPSOMMING: Suid-Afrika, soos soveel ander ontwikkelende lande, is gekonfronteer met 'n baie komplekse situasie: alhoewel grootskaalse degradasie van die omgewing die toekoms van die land bedreig, sien die algemene publiek nie omgewingskwessies as belangrik genoeg om 'n bydrae te lewer nie. Sustainable management in a disturbed environment : a case study of the Hogsback Working for Water Project.

Invasive alien plants in South Africa have become one of the major environmental problems affecting millions of hectares of productive and conservation land. Acacia mearnsii, black wattle, is a key invader species along the eastern escarpment. The major rivers of the country rise on this escarpment and the water catchments have been severely affected by black wattle invasion that has reduced water flow and increased soil erosion. The government introduced the Working For Water (WFW) programme in 1995 in order to address the problem of invasive alien plants in the country while, at the same time, creating job opportunities. This study researches the implementation of WFW projects in the small mountain village of Hogsback in the Amatola Mountains since their inception in 1996/97. The main research question posed by this study is: "What factors support or threaten sustainable environmental management through the Working For Water Programme in the Hogsback area?" It gives a history of the environmental changes since 1800 as a result of human disturbance. The social history of the area is described from the viewpoint of the social and cultural disturbances that led to the present day community conflict. The interface between the environmental and social history is then discussed. Semi-structured interviews were held with twenty eight members of the Hogsback community to solicit their views and perceptions of the WFW projects and the role of civil society and government in sustainable environmental management of invasive alien vegetation. Environmental and development plans undertaken for the Hogsback area were analysed. The results were then discussed in terms of the national and regional goals of WFW. The findings indicated that most of the goals of WFW have not met with great success in Hogsback. A number of limiting factors were identified, the primary one being community conflict, both within and without WFW. As the community struggles to address the aspirations of the landless and economically deprived black population while, at the same time, addressing the fears of the white population, the rapid rate of societal, governance and legislative change since the election of the democratic government in 1994 contributed to an environment of uncertainty. Within WFW, there are management problems that have limited the success achieved in clearing invasive alien species in the catchment. The lack of long-term strategic plans, sufficient accurate data and hands-on management are shortcomings in the local projects.
