Överenskommelse om ersättning vid markåtkomst : Hur nya regler i expropriationslagen påverkat ersättningsnivån för att träffa frivilliga avtal

För att tillgodose allmänhetens behov av vägar, kraft- och vattenledningar med mera, får mark tas i anspråk. Expropriationsändamål och ersättningsbestämmelser för att tvångsvis ta mark i anspråk, finns stadgat i Expropriationslagen (SFS 1972:719). Genom århundraden har kritik framförts mot höga kostnader för att få åtkomst till mark vilket motiverat sänkningar av ersättning för mark. År 2010 genomfördes ändringar i ersättningsbestämmelserna som syftade till att höja markersättningen. Förhandlingar ska alltid föras vid markåtkomst för att eftersträva frivilliga uppgörelser. Syftet med denna studie var att undersöka hur ersättningshöjningar i lagen har påverkat ersättningsnivån för att träffa frivilliga avtal. Undersökningen skulle även påvisa vilka rättsekonomiska konsekvenser som följt av lagändringen. Kvalitativa intervjuer genomfördes med ett fåtal personer som besitter stor erfarenhet inom markförhandling och god kunskap om ersättningsregler. En enkätundersökning utfördes för att få ett större underlag till vissa frågor i studien. Resultatet visade att kostnader för att ta mark i anspråk har ökat. Förhandlingsutrymmet för att nå frivilliga uppgörelser har minskat en aning men möjligheten att träffa frivilliga avtal har emellertid inte blivit sämre. Slutligen konstaterades att det vid vissa markintrång fordras att extra ersättning, utöver lagstadgad ersättning, utgår för att nå en frivillig uppgörelse. Extra ersättningen utgör vanligen 5-10 procent vilket är en minskning sedan lagändringen 2010. / There is a possibility to compulsory acquire land and rights to land in order to meet the need for public interests, for example infrastructure projects. According to the Expropriation Act, property owner who is forced to surrender land should be compensated. For centuries the principles determining compensation have been questioned. This finally led to a development of new legislation in 2010. To conduct a negotiation, voluntary agreements are desired. The purpose of this thesis was to explore how the increased compensation has affected the level of compensation in voluntary agreements. The study was also made to investigate the legal economic consequences that followed by the amendment. Qualitative interviews were conducted with a few people who had experience in land access and good knowledge of voluntary agreements. A survey was conducted to gain a better knowledge for certain questions in the study. The results showed that the cost of land access has increased. The scope for voluntarily negotiations has decreased slightly, but the opportunity to meet voluntary agreements has not deteriorated. The conclusion of this thesis was that it required an extra negotiated compensation for land access, other statutory compensation payable to reach a voluntary agreement. Extra compensation usually represents 5-10 percent, which is a decrease since the legislation in 2010 was settled.

Land Rights and Expropriation in Ethiopia

This study examines and analyses the expropriation laws and practices in Ethiopia. The objective of the thesis is to analyze and describe the land rights and expropriation laws in Ethiopia and to compare them with the practice in order to determine the fairness of compensation. The study is made against the Ethiopian Constitution and other subsidiary legislations which provide the basic land rights and the nature and details of expropriation. The basic argument made in this thesis is that even if the Ethiopian Constitution provides and guarantees common ownership of land (together with the state) to the people, this right has not been fully realized whether in terms of land accessibility, enjoyablity, and payment of fair compensation in the event of expropriation. The reasons have to do either with the faulty nature of the laws or with their implementation by public authorities. From the outset, the constitution excludes land as a subject of compensation. For this reason, land is being excluded from the compensation package and hence it has no value for the holder. Urban land holders are denied location value of their property, which they can collect it otherwise during sale, and hence the compensation becomes unfair. Similarly, rural farmers are denied compensation for the complete loss of their farm land. The denial of compensation for the value of the land is categorically in contradiction with the very principle of joint ownership of land by the people and the state. There are also other reasons which are related to the law or its practical applicability, such as valuation process which reduces the amount of compensation. There are also property interests which are not included as compensable interests. Payment of compensation is one factor for secure property right and hence sustainable development. To ensure fair compensation in the event of compensation, a legal and policy level reform is necessary to address and amend the existing problems. Further, to harmonize the laws and practices is imperative to reduce the amount of injustice existed in today’s expropriation procedure in Ethiopia. / <p>QC 20131122</p>
