Justice and reconciliation : transitional justice in post 1994 Rwanda in the light of the South African experience.

This study deals with the problem of transitional justice in post-genocide Rwanda in the light of South African experience. Transitional justice, a kind of justice pertinent to societies in transition from dictatorship to democracy where the new democratic regime faces the challenge of how to redress the abuses of the past, varies according to each case. While South African transitional justice has taken a form of mixed memory and punishment with the Truth and Reconciliation Commission, the case of Rwanda still presents a number of difficulties. First and foremost, unlike South Africa, Rwanda is a case of genocide and so far there is no agreement about how to think of and understand this genocide. Of the three different sources considered in this study, Adedeji and the Human Rights Watch Report argue that genocide was planned in advance, while Mamdani contends that it was a result of the failure of governmental forces to win the war and the advancement of the rebels, and nothing as such was planned before. . Besides the genocide, the continuation of human rights violations and the lack of will to change, the lack of democracy, the continuation of international support despite the lack of transparency in governance, along with other elements, hold Rwanda in the pretransition stage. In this study, I examine the close links between transitional justice and Truth and Reconciliation Commission, I raise the question of what it would mean for Rwanda to have a successful Truth and Reconciliation Commission; given the history of genocide, and I discuss the failure of the Commission in Arusha. For transitional justice to take place in Rwanda, every form of armed struggle must stop so as to allow Rwandans (all conflicting parties involved) to take the genocide seriously and face its entire truth with courage and honesty. The truth of genocide would clarify the misconception of Rwandan history and would allow Rwandans to change their mentality and belief that ethnic majority means necessarily political majority and to embrace a more transethnic political identity. Then the establishment of a judiciary system capable of dealing with the abuses of the past would be possible. This new democratic regime, which would be democratically organized when all these requirements are met, would determine what kind of transitional justice would be pertinent to the Rwandan case. / Thesis (M.A.)-University of Natal, Durban, 2002.

Genocide, citizenship and political identity crisis in postcolonial Africa : Rwanda as case study.

To state that the 1994 Rwandan genocide was one of the most horrific catastrophes that occurred in the 20th century is to restate the obvious. This thesis is an analytical exploration of the root causes of the 1994 Rwandan genocide. It explains how Tutsi became non-indigenous Hamities and how Hutu became native indigenous, leaving the two populations to be identified along racial and ethnic lines. In 1933, the Belgians introduced identity cards which specified one‟s ethnic affiliation, giving birth to political identities as Hutu and Tutsi ceased to become cultural identities and became political identities. The identities of Hutu and Tutsi were not only legally enforced, but they also became linked to the governance of the state. Tutsi was now associated with state power and domination, while Hutu was linked with suppression and discrimination. Independent Rwanda, the Hutu took over power and continued to subscribe to some of the colonial racists ideologies and maintained Tutsi and Hutu as political identities. The once oppressed Hutu became the oppressor, whilst the once dominate Tutsi became the oppressed. The victim group construction theories were used in this study to examine the ills of race-branding in independent Rwanda. The Hutu regimes of the First Republic (1962-1973) and the Second Republic (1973-1994), failed to go beyond the colonist‟s strategy of divide and rule and instead continued to apply this racist ideology to bring justice to the Hutu, which turned into revenge for the Tutsi. World history has been punctuuted by cycles of violence, regardless of time, region or race. Genocide. which is the worst form of violence has always led to horrible impacts of a social, economic and environmental nature. The last decade of the 20th Century was the most turbulent Rwanda has ever seen. The country was ravaged by civil war,genocide, mass migration. economic crisis. diseases, return of refugees and deforestation. Almost all Rwandan families were affected wherever they were and at multiple levels, by outcomes such as death, disease, disability, poverty, loss of dignity and imprisonment. Fortunately, the people of Rwanda have chosen the path of peace. but arc still faced with a huge task of dealiing with the impacts or the genocide and prior conflicts in the region. This dissertation attempts to investigate the socio-economic impacts of the genocide on current development in Rwanda using primClry and secondary data obtained from fieldwork undertaken in Cyangugu and Rutare Towns. The conceptual basis for the study was the Geography of Conflict, The general conclusion reached was that the causes and consequences of the Rwandan genocide are multidimensional. The Rwandan genocide did not originate from the "ancient hatred" between Hutu and Tutsi ethnic groups, but from the manipulation of history and bad leadership. Also. the main impacts of genocide in Rwanda are the destruction of human resources. social and cultural structures in the country, especially the relationship between the Hutus and Tutsis ethnic groups. In the same way the genocide resulted in destruction of infrastructure. development facilities and natural resources, However. the effort for reconstruction and development undertaken after the genocide shows that rcconciliation is possible in long term despite what happened. Problematizing 'victim's justice' : political reform in post-genocide Rwanda

Magister Administrationis - MAdmin / In this dissertation, I problematize 'victim's justice' in post-genocide Rwanda. I argue that the kind of justice that was meted out in post-genocide Rwanda, namely victors' justice and complementary to it – victims’ justice, does not allow for the political reform required to break the cycle of violence in Rwanda. In the aftermath of the 1994-Rwandan Genocide, both state and society were faced with a moral and political dilemma, because the popular agency or mass participation of perpetrators derived from the Hutu majority, who targeted the Tutsi minority, with intent to annihilate them. There were massacres of both Hutus and Tutsis, but Hutus were targeted as individuals, whereas Tutsis were targeted as a group. It is the specific ‘intent to annihilate’ Tutsis as group, that makes this a Genocide against Tutsis. I draw and develop arguments made by Mahmood Mamdani, elaborating on the specific question of ‘victims justice’ for political reform in Rwanda. Both kinds of justice were outcomes of the logic of the Nuremburg Trials. Since its inception, the legacy of the Nuremburg Trial is demonstrated in how it was idealized at the end of the Cold-War by international law and human rights regime. In essence, the historical and political context of the Nuremburg trial has been removed, as it has been produced into a template- the 'Nuremburg-styled criminal trial'. 'Criminal justice' has come to define how we think of justice after mass violence, as the most morally acceptable form of justice for the victims, and the most politically viable response for constituting a 'new political order' after mass violence. This dissertation addresses the argument made, that victors' justice and victims' justice in Rwanda, has constituted two categories, which collectivise Tutsis as victims and Hutus as perpetrators. In the context of a genocide, where the perpetrators are derived from the Hutu majority and the victims from the Tutsi minority, this present both a moral and political dilemma for Rwanda’s state-building and national reconciliation project. Criminal justice also frames mass violence as being criminal, rather than addressing it as political violence. This has troubling consequences for intervening into the cycle of violence in Rwanda. The 'cycle of violence' in Rwanda, refers to the continuation of political violence, in which 'every round of perpetrators has justified the use of violence as the only effective guarantee against being victimised yet again. Thus, intervention into the cycle of violence would mean thinking out of the logic of victimhood and pursuing an alternative kind of justice. To think of the genocide as political violence, redirects the attention to the issues that made the genocide possible. I establish the importance and necessity of critically interrogating 'victims justice' in Rwanda, by placing the 1994-Genocide in its historical and political context, with a particular focus on the legacy of colonialism. The post-colonial regimes in Rwanda, inherited the colonial institutions of rule; and the politicisation of Hutu and Tutsi into racial categories, which have shaped particular meanings for power, justice and citizenship. I demonstrate in this dissertation that critical issues found in post-genocide Rwanda today, are symptomatic of the inherited colonial legacy. I address the prevailing political crisis through an analysis on post-genocide governance; national reconciliation; the 'land question'; and the Great Lakes refugee crisis. Furthermore, I found that it was critically important for my research question, to also adopt a regional perspective, because Rwanda lies at the epicentre of the Great Lakes regional crisis. This dissertation concludes with returning to the question of political reform, and breaking the 'cycle of violence'. My suggestion is that we need to think of Mamdani's concept of survivor's justice, rather than victims' justice or victors' justice, which assist in confronting the needs of political reform that address colonial legacies.

Twenty years after the 1994 Rwandan Genocide, Violet Walters makes her way to the tiny village of Murumba to fulfill her dream of becoming a philanthropist. In addition to the shock of a new culture, Violet must now contend with Bret Calloway, a hardened philanthropist whose ten years at Murumba have made him less than happy about the arrival of Violet and her optimistic new perspective. Amid the mounting tension of their relationship, war looms in the background. What ensues is a testament to the transformational nature of a culture and its people. Gukundana seeks to illuminate injustices related to civil strife and genocide from an outsider's perspective. The character of Violet acts as a stable lens from which western viewers can engage with cultural hardships very different from their own. Within this, the connection between the warring ideologies of Bret and Violet against the background of the mounting violence around them serves as another window into greater emotional engagement with themes of violence and war. Ultimately, this screenplay's mission is to bridge cultural barriers in order to endear viewers to the unity, resiliency, and power of the Rwandan people, thus sparking change within a viewing audience's surrounding community.

A sociological analysis of culture and memory : a case study of the Kigali Memorial Center of Genocide in Rwanda.

The 'never again' slogan to genocide, expressed by the United Nations Organization in 1948, after the Armenian and Jewish genocides has not been a barrier to other genocides whose Holocausts are a product. In 1994 in Rwanda, genocide occurred and the Kigali Memorial Center of Genocide is one of the Memorials (Holocaust) which stands as a reminder of the horror, in order to inform the community to keep watching. This raised the curiosity of the researcher, to analyze how these new symbols can contribute to restore and revitalize social and cultural values in the context of Rwanda. The inside of the house offers on opportunity to visit the displayed history in which the genocide is rooted, including the period of genocide through survivors' experiences represented in short movies and by the material used in the killings. There is a room reserved for displays of the others' genocides in the world. Outside the house, mass graves surrounded by a garden, announce the burial place and a documentary place. The first chapter is the general introduction of the study and outlines the framework of the study. The second chapter offers the syntheses of the literature review that it presents the social and political context in which the genocide took root. The third chapter offers the theoretical framework which deals with the nature of culture and its influence in the understanding of the Kigali Memorial Center of Genocide. The fourth chapter focuses on the fieldwork methodology. This study makes use of the qualitative approach. The primary data was collected through in-depth interviews of twenty one individuals and discussions with four focus groups with ten respondents in each group. Respondents were randomly chosen. The secondary data was used to complete the primary data. The fifth chapter is the presentation of the research findings. The findings reveal that after completing the construction of the Kigali Memorial Center of Genocide in 2004, spontaneous and organized visits to the Kigali Memorial Center of Genocide have taken place. This 'window' of what happened, inspires visitors and communities that there is a need to understand the past which can help in building a hopeful future together, for sustainable peace.
