The thesis is focused on the issue of protection of personality rights as one of the fundamental institutions of civil law. The thesis is mainly focused on contemporary conception of man and his personality in current civil law. The theoretical foundations of the concept of general right of personality is summarized and valid legislation of protection of personality right made by Act no. 89/2012 Coll. - Civil Code, is described in the context of general right of personality and its theoretical conception. The thesis is divided into twelve chapters; the first chapter defines basic concepts and terms such as the person, personality and legal personality. The second chapter deals with the theoretical concepts of general right of personality in an objective and subjective sense. The third chapter is focused on the historical development of the protection of personality right in the world and in our country and the development of legislation on protection of personality right is described. The fourth chapter contains a comparison of the concept of protection of the protection of personality rights in continental law and common law. The thesis deals with the topic of safety and health protection of pre-school children. It focuses on education opportunities for children in nursery school. The aim of the work is to highlight the importance of health and safety education for pre-school-age children and to propose the subsequent possible implementation of a project called Safe in danger into the education of pre- school-age children. The work summaries theoretical knowledge about the developmental peculiarities of a child of pre-school age and possible risks of accidents. There is a condensed legislative framework that is binding on pre-school education, which implies principles for the safety and health of children and presents the expected outcomes formulated in the Framework Education Programme for pre-school education in the area. The theoretical section points to an investigation in the field of selected issues by the Czech School Inspection and presents an overview of programs, projects and materials that can be used to educate children on this issue. The empirical part of the work uses the method of action research. This diploma thesis deals with electromagnetic radiation in its frequency spectrum. It also divides radiation into ionizing and non-ionizing. The principle of its effects and possible health problems from radiation exposure are also described. Hygienic limits – the maximum allowable and reference values of non-ionizing radiation are analysed too. The thesis should prove that the things of everyday need do not threaten the lives of human beings and are in compliance with the regulation No. 1/2008 Sb. on Health Protection Against Non-Ionizing Radiation. Measurement of low-frequency part is carried out with the cooperation of The National Institute of Public Health. Measurement of high-frequency part was carried out in 3 flats. The aim of this measurement was to find out the change of power density with the moving in a flat and the influence of the barriers (in this case walls).

The thesis deals with the legal regulation of protection of personality rights. According to the certain changes in personality protection legal regulation caused by recent adoption of new Civil Code, Law no. 89/2012 Coll., the topic appears to be up to date. The aim of this thesis is to bring current legal regulation of this issue in its general terms. The thesis is divided into eight chapters. The first chapter explains basic terms such as personality and general right of personality. Second chapter describes the historical evolution of legal regulation with the main focus on Czech territory. The third chapter examines the existing legal sources affecting the protection of personality. The fourth chapter discusses personality rights entities and it is followed by the definition of the scope of personality protection rights. The sixth chapter explores the methods how is it possible to restrict personality rights, both from the will of concerned person and against it, especially in the form of so called statutory licenses. Problematika kouření v restauračních zařízeních v centru Plzně / Smoking in restaurants in the center of Pilsen

The topic of this diploma thesis is ´Smoking in restaurant facilities in Pilsen city center´. Smoking in restaurant facilities harms not only their visitors but especially their employees. This group of citizens becomes passive smokers for the entire working time which may have negative health consequences. The main goal of this thesis was to map out the problem of smoking in restaurant facilities from their employee´s point of view. Three research questions have been determined towards fulfilling this goal. The research was implemented with the help of qualitative survey. Semi-structured in-depth interview was carried out with 13 respondents who had been chosen through the snowball sampling method. Information was evaluated through the open coding method and it has responded to the research questions. The first research question - What are the smoking habits of smoking restaurant facility employees? The research has proven that the amount of cigarettes smoked by the smoking restaurant facility employees has raised. The second research question - How do the employees of smoking restaurant facilities perceive the risk of passive smoking? Respondent´s answers have provn that they do not perceive passive smoking to be a risk factor which might harm their health. Only a minor part of respondents minds working in a smoking environment. The third research question was put this way: What is the attitude of employees in smoking restaurant facilities towards the new planned anti-smoking legislation? The research has proven that most respondents does not wish the acceptance of smoking prohibition in restaurant facilities. The reasons are concerns for their jobs, decrease in revenue, refusal of prohibition in general ort he fact that they themselves are smokers. Only a small number of respondent sis acutally concerned about their health and would welcome an amendment to the Act. A short intervention was carried out with the respondents within the research, which was supposed to inform the employees of restaurant facilities about the risks of passive smoking. The research has proven that employees of smoking restaurant facilities do not perceive the risk of passive smoking really. They are often exposed to tobacco smoke even in their leisure time. The most effective prevention may be ensured by politicians who would enforce a stricter legislation.

Todavia, o sentido conferido a essa expressão não se faz claro, sendo tratada como uma noção. A dissertação tem por objetivo analisar a noção de segurança sanitária incorporada na vigilância sanitária brasileira com a criação da Agência Nacional de Vigilância Sanitária (Anvisa). Para tanto, foi realizado um estudo de caso, do tipo exploratório, contemplando a análise de documentos de cunho técnico e normativo emitidos pela Anvisa, referente ao período de 1999 a 2004, bem como a realização de entrevistas semi-estruturadas com informantes-chave que participaram do processo de formulação do desenho institucional. A partir da massa de dados, identificaram-se situações, em que o termo foi utilizado, extraindo os significados associados à expressão em estudo. Constatou-se que a noção de segurança sanitária, no caso em estudo, gira em torno dos binômios risco-benefício ou risco-proteção da saúde, apresentando-se tanto como uma relação risco/benefício aceitável na perspectiva da proteção e promoção da saúde individual e coletiva quanto uma relação de obrigação do Estado para com a sociedade com vistas à proteção da saúde. No que concerne à extensão da noção, observa-se que ela abrange produtos e serviços de interesse à saúde humana; incorpora ainda, de forma pouco expressiva, questões ambientais, incluindo meio ambiente e ambiente de trabalho. As preocupações em relação à SS recaem sobre questões referentes à produção e ao consumo de medicamentos e tecnologias de interesse da saúde, sobretudo, aquelas que têm como finalidade o diagnóstico e tratamento médico; entretanto, os dados revelam que tem havido uma ampliação do escopo da noção de segurança sanitária. / Salvador

Il y a en France un double mouvement, une tension permanente entre la logique du droit des étrangers et celle des droits de l’homme, qui se cristallise autour de la santé des non-nationaux.La santé est intégrée au sein de la police administrative spéciale afin de protéger la collectivité de risques induits par l’arrivée d’étrangers malades. Mais d’autres enjeux que la préservation de la santé publique sont présents. La santé des étrangers est utilisée comme un moyen de régulation des flux migratoires et de sélection parmi les individus. La mise en œuvre de la politique dite de « l’immigration choisie » est cependant encadrée par les droits fondamentaux reconnus progressivement aux étrangers.La santé est également un droit des étrangers résidant en France, celui d’accéder aux soins nécessaires à leur état. Ce droit est porté par les principes d’égalité et de dignité, mais également dépendant de leur application par les juges. Le principe d’égalité conduit ainsi à une catégorisation du droit d’accès aux soins en fonction de la situation administrative des étrangers. Ce droit connaît en outre des variations importantes et se résume parfois au seul bénéfice de soins vitaux et/ou essentiels. Pour des considérations migratoires mais aussi financières, les juges font le choix de le rattacher au principe de dignité plutôt qu’à un droit, autonome, à la protection de la santé. / In France there is a double movement, a permanent tension between the logic of foreigners' rights and that of human rights, which crystallizes on the health of non-nationals.Health is part of the special administrative police aiming at protecting the community from the risks induced by the arrival of sick foreigners. But there are other challenges besides the preservation of public health. The health of foreigners is used as a means of regulating migration flows and selecting individuals. However, the implementation of the so-called "chosen immigration" policy is governed by the fundamental rights gradually granted to foreigners.Health is also a right of foreigners residing in France to access the care necessary for their condition. This right is supported by the principles of equality and dignity, but also depends on their implementation by judges. The principle of equality thus leads to a categorisation of the right of access to healthcare according to the administrative situation of foreigners. This right also varies considerably and is sometimes limited to the sole benefit of vital and/or essential care. For migration but also financial considerations, judges choose to link it to the principle of dignity rather than to an autonomous right to health protection.

This diploma thesis deals with the issue of safety and protection of children's health. It namely disserts on the occurrence of accidents among children, their prevention and provision of first aid in case of an accident or sudden damage to one's health . The aim of this thesis is to map the current state of accident occurrence among children and the scope of assertion of permanent active prevention with selected primary school pupils. The theoretical part contains epidemiological data concerning accident occurrence among children, types of accidents from the point of view of physical and psychological development of a child and the environment in which these accidents occur and selected preventive measures. Most attention is paid to school accident occurrence, safety and protection of pupils and incorporation of this issue in the Framework educational programme for basic education. It also provides a summary of legal aspects and recommended practices of first aid provision, including the current trends and introduction of educational programmes and courses intended for lay public. The practical part maps the awareness of safe behaviour as the primary form of accident prevention among ninth grade primary school pupils as well as their knowledge, skills and attitudes to first aid provision.
