The purpose of my thesis is to explore and discuss interrogation tactics. Interrogation tactics is a concept that includes various methods used by interrogators to reach the goal of the interrogation, which is true and full testimony. Considering the extent of the topic, I am focusing more closely on the techniques used for the purpose of overcoming false testimony. The thesis is composed of nine chapters. In the opening chapters I explain the concept of interrogation from three perspectives - from the perspective of criminology, psychology and law. These chapters also describe different types of interrogation, as well as the process of documentation and the process of formation of testimony. The fifth chapter recognizes the issues of the preparation phase and its division into analytic and synthetic part. In this chapter I also emphasize the importance of expert and thorough preparation in order to ensure a successful interrogation. The sixth chapter presents three consecutive phases of interrogation, which are the initial phase and the phases of monologue and dialogue. This is the construction of interrogation that affects individual tactical methods. This thesis is devoted to interrogation, detection of lies and tactics of overcoming them. Large part of this work is devoted to ordination of findings of criminology and forensic psychology on this issue. These findings are complemented by practical examples. Important part of this thesis consists of an analysis of real interrogation with a demonstration of possible practical applications of the lie detection techniques and the tactics of overcoming false testimony. The introductory chapter of the thesis is focused on general theoretical analysis of interrogation, with an emphasis on the legal side of things. Very important part of the process of overcoming false testimony is the lie itself, to which the second chapter is devoted. The impact of usage of interrogation tactics on the interrogated in order to overcome the alleged false statements is related to the issue of false confessions and self-incrimination, because interrogator's real task is not to obtain the testimony he wants to hear, but to obtain a just and truthful testimony. The tactical methods of overcoming the false testimony Abstract The objective of this thesis is to describe and analyse the false testimony at interrogation, its recognition and follow-up overcoming by means of tactical interrogation methods and other techniques. In the introductory part of the thesis, the elemental concepts such as the phenomenon of lie, interrogation and testimony are defined in order to gain some insight, without which it would not be well possible to dedicate to the research of detection of lie and its overcoming. The following part deals with the lie detection in crime investigation in particular, it highlights the importance of correct identification of false testimony and it pursues the lie from perspective of the recipient of lie, whose interest is to reveal the lie. The particularities in this area regarding children are outlined as well. The subsequent part is focused on the false testimony and its detection based on the verbal, nonverbal and paraverbal tokens in conduct of concerned person. Une condamnation pénale définitive ne peut en principe plus être remise en cause. La chose jugée doit en effet être tenue pour vraie. L’adage non bis in idem et les principes de l’autorité et de la force de la chose jugée semblent dès lors interdire de rouvrir le procès pénal. Toutefois, le législateur français prévoit deux procédures distinctes permettant de remettre encause la condamnation prononcée : la révision et le réexamen. Les conditions de mise en oeuvre de ces procédures et leurs spécificités en font des procédures très exceptionnelles. Par la présentation d’éléments nouveaux de fait pour la révision, et de droit pour le réexamen, le requérant peut dans certains cas prétendre à nouvelle étude de son affaire. Cependant cette réouverture ne pourra être décidée que par une juridiction ad hoc et sera de type différent selon le nouveau procès envisagé. De plus, l’issue de ce nouveau procès pourra permettre de maintenir la condamnation en dépit des nouveaux faits présentés ou reconnaître l’innocence du condamné. / Final sentencing in a criminal trial cannot in principle be questioned any more. Indeed the adjudged case has to be considered as definitely settled. The non bis in idem Latin saw and the res judicata tenet thus seem to preclude the re-opening of a criminal trial. And yet, lawgivers put in place two distinct legal processes that enable French citizens to challenge their sentencing: reviewing and re-hearing. The conditions for carrying out these processes and their own specifities make these proceedings quite exceptional. Through the presentation of new evidence for reviewing, and because re-hearing can be considered as of right, convicted people may in some cases get a new trial. Nevertheless only an ad hoc jurisdiction can decide upon a new hearing and the latter will be of a different kind depending on the new trial at hand. Moreover, the upshot of this new trial will make it possible either to maintain the sentencing notwithstanding new evidence being presented to a new court or to declare the defendant not guilty.
