Aims to profile the performance of the union entity, headquartered in Ceará’s capital, in that time span. Specifically, analyses the representation in the workplace, describes the health care services provided to its members, identifies the sources of funding used by the union, knowing its actions in defense of the category and the dialogue between the union and its base. The methodology was one of investigative and descriptive nature. It was a field research, of the participant type, whose data were collected through a separate instrument, previously developed by the researcher and applied directly to a member of the executive board of the union. The results led to the following main conclusions: a. representation in the workplace is given by the representative of the employees in the company and the union leader b. unions are supported by the contributions recognized by Brazilian law c. the union actions in defense of the workers happens through participation in the collective bargaining process and the outbreak of the strike d. the communication with the union base is through campaign for unionization, union mobilization and visits to the workers it represents. / Estudo da entidade sindical de primeiro grau no contexto da liberdade sindical no Brasil: um perfil da atuação de sindicatos da categoria profissional, no Município de Fortaleza, no período de 2010 a 2012. Objetiva traçar um perfil da atuação do ente sindicato, com sede na capital do Estado do Ceará, neste lapso temporal. Especificamente, destina-se a analisar a representação no local de trabalho, descrever os serviços assistenciais prestados aos representados, identificar as fontes de receitas sindicais, conhecer a atuação sindical em defesa da categoria e a interlocução do sindicato com sua base. A metodologia teve natureza investigativa e descritiva. Realizou-se uma pesquisa de campo, do tipo participante, cujos dados foram coletados por meio de instrumento próprio, previamente elaborado. Este foi aplicado pela própria pesquisadora diretamente a um membro integrante da diretoria executiva do sindicato. Os principais resultados levaram às seguintes conclusões: a. a representação no local de trabalho se dá pelo representante dos trabalhadores na empresa e pelo dirigente sindical; b. os sindicatos se sustentam com a arrecadação das contribuições reconhecidas pelo ordenamento jurídico; c. a atuação sindical em defesa da categoria se efetiva por meio da participação no processo de negociação coletiva e na deflagração da greve; e. o sindicato dialoga com sua base através de campanha para sindicalização, mobilização sindical e visita aos representados.

A presente pesquisa analisa o direito à assistência jurídica integral e gratuita como pertencente ao grupo dos direitos humanos e também dos direitos fundamentais. Seu estudo é elaborado sob o aspecto do desenvolvimento do Estado do Bem Estar Social, do princípio da igualdade e da superação dos obstáculos ao acesso à Justiça. Nesse sentido, é enfatizada a função da Defensoria Pública da União como entidade responsável por prestar assistência jurídica no âmbito da Justiça do Trabalho, tanto aos trabalhadores necessitados, como aos empregadores que comprovarem os requisitos elencados pela lei para obtenção dessa assistência. Além disso, são analisadas algumas especificidades do Direito do Processual do Trabalho como o jus postulandi e a questão dos honorários advocatícios relacionadas ao tema da assistência jurídica. Por fim, em decorrência do tratamento legal concedido à prestação de assistência jurídica na seara laboral, é estudada com maior profundidade a função assistencial dos sindicatos diante do princípio da liberdade sindical e as modalidades de assistência jurídica que as entidades sindicais prestam a seus representados. / The following research analyzes the right to free and integral legal aid as part of human rights as well as fundamental rights. Its study is developed from the points of view of the Welfare State, the principle of equality and the overcoming of obstacles towards the access to Justice. In this regard, it is emphasized the role of the Federal Public Defender\'s Office as the entity responsible for providing legal aid services in the scope of Labor Court, for both workers in need and for employers who prove to meet the requirements listed by law for obtaining this assistance. Furthermore, we analyzed some particularities of the Labor Procedural Law such as the possibility for a party to plead his own cause and the matter of attorneys\' fees in labor cases related to legal aid. Ultimately, due to treatment granted to legal referral in the labor field, the assistance role of trade unions is studied more deeply next to the principle of freedom of association and the categories of legal aid services which these unions provide to their ones represented.
