No. of bitstreams: 0 Previous issue date: 2018-08-13 / The objective of the present study was to analyze the political participation of the foreigner in Brazil under the paradigm of human dignity after the federal Constitution of 1988. With the increase of migratory flows in the first decades of the 21st century, States have more and more to worry about the social inclusion and extension of fundamental rights to foreign residents within its territory. Brazil, following a nationalist tradition in its constitutions, still does not allow the political participation of foreigners in its elections. Therefore, taking the work of Hannah Arendt as a theoretical framework, while the migratory policies of the states do not allow the political participation of foreigners, the very human condition of these individuals is compromised. It is necessary to study this type of political citizenship as a way of realizing the principle of the dignity of the human person. The methodology of the research is basic, because it aims to generate new and useful knowledge about migration policies and citizenship from abroad; qualitative, since it does not require the use of statistical methods and techniques; exploratory, descriptive and bibliographical, elaborated from material already published, consisting mainly of national legislation and comparative law, national and foreign doctrine, journal articles, as well as data from official sources made available on the Internet. To deny the inclusion of foreigners in the political community of the countries where they live is to not fully recognize their human dignity. It is as if the political community formed by the corps of nationals constantly left these people vulnerable. Keywords: Human migratory flows. Migration policy. Alien political participation. / O objetivo do presente trabalho foi analisar a participação política do estrangeiro no Brasil sob o paradigma da dignidade humana pós-Constituição federal de 1988. Com o aumento dos fluxos migratórios nas primeiras décadas do século XXI, os Estados cada vez mais tem que se preocupar com a inclusão social e extensão de direitos fundamentais aos estrangeiros residentes dentro do seu território. O Brasil, seguindo uma tradição nacionalista em suas constituições, ainda não permite a participação política dos estrangeiros nas suas eleições. Portanto, tomando a obra de Hannah Arendt como marco teórico, enquanto as políticas migratórias dos Estados não permitem a participação política dos estrangeiros, a própria condição humana destes indivíduos fica comprometida. Necessário se faz o estudo deste tipo de cidadania política como forma de efetivação do princípio da dignidade da pessoa humana. A metodologia da pesquisa é básica, porque objetiva gerar conhecimentos novos e úteis sobre políticas migratórias e cidadania do estrangeiro; qualitativa, já que não requer o uso de métodos e técnicas estatísticas; exploratória, descritiva e bibliográfica, elaborada a partir de material já publicado, constituído, principalmente, de legislação nacional e de direito comparado, doutrina nacional e estrangeira, artigos de periódicos, bem como dados de fontes oficiais disponibilizados na Internet. Negar a inclusão dos estrangeiros na comunidade política dos países ondem residem é não reconhecer totalmente sua dignidade humana. No. of bitstreams: 0 Previous issue date: 2017-07-14 / This work has the general objective to examine the possibility of expanding the foreign policy interest in light of the de-colonial Theory of Human Rights, because of the need to rethink democracy, since the global order of the XXI century imposes a duty of hospitality, otherness , empathy, generosity and cooperation, which has been forgotten by most nations. Therefore, the aim is - given the lack of foreign policy representation throughout Western history and growth of migration flows because of natural disasters, economic crises and wars - to study the social, economic, political and cultural impacts of the foreign vote. Furthermore, it approaches the subject with a focus on interculturality, sovereignty, the theory of capabilities of Amartya Sen and Martha Nussbaum and UN Sustainable Development Goals, especially Goal 16 to at a later time discuss the models of political participation, particularly from the perspective of theory decolonial. Next, it is studied - before the growth of the migratory flow and the global order each comes more "interdependent" and "inter-frontier" - the need to re-found the Social Pact from the perspective of the New Latin American Constitutionalism, one of the facets being the de-colonial theory. In this regard, the fundamentals of political rights in the international legal order and in Latin American comparative law are discussed, as a basis for the empowerment of the foreign agency and regional integration through a decolonial theory of human rights. Finally, we aim to propose a model of inclusive, intercultural, human, cooperative and empathic political participation that will consecrate the decolonial theory in Brazil. In this bias, a detailed investigation of the historical perspective of voting and migration in Brazil, the panorama on Latin American integration, Brazilian migratory policies, and the old comparison of migration policy Law nº. 6,818 / 81), with the current one (Migration Law - Law nº. 13,445, May 24, 2017), on the arguments favorable and contrary to the foreigner's vote. And, in the last analysis, how the Proposals for Amendment to the Constitution hitherto presented are tools capable of concretizing the decolonizing thinking in Brazil. The methodology used was critical, empirical and descriptive-analytical, using bibliographical research and data from international organizations. KEYWORDS: Interculturality; Political Capacity; Sovereignty; Decolonial Theory; Voting of the Foreigner in Brazil. / Esta dissertação tem como objetivo geral examinar a possibilidade de ampliação da participação política do estrangeiro à luz da teoria descolonial dos Direitos Humanos, em virtude da necessidade de repensar a democracia, uma vez que a ordem global do século XXI impõe um dever de hospitalidade, alteridade, empatia, generosidade e cooperação, que tem sido esquecido pela maioria das nações. Para tanto, busca-se ¿ diante da falta de representação política do estrangeiro ao longo da história ocidental e do crescimento dos fluxos migratórios em virtude dos desastres naturais, crises econômicas e guerras ¿ estudar os impactos sociais, econômicos, políticos e culturais do voto do estrangeiro. Ademais, aborda-se o tema sob o enfoque da interculturalidade, da soberania, da teoria das capacidades do Amartya Sen e da Martha Nussbaum e dos Objetivos do Desenvolvimento Sustentável da ONU, em especial, o objetivo 16, para em momento posterior discorrer sobre os modelos de participação política, em particular, sob a ótica da teoria descolonial. Em seguida, estuda-se ¿ ante o crescimento do fluxo migratório e a ordem global cada vem mais ¿interdependente¿ e ¿interfronteiriça¿ ¿ a necessidade de refundação do Pacto Social sob a perspectiva do Novo Constitucionalismo Latino-Americano, cuja uma das facetas é a teoria descolonial. Nesse aspecto, aborda-se os fundamentos dos direitos políticos na ordem jurídica internacional e no direito comparado latino-americano, como embasamento a potencialização da agência do estrangeiro e a integração regional por meio de uma teoria descolonial dos Direitos Humanos. Por fim, almeja-se propor um modelo de participação política inclusiva, intercultural, humana, cooperativa e empática, que consagre a teoria descolonial no Brasil. Nesse viés, revela-se de suma importância uma investigação detalhada sobre: a perspectiva histórica do voto e da migração no Brasil, o panorama sobre a integração latino-americana, as políticas migratórias brasileiras, inclusive, com a comparação antiga da política migratória (Estatuto do Estrangeiro ¿ Lei nº 6.818/81), com a atual (Lei de Migração ¿ Lei nº 13.445, de 24 de maio de 2017.), sobre os argumentos favoráveis e contrários ao voto do estrangeiro. E, em última instância, tratar de como as Propostas de Emenda à Constituição até então apresentadas são ferramentas aptas a concretizar a pensamento descolonizador no Brasil. A metodologia utilizada foi de caráter crítico, empírico e descritivo-analítico, utilizando-se de pesquisa bibliográfica e de dados de organizações internacionais.
