Aidai Idinova Abstract The thesis will look at the how effective human rights protection can be, and especially regarding the Roma population in the Czech Republic. As there is a huge number of human rights, this thesis will focus on the right to education. Moreover, the case study of this thesis is the Roma population in the Czech Republic, therefore the rights and livelihoods of the Roma population will be analysed, examined and evaluated in this country. The thesis will also look at four hypotheses and try to find out if there really exists discrimination in the country, and to what extent; whether religion has an effect towards perceptions towards Roma; whether longer education changes one's attitudes towards Roma; and whether a communist past correlates with greater discrimination. But most importantly, this thesis will look at the right to education and the access to education for Roma students. Education is such an important human right as it has long-term effects in Roma's employment, health care and housing opportunities. Therefore, the Czech educational system will be analysed in regards to the socially disadvantaged group of the Roma population.

This thesis examines the relationships between various groups of human rights, and the effect of globalization and the state on human rights protection. Two hypotheses are examined in path analysis of fifty-two African counties. The first hypothesis considers the proposition that economic, social, and cultural rights implemented prior to civil and political rights in Africa meet the needs of the population better than primary implementation of civil and political rights. The second hypothesis is that globalization has a negative effect on protection of all human rights and that its impact on rights is generally larger than the impact of the state. Within the context of a multivariate model, my analysis does not support the hypotheses. These findings are discussed with regard to the existing literature and several suggestions are proposed for future research.

The African Union (AU) was set up in the year 2000 by the Constitutive Act of the African Union (Constitutive Act). Provisional measures indicated by international courts and quasi-judicial organs in human rights cases Abstract Whenever human rights are at stake there should be quick response of the authority dealing with the situation. Provisional measures are therefore useful tool how to prevent irreparable harm. The aim of my thesis is to analyse provisional measures indicated by various human rights adjudicators from different continents. Main focus is put on legal provisions empowering international courts and quasi-judicial organs to indicate provisional measures, examining whether provisional measures are legally binding, exploring the extent to which international forums indicate provisional measures and highlighting some specific types of provisional measures. The approach is description with elements of comparison. The thesis is composed of six chapters. Chapter one is introductory and defines the concept of provisional measures and its main characteristics and conditions for use. The aim of this diploma thesis is the analysis of the connection between the protection of human rights to environment of the certain quality and the protection of the environment itself. The diploma thesis is divided into three chapters. The first chapter is focused on theoretical basis of the topic, especially the relation between two areas of law - international environmental law and human rights law, concerns advantages and disadvantages of the approaches to this topic, and definitions of the most important terms, including different use of these terms by the individual authors. The second chapter outlines the evolution of these rights in the hard law and soft law universal international agreements with the overlap into the regional systems of human rights protection. The first part of this chapter relates to the documents about substantive rights and the second part examines the procedural documents with special reference to the Aarhus Convention. A presente dissertação trata da dupla incriminação como condição para a extradição. A dupla incriminação surgiu nos contornos da gramática da extradição, com fundamento na aplicação da legalidade penal e em razões de reciprocidade. Atualmente, também se diz que a dupla incriminação embasa-se no princípio da solidariedade internacional. Todos os 27 tratados de extradição assinados pela República Federativa do Brasil possuem a cláusula da dupla incriminação em seus textos. O Supremo Tribunal Federal considera a dupla incriminação nas ações de extradição sob o viés da legalidade penal e mediante exame acurado dos elementos constitutivos do crime objeto da solicitação estrangeira. O Modelo de Tratado de Extradição da ONU recomenda que não se examine os elementos constitutivos do crime no conceito da dupla incriminação, a qual deve ser compreendida no seu sentido in abstrato. No âmbito da União Européia a dupla incriminação deixou de ser obrigatória para o rol de delitos previstos na Decisão-quadro n. 2002/584. O atual modelo de extradição no Brasil no tocante à dupla incriminação não alcança a efetiva proteção do indivíduo, tampouco reforça a cooperação internacional ou mesmo garante à vítima seu direito fundamental de acesso à Justiça. / The current research concerning to double criminality as a condition to extradition. The double criminality was emerged in the contours of the grammar extradition, was based on the application of criminal legality and reciprocity. Currently also says that the double criminality is based on the international solidarity principle. All of the twenty-seven treaties signed by Federative Republic of Brazil have the requirement of double criminality in their texts. The Brazilian Supreme Court takes into account the double criminality under the bias of the criminal legality and the scrutiny of crimes elements, which are subject the foreign requirement. The UN Draft Extradition Treaty recommends do not assess crimes elements under the double criminality concept, which might understand in the sense of in abstract. Within the European Union the double criminality is not obligatory requirement for some offences established in the Framework Decision n. 2002/584. The current Brazilian extradition model regarding double criminality not achieve the effective individual protection nether reinforces the international cooperation in criminal matters nor even ensures that victim his fundamental right of access to Justice.

Le débat portant sur la relation entre la protection des droits de l'homme et la protection des investissements étrangers n’est pas nouveau. Quand cette dernière et la protection des droits de l'homme des peuples locaux s'opposent, quelle solution le régime du droit de l'investissement devrait-il proposer? Est-il possible d'inclure la protection des droits de l'homme des investisseurs étrangers dans le régime du droit international de l'investissement? Il faudrait trouver le moyen de rendre le régime du droit international de l'investissement compatible avec le régime du droit international des droits de l'homme. C'est le problème principal que cette thèse souhaite traiter. Je propose d'inclure la protection des droits de l'homme par le biais de la clause du traitement juste et équitable (TJE) dans les TBI. Le sens littéral du TJE est de donner aux investisseurs étrangers le traitement qu'ils méritent. Cela veut dire que l'on ne devrait leur donner ni plus ni moins que ce qu'ils méritent. On leur donne plus quand leur investissement est protégé sans que l'on accorde l'attention qui lui revient à la protection des droits de l'homme des peuples locaux. En même temps, les investisseurs étrangers méritent un environnement d'investissement dans lequel leurs droits de l'homme sont respectés. Pour l'argument de la cohérence, on a pu voir que le TJE était en général la mise en œuvre de l'état de droit. Les investisseurs étrangers méritent un environnement d'investissement où l'état de droit existe. L'état de droit inclut la protection des droits de l'homme. Les investisseurs étrangers méritent un environnement d'investissement où les droits de l'homme sont protégés. / The relationship between human rights protection and foreign investment protection has been an issue that has been widely discussed. When the foreign investment protection and the human rights protection of local people conflicts, how should the investment law regime solve the problem? Moreover, is it possible that foreign investors' human rights protection be included in the international investment law regime? The international investment law regime should find a way to make itself compatible with international human rights law regime. The aforementioned is the major issue that this thesis intends to address. I have proposed to include human rights protection through the fair and equitable treatment (FET) clause in BITs. The literal meaning of FET is to give foreign investors the treatment that they deserve. This means that foreign investors should not be given neither less than they deserve, nor more than they deserve. Foreign investors were given more than they deserve when their investment were protected without giving due regard to local people's human rights protection. Meanwhile, foreign investors deserve an investment environment where their human rights are protected. For the coherence argument, FET is generally the implementation of the rule of law. In its interpretation, there is a presupposed warrant. The warrant is "foreign investors deserve an investment environment where rule of law is implemented." Foreign investors deserve an investment environment where rule of law is implemented. Rule of law includes the protection of human rights. Foreign investors therefore deserve an investment environment where the protection of human rights is implemented.
