A investigação científica buscou resposta para o seguinte problema: O protesto extrajudicial de certidão de dívida ativa pode ser utilizado como forma de acesso à justiça visando maior efetividade na satisfação do crédito fiscal? Para responder a essa questão, utilizou-se o método dialético por meio da pesquisa exploratória e bibliográfica. A dissertação traz em seu primeiro capítulo o direito fundamental do acesso à justiça, contextualizando a garantia do direito à efetividade. Prossegue discorrendo sobre a crise do Poder Judiciário no Estado Democrático de Direito e se a extrajudicialização pode ser entendida como mecanismo de acesso à ordem jurídica justa. O segundo capítulo explica o que é a dívida ativa, a composição da certidão de dívida ativa (CDA) e transcorre analisando o processo de execuçao fiscal bem como a crise em que se encontra atualmente. No mais, trata da possibilidade de utilização da extrajudicialização da cobrança de créditos fiscais como forma alternativa para a arrecadação dos créditos fiscais de maneira mais efetiva, explanando sobre a divergência doutrinária quanto à utilização do protesto extrajudicial de CDA. O último capítulo analisa o protesto extrajudicial de certidão de dívida ativa como mecanismo utilizado para a arrecadação do crédito fiscal bem como explica sua relevância no que diz respeito à efetividade na aplicação do procedimento extrajudicial. Por fim, compara-se o processo de execução fiscal, que é o meio tradicional de cobrança de crédito fiscal, e o protesto extrajudicial de certidão de dívida ativa no que tange à efetividade desses mecanismos de cobrança, contemplando o custo, o tempo e o percentual de arrecadação dos dois procedimentos. Finalmente, constatou-se que a forma de extrajudicialização da cobrança de créditos fiscais utilizando o protesto extrajudicial de CDA tem maior efetividade garantindo acesso à ordem jurídica justa, buscando uma justiça social. / This dissertation aimed to research a mechanism that would allow better access to the courts of justice for tax credit recovery, using a faster and more efficient way than the existing legal system in current form. This scientific study tried to answer the following question: extrajudicial protest regarding the certificate of outstanding debt can be used as a means of access to the courts, seeking greater celerity and effectiveness in satisfying tax credit? To answer this question, we used the dialectical method, through exploratory and bibliographic research. The first chapter discusses the fundamental right of access to justice. It contextualizes the guarantees of the right of effectiveness and procedural celerity. Subsequently, the chapter discusses the crisis of Judiciary in a democratic rule of law. It also observes the universal movement of justice access and if extra legalization can be understood as such a mechanism of courts access. The second chapter explains what are the outstanding debt and the composition of the certificate of outstanding debt. It also examines the process of tax enforcement and the crisis in which it finds itself actually. In addition, the chapter discusses the possibility of using extra-legalization for tax claims recovery. It would be an alternative way to tax credits collection in a more effective manner, explaining on the doctrinal divergence as the use of extrajudicial protest procedure on certificate of outstanding debt. The last chapter analyzes extrajudicial protest of outstanding debt certificate as a mechanism used for the collection of tax credit. It also explain the relevance with respect to the celerity and effectiveness in the implementation of extrajudicial procedure. The chapter makes a comparison between the process of tax enforcement, which is the traditional way of collecting tax credit, and the procedure of extrajudicial protest certificate of outstanding debt. All this relates to the effectiveness of these collecting mechanisms, contemplating the cost, time and the percentage of collection of both procedures. Finally, it notes that the form of extra-legalization of tax claims recovery using extra-judicial protest certificate of outstanding debt has greater effectiveness ensuring access to fair legal order, seeking a social Justice.

In the quest for rationalization of civil procedure, having been identified as the extrajudicial execution process , especially for collection of the debt of the Union, the States, Federal District and municipalities, it is one of the main bottlenecks in the length of civil proceedings, we treat, at this work, the possibility of non-judicial procedure for the collection of the credit embodied in extrajudicial titles and its compatibility with existing principles / A presente Tese de Doutorado está inserida na linha de pesquisa de efetividade do Direito Privado e Liberdades Civis, no núcleo de pesquisa em Direito Processual Civil. O trabalho analisa a constante histórica introdução de meios estabelecidos na busca por efetividade na solução de litígios através de procedimentos alternativos sem deixar de lado a garantia máxima de acesso pleno ao Poder Judiciário. Na busca pela racionalização do processo civil, tendo sido identificado que o processo de execução de título extrajudicial, principalmente para cobrança da Dívida Ativa da União, dos Estados, do Distrito Federal e dos Municípios, é um dos principais gargalos da morosidade do processo civil.
