Le traitement juridique de la procréation est volontiers présenté, en France et en Allemagne, comme servant à limiter les dérives, à garantir les valeurs fondatrices de la société tout en assurant la protection du corps humain, de la personne et de la dignité humaine. Cet encadrement apparaît comme nécessaire pour lutter contre les abus que la consécration d’une liberté procréative rendrait possibles. Mais est-ce réellement le principe de protection de la vie et de la personne qui constitue le paradigme principal du droit de la procréation ? En prenant notamment pour cadrage théorique les réflexions de Michel Foucault et de Giorgi Agamben sur la biopolitique, il apparaît que ce n’est pas la protection de la vie biologique, zoe, la vie nue, c'est-à-dire le seul fait de vivre, commun à toutes les espèces vivantes, que l’État entend protéger mais seulement certaines de ces formes : la vie bonne - c'est-à-dire la vie bonne, celle qui est axiologiquement et politiquement significative. Les diverses réglementations du champ procréatif - contraception, avortement, procréation médicalement assistée et gestation pour autrui - entendent mettre en œuvre des processus de normalisation de la vie, particulièrement visibles en ce qui concerne la famille et le handicap physique et mental. / How Law addresses procreation is often presented, both in France and Germany, as a way to limit abuses, to guarantee founding values of the society while ensuring at the same time the protection of the human body, the human person and its personal dignity.This legal framework seems to be necessary to prevent any abuse that may arise from procreative freedoms’ enshrinement.The question is thus the following : Is this principle of protection really constitutive of the main paradigm of reproductive rights ? Is the protection of life and of the human person the base of this paradigm ? Taking Michel Foucault’s and Giorgi Agamben’s work on biopolitic as a theoretical frame, it seems that the State does not intend to protect zoe (biological life), the « bare life », i.e. the simple fact of living, encompassing all living species.It appears that the State aims to only protect some forms of life : the « good » life, i.e. the life which is meaningful both axiologically and politically.Via various regulations on procreation - birth control, abortion, medically-assisted procreation or surrogate motherhood - the State implement processes that lead to normalize the life per se. These processus are especially visible when relate to the family as well as physical or mental disability.

The stakes of mimesis : tracing narrative lines in the works of E.T.A. Hoffmann and Honoré de Balzac

My project offers a set of comparative close readings of texts by E.T.A. Hoffmann and Honoré de Balzac. Balzac’s early fiction, I contend, grapples with questions relating to the representational practice of mimesis through an explicit engagement with Hoffmann’s work. Hoffmann’s fiction, in turn, proves itself repeatedly to contain the traces of a proto-realist tendency, through its playful interventions into the staging of narrative creation. The contribution of my project to scholarship is twofold. First, it offers comparative readings of texts that have not yet been drawn together, hoping to re-adjust the common ascriptions of ‘Romanticism’ and ‘Realism’ to Hoffmann and Balzac respectively, and to identify a new complication in the relationship of those generic categories. Second, it articulates a new account of mimesis. By drawing on the work of twentieth-century theorists such as Erich Auerbach, Walter Benjamin and Merleau-Ponty, it shows that ‘mimesis’ refers not merely to the imitation of an object, but rather to the reproduction of a particular sensory experience of that object. This perspective on mimesis allows me to unfold new readings of the two authors. How is life compromised in the name of fiction, of the artwork? This question recurs compulsively in Hoffmann’s tales, figured in repeated and near-repeated scenarios in which the everyday is pitted against an ideal or delusional alternative. When Balzac imitates or repeats this mimetic question in the works I consider, it is invariably figured in the image of Hoffmann, called upon as a fictional co-author or authorial double, or as a para-textual element, often in highly visual terms. The thesis thus addresses what I have come to term the ‘stakes of mimesis’. If a particular compromise, or particular stakes, are involved in the creation of fictions, for Balzac those stakes are drawn in distinctly Hoffmannesque terms. The thesis is structured according to the conviction that the relationship between the two writers is not simply a linear one of filiation or influence, but one led by a more complicated sense of imitation. To this end, I take to task the conventional figure of the narrative ‘line’ and follow it through various Romantic and modernist complications. My first chapter, ‘Chiasm’, works as a conceptual introduction to the readings, tracing a particular account of literary mimesis from Plato to Maurice Merleau-Ponty. The four subsequent chapters each read a pair of texts by Hoffmann and Balzac alongside one another. Chapter Two, ‘Line’, focuses on the arabesque lines of Der goldne Topf and La Peau de chagrin. Chapter Three, under the emblem ‘Trope’, examines the paper identities of characters in Die Abenteuer der Sylvester-Nacht and Le Colonel Chabert. Chapter Four, ‘Figure’, considers the delusional artist figures and ekphrastic narrative frameworks of Der Artushof and Le Chef-d’œuvre inconnu. Finally, Chapter Five, ‘Cross’, examines questions of inheritance between Die Elixiere des Teufels and L’Élixir de longue vie. In unfolding these emblematic figures as models of reading, I seek new ways of thinking about the relationship between these two authors, and about the act of comparative reading.

This thesis analyses the administrative justice system, which represents one of the key control mechanisms of the public administration in The Czech Republic. The aim of this thesis is to compare the administrative justice system of The Czech Republic with selected European models of the administrative justice system such as the French and German justice systems. The result of this comparison highlights the differences in justice systems and considers the possibility of implementing these models in The Czech legal system.The administrative justice system in The Czech Republic has been developing since 2003, when The Act N. 150/2002 came into effect. The operating administrative justice system in The Czech Republic is characterized by the following criteria: statutory framework, power and jurisdiction of the administrative court, organization of the administrative justice system and the course of the judicial administrative proceedings. The following chapters discuss the French and German models of the administrative justice system and analyze the similarities with the Czech system.The final chapter compares the individual administrative justice systems and their most important differences.

Iran, with its attractive geographical position and its abundant natural resources, has had an undeniable attraction for the world's greatest powers over the history. Well before the creation of the Islamic Republic of Iran, this country established high level of economic interactions with a great variety of political partners. In recent years, the country's change of regime has had a crucial impact on those relationships. By analysing the trade data between Iran and Western countries (the U.S.A., Canada, the U.K., France, Germany, and Italy) as well as the major Eastern countries (China, Russia, and India), it is possible to establish a better understanding of how political events have impacted Iran's commerce with the world's major economic players. It is also possible to understand how the change of direction of the Iranian's imports and exports can impact the behavior of the other nations studied. This research focuses on the analysis of Iranian trade since 1969, ten years before the revolution and until 2009.
