La renégociation du contrat est un mécanisme qui permet de sauvegarder le contrat lorsque celui-ci devient déséquilibré du fait de circonstances nouvelles. Ce déséquilibre, parce qu'il affecte l'une des parties, met en péril la pérennité de la relation. Le droit public l'a depuis longtemps admis. A contrario, le droit privé a toujours refusé d'accueillir la correction du contrat au nom du principe d'intangibilité prévu à l'article 1134 alinéa 1er du Code civil. Sa mise en œuvre ne peut alors résulter que d'une prévision contractuelle. Pourtant, le principe de bonne foi prévu à l'alinéa de ce même texte, ayant pour corolaire l'obligation de coopération et de collaboration, encourage cette reconnaissance. Admettre légalement le droit à la renégociation du contrat devenu déséquilibré ne peut pas être attentatoire aux principes de force obligatoire et de sécurité juridique. Le droit à la renégociation repose sur la liberté contractuelle : les parties doivent pouvoir entrer en renégociation mais elles gardent toute leur liberté quant à l'expression d'une volonté d'adaptation du contrat aux circonstances nouvelles de son exécution. Le droit à la renégociation du contrat doit être un mécanisme d'atténuation de l'intangibilité du contrat. Le droit supranational admet cette théorie : on la retrouve dans de nombreuses dispositions en droit communautaire et en droit international. De même, les projets de réformes nationaux du droit des contrats font tous référence à cette théorie qu'ils accueillent à l'unanimité. Il appartient aujourd'hui au législateur de mettre fin à cette particularité française fondée sur l'arrêt du Canal de Craponne, et accueillir cette théorie afin de redonner toute son efficacité au contrat, qui demeure l'outil fondamental des échanges économiques. / Renegotiation of the contract is a mechanism that allows you to save the contract when it becomes unbalanced due to new circumstances. This imbalance, because it affects one of the parties, jeopardizes the sustainability of the relationship. Public law has long been recognized. By contrast, private law has always refused to accept the correction of the contract on behalf of the principle of inviolability under Article 1134 paragraph 1 of the Civil Code. Its implementation can then result from a contractual forecast. <p>Discharges of warfare bio aerosol clouds are powerful weapons in war and terror situations. A discharge of a small amount of a contagious substance can obliterate large areas. The discharges can usually not be seen with bare eyes, hence some tool needs to be used to find bio aerosol cloud discharges. One way is to use a lidar for the detection of clouds. By sending out a laser pulse into the atmosphere some of the light is scattered back. By measuring the backscattered light, the aerosol structure of the atmosphere can be obtained. If a cloud is hit by the laser beam, an increase of light is observed and the cloud can be detected and tracked.In this thesis a tool for simulating the elastic backscattered light has been developed. A graphical user interface for easier handling has also been developed. For automatic detection of clouds some detection algorithms have been tested. Another graphical user interface for presentation of the simulated lidar signals has also been constructed.The simulator is working well. A lot of different parameters can be changed for the lidar system, the atmosphere and the cloud type. The model works as a helpful tool for specifications of an elastic lidar system to be developed and also as a guide for expected system performance and ways to present the results.</p>

Le but de cette recherche est de décrire le processus d'intégration des apprentissages chez l'adulte et d'identifier les conditions qui le facilitent en contexte informel. Dans un monde en mutations, l'intégration des apprentissages constitue une réelle préoccupation. Pour les adultes aux prises avec différents rôles et responsabilités, apprendre est une nécessité et intégrer, un incontournable. Jusqu'à présent, les travaux ont davantage mis l'accent sur des stratégies à mettre en place de la part des intervenants pour faire intégrer, mais le point de vue de la personne apprenante pour intégrer demeure peu exploré. La présente recherche-action s'y intéresse, à travers la quête d'intégration vécue par des adultes qui veulent intégrer foi et vie. Leur désir de vivre une plus grande cohérence entre leur foi et leur vie les incite à trouver des moyens plus efficaces. Ce cas particulier d'intégration permet de saisir le processus d'intégration des apprentissages des adultes dans un contexte informel. Pour bien ancrer le projet, la notion d'intégration se fonde sur quatre caractéristiques, à savoir le rassemblement d'éléments, l'interaction entre ceux-ci, la formation d'un tout cohérent et le choix d'une direction et celle plus spécifique d'intégration des apprentissages, s'inscrit dans une conception systémique du processus. Pour suivre l'évolution du processus d'intégration foi et vie et apporter des changements significatifs à la situation vécue par le groupe d'adultes, le choix méthodologique privilégié a été la recherche-action communautaire de Stringer (1996, 2007). Celle-ci s'est déroulée dans une série de onze cycles de trois temps marqués par l'observation, la réflexion et l'action. Les résultats présentent les changements survenus qui ont conduit les membres vers la situation souhaitée. Un regard sur le processus d'intégration foi et vie des membres a permis d'y découvrir différentes voies pour intégrer et des conditions ayant favorisé le processus. Ainsi, ces résultats apportent un éclairage nouveau sur le processus d'intégration des apprentissages des adultes et des façons d'intégrer. Pour assurer le déroulement de ce processus, des conditions telles que porter le désir d'intégrer, avoir des lieux et se donner du temps méritent d'être prises en considération.
