A análise infere que há incompletude na primeira premissa e inconsistência na segunda, apresentando-se portanto a teoria elaborada pelo autor como não suficiente para seu propósito de servir de referência para as decisões jurídicas. Verifica-se, portanto, a existência de uma propensão ao engano tanto nas doutrinas jurídicas correntes quanto na própria tese de Dworkin, e o 'Gênio Maligno' do título refere-se à personagem fictícia e metafórica criada por Descartes, cuja função é justamente a de induzir-nos ao erro, numa clara referência aos equívocos conceituais que genericamente ocorrem na área da Justiça e do Direito / Abstract: This paper is designed to analyze the thesis produced by Ronald Dworkin in his book Law's Empire, where the author develops a theory of law that is based on the premises of (i) constructive interpretation of law texts and practices and (ii) moral, political and social integrity, and proposes that they are the best solution for the debate on the improvement of law doctrines. After an analysis, one can perceive that the first premise lacks completeness and the second consistency. Therefore, the theory set forth by the author is regarded as not sufficient to fulfill its purpose to be used as a reference for juridical decisions. One can identify that there is a tendency for inaccurate explanation of both current law doctrines and Dworkin's own thesis, while the Evil Genius in the title refers to a metaphor and fictitious character created by Descartes whose role is to induce readers to conceptual misconstructions as a reference to misinterpretations that usually take place in the areas of Justice and Law / Mestrado / Mestre em Filosofia

A critical analysis of equal remuneration claims in South African law

The legislation relating to equal remuneration claims is an area of law which is nuanced and consequently poorly understood. It has posed an unattainable mountain for many claimants who came before the South African courts. This is as a direct result of the lack of an adequate legal framework providing for same in the Employment Equity Act 55 of 1998. The case law recognises two causes of action relating to equal remuneration. The first cause of action is equal remuneration for the same/similar work. The second is equal remuneration for work of equal value. The former is easily understood by both claimants and courts but the latter is poorly understood and poses many difficulties. The aim of this dissertation is fourfold. Firstly, the problems and criticisms regarding equal remuneration claims will be briefly highlighted. Secondly, a comprehensive analysis of the current legal framework will be set out together with the inadequacies. Thirdly, an analysis of international law and the law of the United Kingdom relating to equal remuneration claims will be undertaken. This paper compared the South African concepts of pay equity and equal pay for work of equal value with those of industrialised countries, including the United States, the United Kingdom, Australia and Canada. The study considered how South Africa recognized the right to promote equal pay, in the absence of a proper legal framework which expressly includes such a right. The paper also focused on the impact of statutes and case law on the developments of equal pay in the aforementioned industrialized countries. It also considered the impact of the decisions of the European Court of Justice on such developments as well as it impact on the interpretation of equal pay in these industrialised countries. The purpose of such comparison was not to transplant the legal system of these industrialised countries but to assist South Africa in remedying its weaknesses by creating legal rules for the promotion of equal pay for work of equal value.

A clarification of the use of multiple regression analysis in meeting the burden of proof in compensation discrimination litigation

Thesis (MComm)--University of Stellenbosch, 2005. / ENGLISH ABSTRACT: The new set of employment equity laws call for South African organisations to justify their compensations systems. During compensation discrimination litigation, evidence is required to support arguments put before the court in order to meet the burden of proof. The similarity between foreign and domestic legal systems, suggests that the operational implications of foreign legislation will also be relevant to South Africa. This raises the debate as to the nature of fairness in the compensation context, the debate of comparable worth and the use of multiple regression analysis. The organisation must present to the court evidence to show that the choice of compensable constructs, their measurement and application does not discrimination directly or indirectly based on group membership. Multiple regression analysis, a statistical method to model the compensation system, is fraught with difficulties and misunderstanding. It is nevertheless the most appropriate method to investigate compensation fairness. Comparable worth and multiple regression analysis require assessment in the South African context. The issues, which hindered the successful use of multiple regression analysis abroad, are reviewed in order to smooth its entry into South African litigation. A framework is presented based on literature and case law whereby all parties concerned can produce and evaluate such evidence / AFRIKAANSE OPSOMMING: Die nuwe Anti-Diskrimineringswetgewing verlang van Suid-Afrikaanse organisasies om salarisstelsels te regverdig. Dit bevraagteken die aard van billikheid in die kompensasie konteks, die debat van vergelykbare waarde en die gebruik van veelvoudige regressieontleding. Die betrokke party moet bewys aan die hof toon om te bevestig dat die keuse van vergoedingskonstruksie, sowel as die meting en toepassing daarvan, nie onregverdig diskrimineer, ten opsigte van demografiese groepe me. Veelvoudige regressieontleding 'n statistiese metode wat gebriuk kan word om die salarissisteem voor te stel. Alhoewel dit vele onduidelikhede bevat, is dit steeds die mees toepaslike metode om salarisbillikheid te ondersoek. Vergelykbare waarde en meervoudige regressieontleding is in die Suid-Afrikaanse konteks geëvalueer. Die aspekte wat die sukses van die gebruik van meervoudige regressieontleding in ander lande verhinder het, is ondersoek en geëvalueer om die toekomstige toepassing daarvan in Suid-Afrika te vergemaklik. 'n Raamwerk gebaseer op literatuur en gevalle studies word voorgestel, waar al die betrokke partye sodanige bewys kan produseer en evalueer.

Fernando Fajnzylber foi um teórico do desenvolvimento latino-americano e o responsável pela construção do novo enfoque teórico da CEP AL para a década de 1990, que deu origem ao projeto cepalino de "transfonnação produtiva com eqüidade". The thread of his work has always been the search of ways for surpassing the obstacles to Latin American development as much as its everlasting social exclusion, which means the building of a whole new economic model - a less dependant and less excluding one, combining economic growth and social equity. Ris economic mode! proposal has been presented as an alterna tive to the neoliberal project for Latin America, placing itself over against region's theorists and political leaders who faced neoliberalism as something inevitable, joining its "hegemonic economic thought". Law enforcement in the South African Gold Mining sector : the nexus between company, environmental and equity law

Although the mining industry contributed to the development of the country by providing infrastructure and employment, it left a negative impact on the environment. To this end, various pieces of law were promulgated to limit environmental damage and hold those who pollute (Mining Companies / licensees) accountable. This research focused on two study sites namely Blyvooruitzicht and Grootvlei gold mines. Both mines underwent forced mine closure and their environmental liabilities remained unresolved. This study focused on important laws governing the South African gold mining sector, to form an understanding of these laws and to establish if these laws protect the environment sufficiently or not. The study included an overview of the current relevant legislative framework regarding mines, with the aim of identifying if there were gaps between Mining law, Company law, B-BBEE law (Equity Law) and Environmental law. This included an exploration of the interrelationships between the various pieces of legislation and the challenges relating to compliance and enforcement of these mentioned laws. Further to this, the research study investigated the requirements and responsibilities of the South African State, and directors of mining companies. The finding was that South African law with respect to mining companies needs minor adjustments, but the crux of the problem is a lack of effective implementation and enforcement by the State. There is ineffective administration of environmental quality control by the various designated National Government Departments. Recommendations made include the need for clear monitoring of compliance and enforcement of the environmental regulatory framework if there is to be successful mine closure in South Africa. In addition, the South African State Government could consider incentivizing compliance, that is, reward mining companies who uphold environmental law. Further to this the thesis suggest the elimination of any contradictions between the various legislations within the mining industry and stipulates that legislation must be read in conjunction with one-another if a robust legislative framework is to exist. / Environmental Sciences / M.Sc.
