O seu fio norteador é, do ponto de vista macro, o que aqui denominamos de uma pedagogia cristã da caridade – disseminada em todo Ocidente católico — e, do ponto de vista micro, a vivência das práticas e crenças construídas em torno da caridade em Cachoeira, analisando as regras prescritas pela religião e o uso que os sujeitos dela fizeram em suas escolhas cotidianas. No estudo dos testamentos, atentamos para a análise dos legados e esmolas neles determinados, buscando compreender a relação entre estes atos e a busca pela salvação da alma, tendo em vista o caráter religioso assumido por tais documentos, legitimado pelo direito canônico e civil. As doações determinadas pelos testadores, as suas escolhas, assim como o efetivo cumprimento das suas últimas vontades dependeram de forma significativa das relações sociais, políticas e econômicas estabelecidas na comunidade local na qual estavam inseridos. Em função disto, buscamos compreender a influência da escravidão, das relações sociais e interpessoais, e da paróquia, em torno da qual se organizou a vida comunitária na sociedade colonial, sobre as escolhas dos testadores, e o papel que exerceram na rede de transformações dos seus bens materiais em benefícios espirituais em favor da sua alma. Entretanto, ao longo deste século, especialmente na sua segunda metade, transformações significativas afetaram as relações entre o Estado Português e a Igreja. Nesse contexto, a legislação testamentária sofreu significativas alterações, que visaram à ampliação do direito dos herdeiros e à limitação da destinação de bens para a alma do testador. A tese analisa o impacto destas transformações na distribuição de esmolas e legados nos testamentos de Cachoeira e na prática religiosa dos testadores. / Abstract: This thesis studies the influence of the principles of charity and works of mercy, disseminated by the Church, in the testament donations of the residents in Vila of Cachoeira and its terms, during the eighteenth century. Its guiding thread is, in the macro point of view, what we call here a Christian pedagogy of charity - spread throughout the Catholic West - and the micro point of view, the experience of the practices and beliefs built around charity in Cachoeira analyzing the rules prescribed by religion and the use that the subject did in their daily choices. In the study of the testaments, we dedicated to the analysis of the legacy and alms determined by the bequests, seeking to understand the relationship between these acts and the search for the salvation of the soul, in view of the religious character assumed by such documents, legitimized by canon and civil law. The donations determinated by the testators, their choices, as well as the effective fulfillment of their last wishes depended significantly on social, political and economic relationship established in the local community in which they were inserted. Because of this, we seek to understand the impact of slavery in social and interpersonal relationships, and the influence of the parish, which is around it, community life in the colonial society was organized on the choices of the Cachoeira testators, and the role played in network transformation of their material goods into spiritual benefits in favor of his soul. However, throughout this century, especially in its second half, significant changes have affected the relationship between the Portuguese State and the Church. In this context, the testamentary legislation has undergone significant changes, which were aimed at expanding the rights of heirs and the limitation of the destination of goods for the soul of the testator. The thesis analyzes the impact of these changes in the distribution of alms and legacies in testaments in Cachoeira and the religious practice of the testators.

Thus, social changes have affected the course of history in the transformation of the law. Thus, the situation created by the end of the international traffic articulate the everyday struggles of slaves for their freedom and delivered for maintenance, this fight also potentiated in the legal field. Moreover, this work aims to understand the profile of social relations involving slave owners, slaves, freedmen and other social actors in their daily life in the context of deregulation of slavery, and as a locus for analyzing São Luís and Alcântara in the 1860s - 1880. For this, it was necessary to investigate how the Law was organized in the nineteenth century, analyzing the legal practice in the capital of the Province of Maranhão and explore the strategies used by slaves and freedmen to reach their individual projects. Furthermore, this study was documentary contribution freedom suits, actions nullity actions maintenance of freedom, appeals, period newspapers, wills, speeches and reports of provincial presidents, surveys and notices of questions. / O Direito é um espaço de conflito entre diversos segmentos sociais. Assim, as mudanças sociais repercutiram ao longo da história na transformação do Direito. Desta maneira, a conjuntura criada pelo fim do tráfico internacional articulada às lutas cotidianas dos escravos por sua liberdade e dos libertos pela sua manutenção, potencializou essa luta também no campo jurídico. Ademais, este trabalho objetiva compreender o perfil das relações sociais que envolviam proprietários de escravos, escravos, libertos e outros atores sociais em sua vivência cotidiana no contexto de desregulamentação do escravismo, tendo como locus para a análise as cidades de São Luís e Alcântara nas décadas de 1860-1880. Para isso, fez-se necessário investigar como estava organizado o Direito no século XIX, analisar a prática jurídica na capital da Província do Maranhão e explorar as estratégias usadas por escravos e libertos para alcançarem seus projetos individuais. Além disso, este estudo teve como aporte documental ações de liberdade, ações de nulidade, ações de manutenção de liberdade, apelações, jornais de época, testamentos, falas e relatórios de presidentes de província, inquéritos e autos de perguntas.
