A phenomenological study of how South African entrepreneurs experience and deal with ethical dilemmas

This research sets out to examine how entrepreneurs experience and deal with ethical dilemmas. An entrepreneur is defined as a person who creates something of value and assumes the risk of establishing and managing a business around it. An ethical dilemma comes about when the entrepreneur must choose between alternatives and where the morally correct choice is unclear. This may be due to conflicting personal values or loyalties, tensions arising out of the realization that the moral action is not in line with his self-interest, cross-cultural conflict, or moral ambiguity. Because of the nature of entrepreneurship, the entrepreneur typically lives with ever-present threats arising from limited resources, competition, and the risk of business failure. His actions must simultaneously ensure survival, maximize profit, limit risk, counter threats, optimize the use of resources, and reward him with a feeling of satisfaction. It is hardly surprising that conflicting priorities sometimes ensue. It is also widely believed that these entrepreneurial pursuits supersede the more general need to act in morally appropriate ways. This is a phenomenological study, based on interviews with seven entrepreneurs in established service-oriented ventures. They were asked to describe their business, any dilemmas they have experienced, how they were handled, and what challenges they experience as entrepreneurs in South Africa today. Using phenomenology as my vehicle for data collection and analysis, I sought to enter the lived-worlds of my participants to discover the essence of how ethical dilemmas are experienced in the entrepreneurial milieu. The study’s findings reflect that each entrepreneur has a distinctive world-view, which is represented by a complex mosaic of virtue ethics, deontology, utilitarianism and metaethical perspectives. The permutations are numerous, thus negating the possibility of typecasting entrepreneurs. Instead this research introduces the reader to aspects of entrepreneurial reality such as the complexity of cultural diversity, the freedom to limit the amount of personal energy given to business, and the existence of a more sensitive, searching inner soul beneath the apparent hard-nosed business-oriented public image. While examining entrepreneurial dilemmas in depth, this research introduces the dilemma drum as a tool to portray the argument form of any dilemma by making explicit the ethical component inherent in every business decision and facilitating its effective resolution in a non-prescriptive way. The findings identify certain individual characteristics of participant entrepreneurs that are unlike anything in the mainstream literature, dispelling notions of the entrepreneur as a societal misfit, an essential innovator with vision and flair, or a compulsive risk-taker, while confirming success as the key motivator rather than money per se, the importance of significant others, and the influence of culture and gender. They provide fresh insights into the psyche of the entrepreneur, which include: the existence of inner conviction - marrying the concept of goal-directedness with that of making a contribution to society; exercising the virtues in order to support a delicate balance between business and ethical imperatives; learning to respect energy flow; an alternative morality based on attracting and allowing benevolent or serendipitous events to happen naturally and redefining success as ‘being able to create what is needed as and when needed’; focusing one’s energy on the telos; developing a personal marketing formula suited to a culturallydiverse society; and the anxiety associated with being out-there on one’s own. The general statement, which is ultimately distilled from the seven situated descriptions, introduces a theory of entrepreneurial ethics that presents a new and different view of the lived-world of entrepreneurship, consisting of: Firstly, the key components of entrepreneurial success – having clear goals, energy, making a contribution to society, being connected, getting others on board, and work as an extension of self; secondly, what drives entrepreneurs – goal-orientation, sense of personal excitement, inner conviction, autonomy, and external recognition of success; thirdly, the entrepreneurial ethic – concern for credibility, commitment to service, contributing to quality of life; fourthly, the nature of entrepreneurial dilemmas - conflicting responsibilities, authenticity and credibility, risk and expansion, and awareness of diversity; fifthly, how entrepreneurs deal with ethical issues in their own distinctive ways – by holding fast to authentic virtues, bowing to community expectations, avoiding friction, adopting a ‘come-what-may’ or ‘what’s in it for me’ attitude, or pursuing a higher purpose where both parties benefit; sixthly, entrepreneurs’ world -views – beliefs, goals, ways of deriving satisfaction, virtuous behaviour; pen-ultimately, the challenges facing entrepreneurs in South Africa – overcoming the legacies of apartheid, containing crime, fostering an acceptable business ethic, and facilitating reconciliation between ethnic groups; and lastly, finding the power within – that illusive entrepreneurial spirit – self-reliance, looking beyond immediate obstacles, grasping opportunities, and understanding serendipity.

The moral psychology of human rights in South Africa

M.A. (Politics) / The human rights discourse is flawed in theory and practise. Despite this, it remains legally entrenched in the South African constitution and enjoys a high degree of rhetorical popularity. This thesis will suggest a theory that will explain the longevity of the human rights discourse based on its ability to open spaces for the development of political agency. This ability is derived from its essentially emotive nature as a discourse comprised of value judgments. The discourse is in turn shaped by the agents that are mobilized through human rights. Hence, human rights will be described as a dynamic, evolving system as opposed to the a priori, deontological facts that they have traditionally been conceived to be.

Strategies for promoting ethics within the SAPS

Corruption and unethical management is a legitimate global concern as it can have a direct and substantial impact on the longevity and the success of an organisation, and a country. As a result much attention has been given to unethical behavior and organisational ethical violations over the last decade. Recent events have indicated that ethics management is an organisational concern with mammoth implications for organisations. The aim of this study was to investigate the development of strategies for the promotion of ethics and the impact of unethical conduct on an organisation. A direct link exists between employee behaviour and the organisational environment. The desired ethical environment is negatively affected if the employees cannot distinguish between right and wrong and do not act ethically when confronted with ethical dilemmas. Proposed ethics strategies may also be impacted on by the unethical behaviour of the leadership of organisations, compliance with legislation and poorly managed ethics strategies. The main research problem in this study was to identify what strategies could be adopted to create an ethical culture within an organisation. To achieve this objective a model was developed, proposed and supported with literature and the research study. A research questionnaire was designed to obtain the relevant data that was distributed to previously identified respondents. The results indicated that the majority employees were of the view that the organisational environment and leadership was not ethical and that the majority of employees were not actively pursuing an ethical environment. Findings indicated that the majority of employees felt that contributing factors to achieve an ethical environment was present, but ethic strategies were ineffective and poorly managed. The proposed study model, when implemented successfully, would allow the organisation the effective application of ethic interventions.

An Afro-European communitarian ethic as a model for a private sector response to HIV/AIDS, with special reference to the King II Report on Corporate Governance for South Africa.

This thesis formulates and argues for a composite conceptual framework of ethics for strategic and sustainable corporate benevolence as a means of addressing HIV/AIDS in South Africa. The template consists of the following theoretical elements: modern virtue ethics, contemporary Western communitarian ethics, the African philosophy of Ubuntu and a feminist ethic of care. This template is applied to relevant pragmatic ends through the proposition that the King I I Report - as it explicitly advocates a universally communitarian and essentially African code of ethics for a business response to HIV/AIDS - offers a viable and valuable model to both understand and transcend the tensions between profits and caring in the post-apartheid era of the South African experience of the pandemic. Specific features of the thesis include contextual perspectives on the ethical variances of HIV/AIDS stigma and behaviour change, cached as the thought-form of " I and We" as opposed to "Us and Them", and the psycho-social linguistics of re-interpreting "the wounded other" as "the wounded us". This is drawn together conceptually in discussion around the individual in and of, rather than as opposed to, the community, stressing how the impact of the HIV/AIDS pandemic is compelling our society to integrate this reverence into our disposition and conduct. In the spirit of this Afro-European communitarian ethic, and to apply this postulated theory for a concrete social morality in the wake of HIV/AIDS, the thesis argues that there is an ethical role for businesses in restoring the balance between nurturing and selfinterest - an equilibrium that is essential for both human expression and human survival. Midwives's perception of ethical behaviour and professional malpractice in the labour units of Tshwane, Gauteng Province, South Africa

Aim: The purpose of this study is to establish midwives’ perception of ethical and professional malpractices in labour units and to enhance the awareness of ethical behaviour and professional practice by midwives. Design: A qualitative, exploratory, descriptive and cross sectional design was followed to explore the midwives understanding of and experiences of ethical practice and professional malpractices in Labour Units of Tshwane, Gauteng Province. A non-probability purposive sampling was used to draw a sample from midwives with two or more years of experience working in Labour Units. Data collection: Individual in-depth interviews using open ended questions were used to collect data. Interviews were recorded using an audio tape recorder, which was later transcribed verbatim. Data collection was continuous until saturation was reached with the eight (n=8) participant. Findings: the results of the study revealed that midwives do understand the ethical code of conduct. However, due to challenges such as shortage of staff; shortage of material resources; non-compliance of midwives to policies and guidelines; fear of decision-making; and lack of management support, all this makes ethical conduct more challenging. The ethical conduct of employees in maternity wards at selected public hospitals in the Western Cape, South Africa

Mini-thesis submitted in partial fulfilment of the requirements for the degree Master of Technology: Public Management in the Faculty of Business at the Cape Peninsula University of Technology 2014 / Maternity service in South Africa faces particular problems in the provision of care to birthing mothers. Violence and abuse have been reported and maternity death rates are high, being related to inadequate provision of care (Myburgh, 2007:29). Ethical conduct plays a significant role in service delivery in Midwife Obstetrics Units (MOU) in general. This is of particular importance since every patient, especially pregnant women, should to be handled with the utmost care, respect and dignity. The research problem emanates from nurses’ behaviour towards patients in MOU labour wards, where women continue to be victims of abuse. Ironically, it is regrettable that they are abused by those who are supposed to be their advocates. The objectives of the study were to assess if nurses in MOU labour wards conduct themselves ethically when dealing with patients, to determine the perceptions of patients towards nurses during child birth stages, as well as to examine factors in maternity wards that may influence a nurse’s performance when dealing with patients. The study adopted the quantitative research method to answer the research question and data interpretation was based on statistical analysis. This method was deemed to be the most effective for collection of a large quantity of data and numerical (quantifiable) data is considered objective. A Likert-type questionnaire comprising closed-ended questions was the measurement instrument. This was considered to least inconvenience nurses and postnatal patients to whom these questionnaires were administered. Answer choices were graded from 1 to 4, being strongly agree, agree, disagree and strongly disagree. The population comprised nurses and postnatal patients in MOUs in the Western Cape, South Africa. Consecutive sampling was conducted in two selected MOUs, being Michael Mapongwana (MM) and Gugulethu (GG), with 311 questionnaires being distributed to both nurses and postnatal Patients in these two facilities. The findings indicated that the ethical conduct of nurses in both MM and GG maternity wards was relatively good. However, some survey findings revealed some unsatisfactory gaps that exist in what both hospitals currently offer to patients in the areas of individual patient care, communication and baby security certainty. Furthermore, the findings indicated that a significant number of patients who chose to make use of MM and GG hospitals, are satisfied with the standard of service received during their stay. However, there were some discrepancies in terms of senior management service where excellence in the monitoring role emerged as being lacking. There is a need for improvement in the current levels of ethical conduct of nurses in both the MM and GG labour wards. These needs for improvement relate to working conditions, especially linked to the human resource (HR) function, leadership and management functions, and improved monitoring and control mechanisms.

Ethical leadership in the Limpopo Provincial Public Service of South Africa: an imperative for good governance

Since the inception of the province in 1994, the provincial government witnessed an alarming statistics of unethical behaviour within its echelons. The media reports is frequently dominated by negative news of ethical transgression within the province’s public institutions. The reports on fraud and corruption scandals ranges from conflict of interests which manifest itself through payment of ghost workers, tardiness, weak institutions, lack of accountability and honesty by senior and subordinate public officials. In 2011, some of the provincial government’s departments were placed under “Administration”, meaning the control of province by the National Treasury. The placement of the departments under administration confirms the public perception that the province is engulfed by ethical challenges which result to poor governance of the province. The findings from the study confirm that although the province attempted to put strategies to minimise acts of unethical behaviour in the province, there is still a concern of ethical transgression that is ongoing and unabated. The study adopted the mixed methodology research design for data collection. The senior public managers and subordinate public officials were sampled as the population for the study. The aim is to assess the pivotal role that senior public managers as leaders play in fostering the organisational performance, hence good governance through modelling behaviour. The findings of the study assist to respond to the concern of why transgressions of ethical conduct occurs despite progressive legislative frameworks were introduced to promote good governance. The ethical dilemmas experienced by ICU nurses and doctors include amongst other: freedom of choice, truth telling, distribution of resources and confidentiality. Purpose: The study sought to explore the ethical dilemmas experienced by healthcare professionals working in ICU, Vhembe district in Limpopo province. Setting: The setting of the study was Tshilidzini hospital, Vhembe district in Limpopo Province Methodology: A qualitative, explorative, descriptive design was used. The population was nurses and doctors working in ICU, Tshilidzini hospital, Vhembe district in Limpopo province. A purposive sampling was used to select the study sample, and the study hospital. Data was collected by means of Semi-structured, in-depth interviews. Data was analyzed using Tesch`s method. Ethical considerations were adhered to. Findings: Participants expressed ethical dilemmas related to lack of resources, unsuitable infrastructure, hospital policies and patient`s decision making. Recommendations: The study recommends better policies by government and critical care societies to help guide resource allocation for ICU services. The number of ICU beds must be allocated according to the population it serves, in-service trainings to be conducted on regular bases in order to equip ICU health care professionals with knowledge of ethics and skills of decision-making, an active ethics committee to be elected to assist ICU practitioners when they encounter ethically challenging situation. / NRF

A wide variety of factors word researched and several were found to impact the manager in this process of degeneration. The impact of the personal qualities of the individual were studied and also the impact of different management styles. Different leadership styles were described and the impact on the ethical management was researched. The organisational culture and the effect of the experience of the work environment were studied. Environment factors like the influence of the church, different ethical frameworks and the effect of capitalism and materialism were applied to the ethical and normative management process. The dichotomy and schizophrenic between the theory and the policies of normative management and the practices and operational management were postulated. A future perspective was defined and the principles of the process of change in organisations for the current timeframe were formulated. A very definitive shift were found in organisations to a paradigm were the focus is placed on relationships and integrity in these relationships. These relationships include all the different levels of relationships. It includes inter- and intra relationships of the manager. It includes the core relationship between the organisation and its employees. It also includes the relationship between the organisation and the society and the ecology. There is a shift away from success driven careers to a total life of significance. Within this lifestyle the focus are on balance between the working environment, personal life and family life. The leaders that succeed in making these changes in their personal lives and also their organisations are the truly visionary leaders. There are however a pattern of destructive ethical and normative degeneration amongst and especially South African managers present. This pattern is to the detriment of the organisations where these managers currently work. Managers and leaders in South Africa show an increasing lack of vision and motivation. The organisations that don't make the necessary changes and develop strategies and intervention processes will lose their leadership and managers to organisations that realised this vision. There are so many factors playing a role in this process, that a simplistic program for intervention will be unsuccessful. To successfully manage this intervention process in an organisation, the facilitator or change agent will need a proper insight into the different processes and will need process facilitation skills. Very few managers however got the ability or skills for this process. / AFRIKAANSE OPSOMMING: In hierdie studie is gekyk na die etiese en normatiewe degenerasie van die Suid Afrikaanse bestuurder. 'n Verskeidenheid van faktore is gevind wat die bestuurder impakteer in hierdie proses. Daar is gekyk na die individu as persoon, as bestuurder met die impak van verskillende bestuurstyle, die impak van leierskap en leierskapstyle. Die impak van die organisasie kultuur, asook die belewing van die werksmilieu is ondersoek. Omgewingsfaktore soos die invloed van die kerk, verskillende etiese raamwerke en ook die effek van kapitalisme en materialisme is gestel teen die agtergrond van etiese en normatiewe bestuur. Die digotomie en skisofrenie tussen die teorie en beleid van normatiewe bestuur is gestel teenoor die operasionele bestuur en belewing van die praktyk. Daar is toenemend 'n gebrek aan visie en dus ook motivering. Organisasies wat nie doelbewuste strategieë en intervensies in plek gaan stel om hierdie verskuiwinge te bewerkstellig nie, gaan hul leierskap afstaan aan organisasies wat hierdie verskuiwinge gemaak het. Uit die studie blyk dit ook duidelik dat daar so 'n wye veld van faktore is wat 'n rol speel in hierdie proses, dat dit moeilik is om 'n simplistiese program van intervensies te formuleer. Om hierdie organisasie veranderinge suksesvol te bestuur, is begrip van die prosesse betrokke en proses fasilitering vaardighede nodig. Min bestuurders het egter hierdie insig en vaardighede.
