15. ABSTRACT The topic of my Master's degree thesis is Distinctions in the legal status of citizens and foreigners in the Czech Republic. Reasons for choosing this topic are the proximity of the topic for me as for a former foreigner, own experience and the fact, that this topic is very current and dynamic. This thesis mainly describes the legal status of citizens and foreigners in the Czech Republic. In my thesis I have therefore focused on the rights and duties of citizens and foreigners, the conditions and forms of acquisition citizenship and particular residence permits. The thesis is composed of ten chapters. First chapter is the Introduction and last chapter is the Conclusion. The other eight main chapters deal with the main aim of the thesis. There are also the Content, the Index of Abbreviations, the Used bibliography and sources and the Index of Annexes beside these ten chapters. The first chapter following the Introduction describes the concept of citizenship, it's sources of law, forms and terms for the acquisition of citizenship, it's attestation and discovery and finally the legal status of a citizen. This thesis explains basic concepts associated with immigration, theories of migration and basic models of immigration policies. It deals with historical continuity, legislature and trends in the sphere of international migration in Europe. Than it is engaged in historical continuity of immigration to the Czech republic, state policy of the Czech republic in the sphere of migration, legislature and its historical changes and instruments for attracting of immigrants to the Czech republic. The thesis analyses development and present condition of international immigration to the Czech republic, number of immigrants, citizenship, purpose-of-residence, age structure, economic activity and spatial allocation on territory of the Czech republic. Furthermore, it focuses on economics and demographics impacts of immigration. This thesis realizes situation in the Czech republic and in its individual regions. At the conclusion it interprets and resumes results.

ABSTRACT: In our thesis, we deal with the topic of multicultural education. We do not opt for the social sciences perspective, though, but choose philosophical angle, instead. Methodologically, we base on the phenomenological-hermeneutical approach. It means that we do not base our questioning on predefined terms but only aim to search for them. Our questions yet focus on face-to-face relationship with the other-foreigner. We especially deal with intersubjectivity concepts of E. Husserl, B. Waldenfels, E. Lévinas, M. Buber and J. Patočka. We try to define basic conditions of mutually rewarding dialog which at the same time would not be flat but kept its depths. Although our approach is theoretical, we try to enroot our results back into practice all the way though by giving variety of practical examples. By "religion" we then mean the effort of really giving oneself into dialog instead of just theorizing about it. The courage to let oneself really disturbed by the other, even though there is a risk of losing something important. Právní úprava podnikání cizinců v České republice a Itálii: srovnání / Legal regulation of undertaking business by foreigners in the Czech Republic and Italy: a comparison

I chose the topic of comparing the legal modifications of the business activities of foreigners because I consider this topic "a starting point" for the comparison of other areas of law, for example, insolvency law, company law, labour law etc. I chose the comparison with Italian law mainly because I am a graduate of FF UK (Philosophical Faculty of Charles University), specialization in germanic-romance languages and from 1996 I have been a legal translator in both Italian and German. For maximum clarity I have divided the entire work into three parts - History, Concepts and Current legal modifications. Further, I have systematically divided these parts into chapters in order that any interested individuals could easily orient themselves in the work. Many differences can be found in the current legal modifications of both countries, however, since both countries are under the influence of community law the differences are not so distinct. I consider the most significant difference in the legal modifications of both countries to be that the Czech Republic has set out in the European direction as late as the nineties due to historical and political reasons. La question de la relation entre nationaux et étrangers en droit public connaît un certain nombre de mutations caractérisées par un apparent rapprochement des deux statuts juridiques et par leur définition. La question est bien celle de la place que le droit public peut ou doit accorder à ceux qui vivent au sein de l'État mais n’en possèdent pas la nationalité et donc celle de l’actuelle signification donnée au lien de nationalité en droit public français. Cette signification semble dépendre à la fois du mode de distinction entre les concepts de national et d’étranger, c'est-à-dire de l’exercice de la souveraineté de l'État dans ce choix, et des statuts qui leur sont ensuite attachés en tant qu’ils sont liés par un élément primordial : la présence sur un même territoire. Ainsi, l’étranger, s’il n’est pas attaché à l'État par le lien de nationalité, est tout de même soumis au pouvoir étatique du fait de sa présence sur le territoire de l'État. Le droit relatif à la nationalité et à l’extranéité est avant tout un droit d’exclusion et de restriction qui conduit à reconnaître à l’étranger moins de droits qu’au national et qui codifie cette différence. Mais ce droit est aussi, en parallèle, un droit d’intégration car il définit un statut de l’étranger dans l'État où il réside et en fait un sujet du droit de cet État. L’enjeu d’une étude des relations entre « nationaux » et « étrangers » est donc de questionner l’actuelle distinction juridique des deux concepts. Il s’agirait ainsi à la fois de réconcilier en la matière les deux expressions du pouvoir étatique : le pouvoir de commandement unilatéral fondé sur la contrainte et la conservation de l’autonomie et de la liberté reconnue à l’individu dans la société, et d’assurer l’équilibre entre une nécessaire différenciation des statuts, en raison de l’existence d’une communauté nationale qui fonde le pacte constitutionnel et qui est à distinguer de la simple société civile, et le respect des libertés individuelles au sein de l'État. / The issue of the relationship between nationals and foreigners in civil law is undergoing a number of mutations characterised by an apparent convergence of the two judicial statuses and by their redefinition. The issue is indeed that of the place which civil law can or must grant to those who live in the State but do not possess the nationality there of and that of the current significance given to the status of nationality in French civil law. This significance seems to depend simultaneously on the mode of distinction between concepts of national and foreigner, i.e. the exercise of State sovereignty in that choice, and the status they are then granted, inasmuch as they are tied by a primordial element: presence on the same territory. Thus, the foreigner, if not attached to the State by a tie of nationality, is nonetheless subject to state power by his or her presence on State territory. Logically, the relative right to nationality and foreignness is primarily a right of exclusion and restriction which leads to granting the foreigner less rights than the national and which codifies this difference. But this right is also, at the same time, a right of integration as it defines a status for the foreigner in the State in which he or she lives, making the foreigner subject to the law in that State. The concern of a study of the relations between « nationals » and « foreigners » is therefore to question the present judicial distinction of the two concepts. It will thus be necessary to reconcile the two expressions of state power: the power of unilateral command founded on constraint and conservation of autonomy and the freedom given to the individual in society, while maintaining the balance between a necessary differentiation of the statuses, by reason of the existence of a national community which establishes the constitutional pact, which is to be distinguished from simple civil society, and the respect for individual freedoms in the State.

This thesis describe the Czech immigration policy from 1989 to the present. The thesis is divided into theoretical and practical part. The theoretical part explains the basic concepts of migration and theoretical approaches to migration. There is also explained the impact of migration on the economy of countries In the practical part is analyzed one of the objectives of the work which relates to the development of immigration policy in the Czech Republic and their effects on selected economic indicators. Further details are described and evaluated projects most active migration policy. The last part, which brings the greatest added value, is the recommendation for Czech immigration policy. This recommendations are changes in the legislative framework of existing projects and sales of long-term visas.

Zahraniční migrace v České republice a její specifické rysy / International migration in the Czech republic and its specific aspects

This thesis provides an overview of the development of international migration in the Czech Republic to determine the aspects affecting migration. The Czech Republic has become a destination country for many immigrants, not only from the European Union, but also from countries outside the European union. The main goal of this paper is to outline the development of migration movements in the Czech republic before 1989 and in the context of legislative and methodological changes that occurred after 1989. The paper also describes the changes in international migration movements between 2002 -- 2012 in the Czech Republic, Hungary, Poland and Slovakia. These countries belong to the alliance called the Visegrad four. In recent years, they became a new place of migration flows, particularly from countries with less developed economies. The aim is to determine the evolution of selected indicators of migration to identify connections between the selected countries given to their common historical and legal aspects.

The diploma thesis is divided into theoretical and practical part. It deals with preschool education and foreigners in the Czech republic within its theoretical part. It focuses on the education of foreigners in the Centre for Preschool Children (CPD) in a children and youth centre of the capital city Prague, DDM hl. m. Prahy. Theoretical knowledge is applied in the practical part. The practical part of the thesis approaches the reality of foreigners' education in CPD in DDM hl. m. Prahy through seven case studies. The main aim of the thesis is to analyse the specifications of working with children of different cultures in CPD. The aim of the thesis is to introduce ways of teaching other cultures in CPD. The application aim of the thesis is to help pedagogues of the Centre for Preschool Children in DDM hl. m. Prahy work with children of other cultures and help them be better prepared for situations that may occure. The outcome of the thesis is a recommendation for working with particular children in CPD. The thesis gives basic orientation in the topic of education of foreigners in the Centre for Preschool Children in DDM hl. m. Prahy and can be extended.

The diploma thesis " Violence as a part of migrants' experience and the possible solutions of it" deals with the issue of violence committed against migrants during their stay in the Czech Republic. The aim of the work is to identify the most common types of violence that foreigners encounter with during their stay, to examine existing methods for solving the problem and to present own proposals for solving the problem from the perspective of a migrant living in the Czech Republic. The theoretical part defines the concept of violence and focuses on its division. A significant part is devoted to the description of the current system of assistance to migrants in today's Czech Republic. The experience with the integration of foreigners in Western European countries is also described in this part. The practical part of the thesis is focused on the existing types of violence with which migrants in the Czech Republic most often encounter. The research is performed using qualitative data analysis. The group of respondents consists of five migrants living in the Czech Republic, who have not obtained the Czech citizenship yet.
