Constata-se que a regula??o visa o cumprimento dos direitos fundamentais e a observ?ncia da democracia, da justi?a social, da liberdade e da dignidade da pessoa humana. A partir disso, pretende analisar a participa??o da sociedade civil na esfera regulat?ria como um dos fundamentos constitucionais para o desenvolvimento do pa?s. Para tanto, relaciona a estrutura institucional de uma na??o com o seu potencial de crescimento econ?mico e desenvolvimento, estabelecendo o conte?do jur?dico deste. Argumenta, a partir da doutrina e da hermen?utica constitucional, que a concep??o de desenvolvimento n?o se restringe a par?metros econ?micos, devendo-se considerar aspectos sociais e ambientais. Compreende que a democracia participativa ? elemento intr?nseco e instrumental do desenvolvimento. Verifica, como corol?rio, que os interesses essenciais ao desenvolvimento - mas que podem apresentar-se de maneira conflitante - devem ser sopesados no ?mbito da regula??o, a partir de uma racionalidade procedimental participativa. Visa, ainda, identificar qual o lastro constitucional a partir do qual se justifica a democratiza??o da Administra??o P?blica. Relaciona a reforma estatal - concebida em termos de descentraliza??o, consensualismo e horizontaliza??o das rela??es entre Administra??o P?blica e administrados - com uma nova perspectiva de encarar-se o interesse p?blico e o princ?pio da efici?ncia. Averigua, por fim, a participa??o da sociedade civil no ?mbito da regula??o de recursos h?dricos, notadamente na estrutura da Ag?ncia Nacional de ?guas e no caso do Comit? de Bacia Hidrogr?fica Pianc?-Piranhas-A?u. Faz-se uso do m?todo dedutivo e da pesquisa bibliogr?fica, al?m do exame dos relat?rios das audi?ncias/consultas p?blicas realizadas pela Ag?ncia Nacional de ?guas e das atas das reuni?es ordin?rias e extraordin?rias promovidas pelo Comit? de Bacia Hidrogr?fica Pianc?-Piranhas-A?u. Conclui-se que a participa??o da sociedade civil na Administra??o P?blica encontra fundamento na Constitui??o Federal. Ademais, no ?mbito da regula??o de recursos h?dricos, verifica-se que n?o se trata de uma utopia ou de um mero instrumento de ret?rica, apresentando-se muitas das vezes de forma eficiente e efetiva. No entanto, explica que ajustes devem ser feitos, a fim de solucionar alguns problemas identificados e otimizar a atua??o administrativa com vias ? consecu??o do desenvolvimento nacional. / The work presents a study on democratic participation in the scope of regulation in the light of the constitutional goal of promoting development. It is noted that the regulation aims to implement basic rights and observance of democracy, social justice, freedom and human dignity. From that, one intends to analyze the participation of civil society in the regulatory sphere as one of the constitutional foundations for the development of the country. Therefore, it relates the institutional structure of a nation with its potential for economic growth and development, establishing the legal contents of such. It argues, from the doctrine and constitutional hermeneutics, that the concept of development is not restricted to economic parameters and should consider social and environmental aspects. It understands that participatory democracy is an intrinsic and instrumental element of development. It verifies, as a corollary, that the essential interests to development - but that may be presented in a conflicting way - must be weighed in the context of regulation, from a participatory procedural rationality. It also aims to identify the constitutional ballast from which the democratization of Public Administration is justified. It relates the state reform - conceived in terms of decentralization, consensualism and horizontality of relations between Public Administration and administered people - with a new perspective of looking up the public interest and the principle of efficiency. It finally ascertains the participation of civil society in the regulation of water resources, especially in the structure of the National Water Agency-ANA and in the case of the Watershed Committee Pianc?-Piranhas-A?u. It makes use of the deductive method and literature review, as well as examines reports of the audiences/public consultations conducted by the National Water Agency and the minutes of both ordinary and extraordinary promoted by the Watershed Committee Pianc?-Piranhas-A?u. One concludes that the participation of civil society in Public Administration is one of the foundations of the Federal Constitution. Moreover, in the context of regulation of water resources, it appears that this is not a utopia or a mere rhetorical instrument, performing often efficiently and effectively. However, it explains that adjustments should be made in order to solve some problems identified and optimize administrative operations with means to the attainment of national development.

The concept behind the provider-receiver principle has evolved with the so-called Payment for Environmental Services Program ? PSA, promoting forest conservation and restoration actions and improving the economic and social conditions of the populations in the rural properties participating in the program. The objective of this study was to assess how the actual populations evaluate the environmental, economic and social efficacy of an ongoing program called ?Produtores de ?gua e Florestas ? PAF? (Water and Forest Producers) taking place in the town of Rio Claro, in Rio de Janeiro State. The project is 8 years old and follows the guidelines established by the National Water Resources Policy in the pursuit of environmental benefits such as improving water production and water quality in the Guandu Watershed by way of initiatives aimed at forest conservation and restoration. For this purposes of this study, we utilized social participation techniques such as non-structured interviews and participative research, resulting in the collective agreements generated by the survey. The study evidenced that the project has technical weaknesses such as lack of monitoring for field activities and lack of inspection for fighting illegal hunting and forest fires. The economic weaknesses were the premiums paid to rural producers who make their land available for the execution of the project. This last weakness could be eliminated if the project could use the funds generated by the Green ICM tax. The study also revealed opportunities that could be tapped with the perception of other weaknesses found such as the lack of a local market for the production of seedlings of species that are native to the Atlantic Forest. There is a desire on the part of rural producers to supply the local market with seedlings, thus meeting the demand of the PAF. One noteworthy aspect was the absence in the UGP (Project Management Unit) of the most important actors at the decision making core of the project: the rural producers themselves. The studies reveal a generalized belief that the PSA project has been fulfilling its primary objective, i.e., the conservation and restoration of forests, assisted by its major ally: an increasing environmental awareness on the part of the participating farmers. / Pol?ticas p?blicas ambientais t?m sido implantadas no Brasil buscando melhorar e ampliar os servi?os ambientais produzidos pela floresta. O princ?pio provedor- recebedor evoluiu seu conceito atrav?s dos Programas de Pagamento por Servi?os Ambientais - PSA que beneficiam a??es de conserva??o e restaura??o florestal e modificam aspectos econ?micos e sociais de popula??es que vivem em propriedades rurais onde o programa ? executado. O objetivo deste trabalho foi avaliar a vis?o dessa popula??o sobre a efici?ncia ambiental, econ?mica e social do programa "Produtores de ?gua e Florestas" (PAF) em andamento no munic?pio de Rio Claro - RJ. O projeto h? 08 anos vem se submetendo ?s regras estabelecidas pela Pol?tica Nacional de Recursos H?dricos em busca de benef?cios ambientais como: melhorar a produ??o e a qualidade de ?gua da Bacia Hidrogr?fica do Guandu por meio de medidas de conserva??o e restaura??o florestal. Para a realiza??o desse estudo foram escolhidas t?cnicas de participa??o social como a entrevista n?o estruturada e a pesquisa participante, t?cnicas estas respons?veis pelos acordos coletivos gerados na pesquisa. A pesquisa mostrou que o projeto possui fragilidades t?cnicas como a falta de monitoramento das atividades de campo e fiscaliza??o para combate a ca?a e a inc?ndios florestais. Possui como fragilidade econ?mica os valores pagos aos produtores rurais que disponibilizam suas terras para as a??es do projeto. Tal fragilidade poderia ser neutralizada pelos potenciais recursos advindos da arrecada??o do ICMs verde . Al?m disso, apresentou oportunidades que podem ser concretizadas a partir da percep??o de outras fragilidades encontradas como a falta de um mercado local de produ??o de mudas de esp?cies nativas da Mata Atl?ntica. H? um desejo dos produtores rurais em abastecer com mudas o mercado local, suprindo assim as demandas do PAF. Notou-se a n?o inser??o por parte da UGP do principal ator do projeto no centro das decis?es: o produtor rural. Pelos estudos, acredita-se que o projeto PSA vem cumprindo seu objetivo principal: a conserva??o e restaura??o das florestas, tendo como maior aliada, a conscientiza??o ambiental dos produtores rurais participantes.

The amount of produced water associated with oil varies a lot. It can reach values which account to 50% in volume up to nearly 100%, at the end of the well s economic life. It could be verified that, once the water reaches the productive wells, there must be a management of this produced water. Its destiny is defined after a precise study, after which the best option is chosen between relieving it into the environment, re-injecting it into the producing container or disposing it into non-producing formations. Whichever option is made by the involved professionals, after the necessary analysis, it shall consider, besides the technical and economical aspects, also the alternatives which entail less environmental impact. The purpose of the present research is to conduct a study about the application of the constitutional principle of efficiency on the instruments worked out by the public administration on water management, specifically the water use licence and charging for the use in the management of water resources applicable to water production at the petrol wells. In this attempt, before entering the proper approach of the efficiency of the mentioned instruments, it was necessary not only bring to light the doctrinal perception about the constitutional principle of administrative efficiency, but also make some considerations concerning to the structure of the national water resources management, set by the Federal Constitution (1988) and the federal legislation (9433/97) / A produ??o de ?gua ? inevit?vel durante a vida ?til do po?o de petr?leo.
