Previous issue date: 2014-03-12 / The present research analyses the efforts put into the regularization process of an
occupation area northeast Goiânia city, more specifically in the allotment Jardim
Nova Esperança, for it was the first collective settlement in Goiânia. It started in 1979
with the informal occupation of an area of "Fazenda Caveiras" - a process marked by
social, environmental and legal conflicts. One of the greatest challenges of
contemporary designs standardization is to regulate informal settlements,
encompassing cartographic legal aspects, and notarial services to formalize the
ownership of the property, by the legal principle of adverse possession in its various
forms. The importance of legal intervention is paramount, because the
precariousness in the exercise of the right of living confirms the deficit of habitability.
The concern to promote agrarian regularization stems from the consolidation of the
neighborhood and from the will to provide improvement in the living conditions of the
local population, such as health, livability, legal certainty and decrease social
vulnerability. Since 1979, there has been a gradual revision in the housing legislation
in Brazil, revised in the light of the Federal Constitution of 1988, the City Statute or
law number 10,257 of July 10, 2001, and of normative instruments designed to
ensure the orderly growth of cities in a sustainable and socially balanced way.
However, the difficulty lies in the application of these laws in a way to restructure the
urban policy in order to improve the regularization process, which is considered one
of the most important tools, even if applied only as a way to reduce illegalities, in the
search of the undeniable right a citizen has to the city and to the remodeling of the
urban fabric. . In this way, the legalization of ownership exercised with housing
purposes through property registration and recognition of ownership is the legal
framework of the right to live for a population that had once had that very right
threatened. It is hoped that the theme receives new approach and research,
contributing with innovative suggestions or conclusions. / Nesta pesquisa foram analisados, sobretudo, os esforços relativos à regularização
fundiária no processo de ocupação da região noroeste do município de Goiânia,
especificamente o loteamento Jardim Nova Esperança, por ser o primeiro bairro de
ocupação coletiva de Goiânia sendo iniciado em 1979, com a ocupação informal da
área da Fazenda Caveiras processo este marcado por conflitos de natureza social,
ambiental e legal. Este é um dos grandes desafios dos projetos de regularização
contemporânea: realizar uma regularização física dos assentamentos irregulares,
abrangendo os aspectos jurídicos cartorários, promovendo regularização da
titularidade do imóvel mediante o instituto jurídico da usucapião nas suas diversas
modalidades. É evidente a importância da intervenção jurídica, pois a insegurança
no exercício do direito de morar reforça o déficit de habitabilidade. A preocupação
em promover a Regularização Fundiária decorre da consolidação do bairro e da
preocupação de proporcionar melhoria nas condições de vida da população local,
como saúde, habitabilidade, segurança jurídica e diminuição da vulnerabilidade
social. Desde 1979, tem-se uma gradativa revisão da legislação habitacional, revista
à luz da Constituição Federal de 1988, do Estatuto da Cidade, lei nº 10.257 de 10 de
julho de 2001, e de instrumentos normativos criados para garantir o crescimento
ordenado das cidades de forma sustentável e socialmente equilibrada. Entretanto,
está na aplicação dessas leis a grande dificuldade encontrada para reestruturar a
política urbana de modo a obter avanço no processo de regularização fundiária,
considerada um dos instrumentos mais importantes, mesmo que seja apenas como
forma de redução das ilegalidades, para a conquista por todo e qualquer cidadão do
inegável direito à cidade e a recomposição do tecido urbano. Deste modo, a
legalização da posse exercida com fins de moradia, mediante a titulação e o registro
imobiliário, é o marco legal do direito de morar para uma população antes ameaçada
no exercício desse direito. Com isto, o tema pode receber nova abordagem e a
pesquisa, contribuir com conclusões ou sugestões inovadoras.

Becoming Ideal Canadians: The Cultural Adjustment and Citizenship Trials of British War BridesBarranger, Chelsea V. January 2019 (has links)
Historical work on British war brides has been limited to the creation and collection of nostalgic interview anthologies; often by the women themselves or their children. These anthologies focus on the meeting of Canadian servicemen and British women and the women’s journey to and reunion with their husbands in Canada. Discussions of life in Canada and negative experiences are only briefly mentioned. This dissertation argues that this nostalgic view of war brides in the historical literature hides the immigration, settlement, and citizenship challenges faced by these women in Canada during and after the Second World War. Reception of war brides by the Canadian government and public was not as positive as the current scholarship has suggested. While some war brides flourished in Canada, others experienced adaptational problems, including differences in language and religion, navigating Canada’s housing crisis, and hostile in-laws. A few women also experienced problems related to abandonment, abuse, or husbands with undiagnosed post traumatic stress disorder. Since divorce was difficult to get at the time, these women tended to suffer in silence. Some war brides and their children even experienced problems with their citizenship, due to sexist provisions in the Canadian Citizenship Act in 1946, and changes to the Act in 1976, which made proof of citizenship necessary for all Canadians; something that many war brides were unaware of. This dissertation examines the creation and evolution of Canadian citizenship from a perspective that highlights its initial racism and sexism, as well as the consistent bureaucratic bungling regarding the application of its provisions since 1947. While these cases were fixed by amendments to the Citizenship Act in 2008 and 2014 by the Harper government, the citizenship conundrums that this community faced raise interesting questions about what citizenship means and who gets to be a Canadian citizen. / Thesis / Candidate in Philosophy / Most historical work about British war brides has been overly nostalgic and focussed on the collection and creation of interview anthologies; often created by these women and their children. This dissertation argues that this nostalgic view of war brides in the historical literature hides the immigration, settlement, and citizenship challenges faced by these women in Canada during and after the Second World War. The different experiences of these women reveal biases towards their background and gender, relationships damaged by the trauma of war, bureaucratic incompetence in the immigration and citizenship process, and raises important questions about national belonging and the nature of Canadian citizenship, from the post-war period to the present.
