Regularizace nelegální migrace / Regularization of illegal migration

This thesis introduces the phenomenon of illegal migration and the ways of its solution. This thesis focuses on the way of regularization or legalization of the illegal status of the foreigner already residing in the state. In the thesis, the meaning of regularization is presented and an analysis of the three european countries with regularization experience is made. The experience of these three countries can be an inspiration for Czech Republic which has been facing the phenomenon of illegal migration for a short time and refuses the regularization at this moment. At the end of this thesis, there are some proposals on what the Czech republic should concern about before the debates about the regularization. The thesis deals also with the conditions under which the regularization would be meaningful if the Czech Republic considers it.

The Thesis "Securitization of Migration in Central Europe" deals with the issue of international migration in Central European countries from the perspective of Security Studies. The aim of this thesis is to point out to the prevailing security concept of this issue in selected countries of Central Europe (Czech Republic, Poland and Hungary), to find out the reasons for this approach to the migration and asylum issues and also to determine whether the security approach to the issue of migration does reflect the real situation of migration phenomenon in selected Central European countries. Through comparative analysis of the issue of migration in selected countries, this thesis verifies validity of the subsequent hypothesis: The security approach to the issue of international migration does not reflect the real situation of migration phenomenon in selected Central European countries. The variables are migration issues most often connected with the security of state and its society: illegal migration, criminality of foreigners, integration, employment of foreigners, access to the welfare benefits and demographical factors.

Criminological aspects of criminality of foreigners This diploma thesis deals with the criminality of foreigners in the Czech Republic. With the development of globalisation, easier and more accessible mobility of people, but also due to war conflicts or poverty, there is naturally an increased migration of people, which brings with it, among other things, security consequences. Being a foreigner in another country has its own specifics, the most significant of which include minority status, different lifestyles, values, opinions, behaviours and customs. These and many other differences may or may not be criminogenic factors leading to foreigners committing crime. Since this is a very comprehensive topic, which cannot be fully described in one thesis, the aim of the thesis is to analyse the current state of criminality of foreigners in the Czech Republic, to define specific crimes of foreigners, which are among the most frequently clarified and to answer the question whether the crime of foreigners in our territory is increasing or decreasing. Essays on the Economics of Migration from Developing Countries

Le but de cette thèse est d'étudier par quatre essais l'économie de migration de pays en voie de développement. Le premier chapitre évalue l'effet des catastrophes naturelles (principalement en raison du changement climatique), dans les pays en voie de développement, sur des taux de migration et regarde comment cet effet varie selon le niveau d'enseignement des personnes. Nos résultats montrent que les catastrophes naturelles sont positivement associées aux taux d'émigration et impliquent aussi la migration des personnes fortement qualifiés. Le deuxième chapitre présente les différents canaux expliquant l'intention de migrer illégalement. Une des nouveautés de l'analyse est qu'elle utilise une enquête sur mesure parmi des individus sénégalais urbains. Nous constatons que les migrants illégaux potentiels sont enclins à accepter un risque substantiel de mort et sont souvent jeunes, célibataires et avec un niveau bas d'éducation. Nous montrons aussi que le prix de l'immigration illégale, les réseaux d'immigrés, de hautes espérances, des politiques d'immigration serrées et le pays de destination jouent tous un rôle dans l'empressement de migrer illégalement. Le troisième chapitre complète le deuxième en étudiant le rôle d'aversion des risques et le taux d'escompte dans la migration illégale du Sénégal. Nos résultats montrent que ces préférences individuelles comptent dans l'empressement de migrer illégalement et payer à un contrebandier. Finalement dans le quatrième chapitre, nous nous sommes intéressés à la place des migrants sur les marchés de crédit dans un contexte rural. Selon nos résultats, avoir un migrant dans un ménage augmente autant la probabilité d'avoir un prêt que sa taille, que le prêt soit formel ou informel. Nous constatons aussi que cet effet positif reste significatif peu importe si le prêt est pris pour des raisons professionnelles ou simplement pour acheter de la nourriture. / The aim of this thesis is to study through four essays the economics of migration from developing countries. The first chapter assesses the effect of natural disasters (mainly due to climate change), in developing countries, on migration rates and looks at how this effect varies according to the level of education of people. Our results show that natural disasters are positively associated with emigration rates and also involve the migration of highly skilled people. The second chapter presents the different channels explaining the intention to migrate illegally. One of the novelties of the analysis is that it uses a tailor-Made survey among urban Senegalese individuals. We find that potential illegal migrants are willing to accept a substantial risk of death and tend to be young, single and with a low level of education. We also show that the price of illegal migration, migrant networks, high expectations, tight immigration policies and the preferred destination country all play a role in the willingness to migrate illegally. The third chapter completes the second one by studying the role of risk-Aversion and discount rate in illegal migration from Senegal. Our results show that these individual preferences matter in the willingness to migrate illegally and to pay a smuggler. Finally in the fourth chapter, we are interested in the effect of migrants on credit markets in a rural Senegalese context. According to our results, having a migrant in a household increases both the likelihood of having a loan and its size, whether the loan is formal or informal. We also find that this positive effect remains significant no matter if the loan is taken for professional activities or simply to buy food.

As a country that is highly affected by the changing nature of international migration due to transformative forces of globalization, Turkey is now being defined as a country of both immigration and emigration. This thesis analyzes Turkish state&rsquo / s international migration politics and policies with regard to recent global trends in migratory movements. It examines the underlying dynamics that govern the policy making processes and tries to identify the problems stemming from them. The primary goal of the thesis is to make an elaborate assessment of the existent institutional framework and to detect the presence of securitization paradigm in the political and legal setting of international migration in Turkey by means of qualitative research methods. It investigates how international pressures and trends, national interests, political considerations and especially the dynamics of fragmented institutional structure have affected policy making strategies. In view of these factors, the thesis suggests adopting a humanitarian approach towards refugees, asylum seekers and migrants that leaves political concerns behind and avoids securitization of the issue.

Šiuolaikinėje visuomenėje nelegali migracija – rimta problema ne tik Lietuvai bet ir visai Europos Sąjungai. 1990 m. Lietuvai atkūrus nepriklausomybę, emigraciniai srautai pradėjo sparčiai didėti, per Lietuvą nusidriekė nelegalių imigrantų iš įvairių šalių keliai į trokštamas Vakarų ir Šiaurės Europos šalis, Lietuvos įsiliejimas į Šengeno erdvę atvėrė kelią laisvai judėti joje ne tik teisėtai esantiems ar gyvenantiems asmenims, bet ir nelegaliems migrantams. Darbo temos aktualumą lemia tai, kad nelegali migracija šiuo metu yra labai sparčiai besivystantis reiškinys, kurio pagrindinis barjeras nelegaliems migrantams iš trečiųjų šalių yra išorinė ES siena, kurią teisėtu ar neteisėtu būdu perėję jie atsiduria Šengeno erdvėje. Šio darbo tikslas - išanalizuoti Valstybės sienos apsaugos tarnybos pareigūnų veiklą nelegalios migracijos kontrolės srityje, ją reglamentuojančius teisės aktus ir įgyvendinimo ypatumus. [toliau žr. visą tekstą] / In modern society illegal migration is a very serious problem not only in Lithuania but for all European Union. Since Lithuania restored it's independence, emigration amount started to increase very rapidly. Lithuania became the way to illegal migrants to the desirable Western and northern European countries. The main purpose of this paper is to analyze State Border Guards service officers activity in the illegal migration control department, to analyze all the law acts and ways of implementation. The study of international law, administrative law and national legislation, the analysis of court decisions, scholarly articles, dissertations and publications of the press, law enforcement reports and statistics, supplemented with other information at the subject, as well as comparison of theoretical and practical information received in interviews, the State Border Guard officers implementation of the control of illegal migration, the formulation of problems and proposition of possible solutions is made. The test results lead to the conclusion that the State Border Guard Service and competences of illegal migration prevention and control are indefinite, there is no clear migration processes of the institutions implementing the distribution of functions, but under the current regulations of the State Border Guard officers, illegal immigration controlled efficiently.

Today, it is a very crucial problem that many European countries are encountering demographic challenges stemming from the population decline and aging and according to many studies and future projections, this demographic trend will reach more critical levels for the next 50 years. The most prominent impact of this demographic situation will be on social security systems that the functioning and sustainability of pension and health care systems will be severely damaged with regard to the rapidly increasing number of elderly and the decline in number of young labor force resulting from the low births rates all over Europe. In this context, labor migration that received significant attention, has risen up to the agenda of Europe to serve as a policy option to mitigate the adverse consequences of demographic challenges. Taking its impetus from the mentioned demographic problem, this thesis aims to analyze the discussions over labor migration as a foreseen policy option to compensate the shortage of labor force in Europe. It also intents to bring relevant data and current debates together to generate a ground in order to open this critical issue to discussion and to elaborate the feasibility of labor migration need for Europe. In this regard, the thesis scrutinizes the reactions of European states regarding their reluctance to open their borders again for &ldquo / mass influx&rdquo / and examines briefly the other preferred and enforced policies that exclude migration option, such as aiming to increase fertility rates, ameliorate social security systems or encourage the native labor force participation. By taking all these into account, this thesis aspires to attract attention to this urgent problem and evaluates the labor migration need in Europe by presenting the relevant reactions and appraisals shaping the migration policies both at the nation state and EU level. Finally, this thesis attempts to contribute to the literature in terms of generating a base for further intensified discussions and studies which constitutes a significant need in the context of interaction between demography and migration in Europe.

The thesis called Illegal work deals with illegal employment of foreigners in the Czech Republic, which is in most cases connected with trafficking in human beings for the purpose of forced labor. The first chapter is generally devoted to the definition of the concept of illegal work under Act No. 435/2004 Coll. on Employment and Act No. 262/2006 Coll. Labour Code. The second chapter brings the view of the employee, employer and the state on illegal work. The following third chapter focuses on the sectors in which illegal work occurs most often. The fourth chapter describes the working conditions of employees who are illegally employed and are exploited in every possible way, especially in terms of pay, working conditions or working hours. The fifth chapter contains factors that affect the exploitation of migrant workers and trafficking in human beings for the purpose of forced labor.
